We the undersigned are dismayed at the flagran VNMton of the Board
of Appeals April 27, 1983 unanimous decision against conversion of 70 Essex
Street from a two to a three family dwelling. In recent weeks this conversion
has surreptitiously been brought into being, culminated by a third family rental.
Electricity has been brought to the third floor, no doubt without the proper
electrical permits/inspections. The Fire Marshall has previously indicated
the dwellings ' Certificate of Compliance is only for a two family,dwelling.
Both the Fire Marshall and the Planning Department have stated existing density
problems in the area precluded allowance of additional parking. The parking
for 70 Essex Street has reached proportions where at times the corner at
Washington Square East has been impassable for buses and no doubt for fire
apparatus.
We request your immediate intervention to enforce those ordinances in
violation, taking whatever actions necessary for the dwelling to be returned
to compliance with the Board of Appeals decision.

Dear Sir:
Ch1 11/13/92,_the,Health-Mpartment„received an anonymous aotlplaint that the
owner ofr0 Essex Street in Salem yas running a business in the first floor
hallway and-that-tie egresses were blocked with merchandise he was selling.
This complaint was referred to the Building Departzrent, relative to egress
and zoning.
On 11/18/92, a complaint was received from Shawn Santerre of 70 Essex Street
notifying this department he was being represented by Attorney Gustafson
relative to blocking front entrance of 70 Essex Street.
On 11/18/92, we received a letter from Attorney Gustafson representing Mr.
Santerre requesting the Health Department inspect the premises in order to
prevent injury in the event of fire. Copies of this letter were forwarded
to both Building and Fire Prevention Departments.
On 11/19/92, in accordance with State Sanitary Code, Chapter II, 105 CMR 410.000,
Health Inspector Virginia Moustakis met on site with the owner,Andrew Firestone.
The following were noted:
Miscellaneous decorated jars, bottles, plates, etc were arranged on both sides
of each stairtxead of the stairwell leading to the second floor.
There was a door on each side of the small front hallway, both leading to the
first floor apartment according to Mr. Finestone. There were no objects directly
obstructing either entrance or exit from these doors. Set back scrreAiat in the
hallway were a table, chair, baskets, plants, etc.
The backhallway had no obstructions at time of inspection.
On 11/20/92, a reinspection was conducted by Health Inspector Virginia Moustakis
and at that time, all objects had been removed frcm the stairtreads. On the
left stairway wall were two wooden knock-knack shelves containing miscellaneous
items. The table, chair, plant, plant container and other objects were still
there.

The Health Department Inspector requested that Mr. Finestone remove both
the wall shelves and other items.
There were three doors to three floors in the backhallway; in the front
hallway, there were only two doors.

property as well as number of legal apartments.

I am writing in response to complaints regarding the
first floor. There are no obstructions blocking either
of the two egresses in the front hallway nor the third
exit from the rear. In addition there is not a business
or any related activity being operated on the premises.
An inspection was made on November 20, 1992 by
Virginia E . Moustakis Sanitarian for the Salem Health
Department which will verify this response .

This office has received complaints regarding a business being
operated from the first floor of the above referenced property. The
complaint also alleges the hallway on the first floor is blocked,
preventing safe egress from the building, this condition must be
corrected immediately.
The property in question is located in a Residential Two Family
district and business use is not an allowed use in that district and would
require action from the City of Salem Zoning Board of Appeal.
Please contact this department within seven (7) days of receipt of
this notice. Failure to do so will result in this office taking the
appropriate legal action.
