The owner of the property or approved agent shall file a `Street Permit' application with the Building Department (see attached) accompanied by a$1000.00 Surety Bond and the appropriate $25.00 dollar fee. This is a common procedure for construction projects in the City. Said permits are issued for 30 days and renewable upon reapplication.. With the information provided this office at the time of this issuance of this letter it appears the location proposed on Holyoke Court acceptable, though this office retains the right to review upon submittal. The issuance of a Street Permit for a dumpster shall under no circumstances be construed as a waiver from any other pernit or license required, nor any of the requirements, provisions, or regulations there under. We fully endorse the cease occupancy directive and life safety measures required by you, the fire department and electrical department for our retail tenant and will act in every way to ensure that the tenant rectifies each situation. As the building owner, tenant and architects, we fully understand the life-safety issues that are being addressed. We have not had the best relations with the tenant in question and access to their space has always been a problem even as owners of the building. This will be changed immediately. The tenancy was occupied at the purchase of the building and we were aware of a living space that exists within the space in question. We informed the tenant that the space was illegal and could not be rented and were assured by Sally Milo, the owner of the two stores at the time, that it was only used during the day by her grandchildren while she watched the store and that it was not an occupied rental unit. Later it came to my attention that our former partner, August "Fuzzy" Faulstich was not forthcoming to you about the apartment's existence and he was reprimanded for his actions and again we informed the tenant that any rental of the unit would be a violation of her lease and she would be evicted. There is absolutely no benefit to us in the rental of the unit. Now Sally's daughter has taken over one store and sold the other business while Sally still holds the lease. Possibly she was not informed of the illegality of the apartment and acted unknowingly. We have given these newcomers a last chance to remain our tenant and will work with them to alleviate your concerns. We have required her to cease and desist from the apartment, provide required egress and signage and comply with the electrical inspector's requirements. As architects, we fully understand addressing these issues in a compliant manner and have ordered new doors and hardware, required immediate fixes to the egress path and signage and are enforcing the requirement of the tenant to hire an electrician to safely deal with the electrical violations.
