On their behalf, we wish to call your attention to the zoning non-compliance of the newly-constructed condominium building located at 188 Essex Street in Salem owned by the Essex Court Development Corporation, which abuts the premises of the East India Mall. We believe that the condominium building violates the zoning ordinance of the City of Salem in at least the following two respects: 1. The building as constructed encroaches upon the premises of the East India Mall. The variance granted to the developer of the condominiums gave it leave to exceed the five-foot side-yard requirement and build to the property line. In fact, they have built beyond the property line. (This encroachment is also a violation of Section 309. 7. of the State Building Codc. ) 2 . Under the variance, the owner was exempted from the ordinance requirement with respect to on-site, off-street parking on the proviso that "a minimum of 107 parking stickers be obtained from the Parking Authority for use by the individual owners of the units for as long as the City of Salem operates its Municipal Garage adjacent to the site. Each unit deed shall contain a requirement that such unit shall purchase a parking sticker from the Parking Authority so long as the City of Salem operates its Municipal Garage. " To our knowledge, the owner has made no arrangement or agreement with the Parking Board to comply with this condition. Moreover, any such preferential, long-term dedication of parking spaces in the garage for the use of the condominium owners (or for any residential use) would be in .:a MCCORMACK be PUTZIGER Mr. William H. The present owners of the Mall have succeeded to the position of the Redevelopment Authority under that agreement. The structure is now and must continue to be in violation of the parking condition contained in the variance pursuant to which it was constructed. In view of these violations, we call upon you, pursuant to Massachusetts General Laws, Chapter 40A, Section 7, to enforce the zoning ordinance of the City of Salem by withdrawing the building permit for the Essex Court Condominium building, by ordering the owner to cease and desist from all further work under that permit, and by withholding the issuance of any certificate of occupancy for any portion of the building, all until such time as the zoning ordinance is complied with. The results of those discussions are as follows: A. Emergency Generator. Discussion centered on the adjustment of the vibration isolator pads under the generator. Steve Santry requested to hear the generator run again before giving his approval. B. 2-hour exterior wall along the Mall. At the Church Street Building, aluminum siding over 1 /2 " fire rated gypsum wallboard was presented as the exterior facing from grade to approximately seven feet above the..third floor in the encroachment area. From the top of the aluminum siding to the roof, the 3-5/8 " x 7-5/8" face brick will be re-installed. These assemblies were acceptable to Bill Monroe and Steve Santry. At the Essex Street Building, aluminum siding was also presented as the external facing for the existing 2-hour rated gypsum drywall wall, to run from grade to the underside of the brick veneer (approximately at the third floor level) . These two issues are: 1 . Excessive noise and vibration from the emergency generator mounted on the roof of the Church Street Building. 2 . Component make-up of the fire rated exterior wall abutting the East India Mall. As the Architect for the project, our office has reviewed the above items and certifies the folowing: Issue One: Emergency Generator. We have reviewed the installation and can report that the generator was installed in the location specified on the Contract Drawings. The generator was found to be mounted on neoprene vibration isolators of a type recommended by the generator manufacturer ( catalog cut enclosed) . Upon consultation with the generator manufacturer, the electrical subcontractor made some adjustments in the attachment of the vibration isolators to the generator steel frame. These adjustments have improved the performance of the vibration isolators and the generator as now installed is in conformance with the Project Contract Documents and the Massachusetts State Building Code. Page 2 . February 21 , 1989 William Monroe, Inspector of Buildings Issue Two: Exterior fire rated wall by the E. India Mall. The exterior wall of the Essex Court Building which abuts the East India Mall is required by the Massachusetts State Building Code to be 2 hour fire rated if a bearing wall and 1-1 /2 hour fire rated if a non-bearing wall. The source for this rating is Table 214 of the Code (copy enclosed) . The wall, as specified on the Contract Documents, was constructed as a 2 hour rated wall. This was accomplished using three different wall assemblies for the Church, Link and Essex Buildings respectively. Due to the encroachment problem, the assemblies at the Church and Essex Street Buildings were forced to be modified. The following modifications will be made to remove the encroachments and maintain the wall' s two hour fire rating. a) Church Street Building. The Contract Documents call for this exterior wall to be constructed as per U.L. Design Number U425, which was done (copy enclosed of U.L. design make-up) . For a portion of this wall the exterior brick veneer had to be removed due to the encroachment. In its place, aluminum siding will be installed on a portion of the wall. Aluminum siding is an acceptable exterior facing as listed in the component breakdown of U.L. Design Number U425. The only other modification required will be for the exterior gypsum sheathing to be replaced or covered with 1 /2 " fire rated gypsum wallboard. This 1 /2" board on the exterior, along with the 3 layers of 1/2 " on the interior will give 2 " of fire rated gypsum wallboard, which is the U.L. requirement for a two hour wall with metal studs. It should be noted that the aluminum siding will extend from grade to approximately 7 '-0" above the third floor. Above this, the 4 " brick veneer will be re-installed, bringing that portion of the wall in conformance with U .L. Design Number U425. Page 3 . February 21 , 1989 William Monroe, Inspector of Buildings b) Essex Street Building. The Contract Documents call for this wall to be U.L. Design Number U438 (copy of U.L. design enclosed) . This wall is not meant to be exposed to the weather, so a cap was installed between the two buildings. However, due to the encroachment problem, this cap will be removed, exposing the wall to the weather. The exterior of this wall will also be covered with aluminum siding, an acceptable exterior facing for fire rated walls as previously shown. Although the final assembly is not a specific U.L. design number, the two hour rating of U.L. Design Number 0438 is not compromised by the addition of the non-combustible aluminum siding product. The assembly has 2 " of fire rated gypsum wallboard (as does U.L. U425 as previously discussed) , which meets the U.L. requirement for a two hour fire rated wall with metal studs. The above discussion represents Vitols Associates' understanding and certification of the status of the two outstanding issues. We are available for further clarifications, if requested or required. The demolition was carried out successfully with the exception of the exit door at Essex Street being slightly askew, resulting in hard opening, however we have addressed this problem. This work is required along buildings such as yours in order to place our building adjacent to the property line. In partially executing this work, we have discovered an existing situation that has led me to write you this letter. The structural drawings for the Mall indicate that the second floor is cantilevered from the structure, therefore this work will not impact the upper level in any way. Section C indicates that we will replace all existing construction as is when this operation is completed and at no cost to you. During the interim, we will construct a temporary weather enclosure for that portion of the building affected. I wish to point out a technical cost issue with regard to the existing Mall construction that should rightfully be borne by your company if required by the City of Salem Building Inspector. According to the Massachusetts State Building Code, every building constructed in the Commonwealth is to have a perimeter foundation wall and footing to protect against damage due to frost upheaval. East India Mall at the locations described in the letter and accom- panying sketches does not have a perimeter footing. We propose to support your section of wall by incorporating a haunch onto our foundation wall. As you know, the project site fronts on both Church and Essex Streets, and was formerly the site of Almy's Department Store. The proposed development is to consist of four (4) mid-rise buildings housing 107 condominium units. The configuration of the four buildings is in the shape of a rectangle along the outside perimeter of the property, with the center open, creating a courtyard. The way that the site has been designed has the courtyard elevation equal to that of the lower level, or approximately ten ( 10) feet below street level. In order to drain this courtyard area, it will be necessary to pump the storm water up to the existing drain located in the abutting streets. It has been brought to our attention that the existing street drains are presently flowing at capacity and may not be adequate to accommodate any additional increase in the rate of runoff. In view of the assessed drainage capacity, we propose the following: 1. Since the site was previously all impervious, with building coverage and runoff directed into the existing street drains, an evaluation will be calculated as to the existing rate of runoff from this site for a 10-year design storm. 2. The proposed "Essex Court" development will then be analyzed, calculating the peak rate of runoff leaving the site via the connection of roof leaders, plus the pumping rate of the drainage lifted from the courtyard area contributing to the street drains. If it can be demonstrated that the peak rate of runoff leaving the site, for the design storm, will be controlled such that the post-development rate is no greater than that of the existing, and that there is no increase in the rate of runoff from the site, we believe that a storm water connec- tion permit can then be granted. Before we begin the detailed hydraulic calculations necessary to perform the above, we request your approval of this design concept. As stated, in a pre- vious conversation with you, upon actual inspection, including a hammer ring check on the tank shell, the damage will be documented both in writing and with photographs. 3. How do you intend to plug these holes? As stated in Step 1 of the "Tank Construction Procedure" an epoxy patching compound with glass cloth reinforcement will be used. Please see enclosed data sheets 1 and 2. 5. How many years do you estimate that this particular tank will hold its present configuration if an epoxy resin lamination is not installed? Typically a new tank of this size is fabricated from ,-" plate. Without knowing the ground water table and perco- lation conditions, as well as the current and future acid and mineral contents, this determination is impossible to make. 8. Do you have a method of testing the soundness of the tank? The tank can be tested for structural integrity using an ultrasonic thickness meter to determine actual thickness versus original tank thickness. (Since erosion/corrosion is not likely to have occurred in the tank top original thickness should be ascertainable.) A vacuum test could be performed on the tank, but would j be extremely costly, and is not necessary in this case. Vacuum boxes could be placed within the tank to determine the extent of deterioration. I II .. t 6. An epoxy fri�td yh�d'lled "composite" liner will be able to with- stand adegree of stress and tank movement before suffer- ing disbondment or integral damage to the composite. When tested, on a 1/8" mandrel bend experiment, these materials received a "Good" rating, meaning that the material flexed over a 1/8" radius bar and failed somewhere between a 450 and 900 angle bend. Such catastrophic distortions would probably never be encountered in the tank unless its walls were collapsing (i.e. implosion). Moreover, the tensile strength of the epoxy compos- ite liner by itself 50, 900 psi versus 60, 000 psi for steel. The epoxy composite possesses the inherent properties to resist de- formation and will significantly contribute to the overall strength of the tank. during shifting. Should cracks start in the steel outer shell the epoxy composite inner shell with its tremendous bond strengths (greater than 2,000 psi adhesion) will deter crack pro- pogation. This lot serves not only the city but also the bank and trash pick-up for C.V.S. by means of a right of way. Much of the work involved is behind the present security fence on the S.R.A. property and can be done without in- terruption of the lot . It is also my opinion that the times indicated are much exaggerated and that the resurfacing and stripping of the lot can be done over weekends as can the raising of the three grates involved and any other work on S.R.A. property. Although this may be a small inconvience to Welch Group when one considers the inconvience to the city, bank and C.V.S. that inconvience pales by comparison.
