Dear May Ching:
This office received a complaint from one of your tenants living at the
above mentioned property. Do to his complaint, an inspection of the premises
was conducted and the following violations were observed.
1. Chimneys at roof level needs to be repaired.
2. Corner board at left front of house is pulling away and must be
re-secured.
3. Broken window at first floor level on driveway side must be removed
and replaced.
4. No damper inside fireplace, this must be replaced at once.
5. Chimney must be cleaned and checked by Certified Chimney Sweep Co. to
insured its safety and usability, or all fireplaces should be
blocked off.
6. Tenants must have accessibility to basement.
7. Basement must be cleaned of all fire hazard chemicals and paints.
8. Basement must be cleaned and maintained orderly.
9. You will have to appoint someone to manage this property that we
can contact to see that these items are being taken care of.
Please notify this department upon receipt of this letter as to your
course of action to rectify this situation.

SECTION 102.0 ORDINARY REPAIRS
102.1 General: Except as provided in Section 113.1, a permit shall not be required
for ordinary repairs to buildings and structures.
SECTION 103.0 INSTALLATION OF SERVICE EQUIPMENT
103.1 General: When the installation, extension, alteration or repair of an
elevator, moving stairway, mechanical equipment, refrigeration, air conditioning or
ventilating apparatus, plumbing, gas piping, electric wiring, heating system or any
other equipment is specifically controlled by the provisions of this code or the
approved rules, it shall be unlawful to use such equipment until a certificate of
approval has been issued therefor by the building official or other agency having
jurisdiction. `
SECTION 104.0 MAINTENANCE
104.1 General: All buildings and structures and all parts thereof, both existing and
new, shall be maintained in a safe and sanitary condition. All service equipment,
means of egress, devices and safeguards which are required by this code in a
building or structure, or which were required by a previous statute in a building or
structure, when erected, altered or repaired, shall be maintained in good working
order.
104.2 Owner responsibility: The owner, as defined in Article 2, shall be
responsible for the safe and sanitary maintenance of the building or structure and
its exitway facilities at all times, unless otherwise specifically provided in this code.

A hearing on this Petition was held Tuesday, September 20, 1977, with mambers Jane

T_ Lurdregan, Arthur Labrecque, James Boulger and Associate Member Douglas hopper
present. Notices were sent to abutters and others in accordance with Mass. General Laws,
Chapter 808.
Additional evidence was heard on this petition on September 27, 1977 with said
urei'Obers present.
ALty. Albert Pitcoff represented the Petitioner before the Board. The house located
at 52 Essex Street is a large wood and brick building situated on a large lot with
frontage on both Essex and Forrester Streets. Plans were presented showing the proper
number of parking spaces for a three family dwelling.
The Board voted unanimously to grant a Special Permit requested to allow the second
and third floor at 52 :Essex Street to be used as two additional apartments and to complete
all the work necessary in order to make said apartments usable.
The motion its restricted in that, there shall be no access to the parking area by
way of Forrester Street.
The Board found that :it could grant the Special Permit requested because it would
in no way derogate from the intent of the Salem Zoning By-laws and because the use allowable
is one that is in harmony with the surrounding neighborhood.
