RE: Section 202 Housing Project, 403, 405, 405 1/2 Essex Street, Salem, MA (MHC# 9651)
Dear Ms. De Mayo:
Thank you for supplying the ,Massachusetts Historical Commission with the additional
information concerning the proposed HUD-assisted housing project referenced above. These
materials were received on July 26, 1996. The project locations are eligible for listing in the
National Register of Historic Places and are located in the McIntire Historic District which is
listed in the State Register of Historic Places and is also a Local Historic District.
MHC-staff are in receipt of the Americans with Disabilities Act Consultation Form you
submitted which has been signed by the local historical commission and the local handicapped
advisory committee.
MHC staff have reviewed the ADA Consultation Information as well as the project plans
previously received, It is understood from these plans, dated April 8, 1996, that the
renovation project will involve extcriur rnayonry repointing and stabilization, limited in kind
replacement.of wood trim; and the installation of a universal access ramp. The proposed
plans call for an alternative path of travel to the building, rather than through the primary
entrance. This project involves creating an unassisted accessible ramped entrance for people
with disabilities at the rear entry.
MHC has determined under the consultation procedures that compliance with the General Rule
of the Americans with Disabilities Act (Title 1128 CFR 35.151) would potentially threaten or
destroy the historic significance of this building. MHC staff agrees that Title 1128 CFR 1.51
(d)(2)(3) may be used becauge of the existing architectural constraints associated with the
primary entrance. After review of this information, I concur to a finding of no adverse effect
for this action (36 CPR 800.4(c) and 950 CMR 71.07 (2)(b)(2)) provided the following
condition is met:
The project proponent will submit an application for a variance to the Massachusetts
Architectural Access Board (MAAB) for approval.
220 Morrissey Boulevard,Boston,Massachusetts 02125 (617) 727-8470
Fax. (617) 727-5128 TDD: 1-800.392-6090
These comments are provided to assist in compliance with Section 106 of the National
Historic Preservation Act (36 CPR 800) and M.G.L. Chapter 9, ss. 26-27C, as amended by
Chapter 254 of the Acts of 1988 (950 CMR 71.00).
A copy of these materials should accompany material submitted to the Advisory Council on
Historic Preservation, The_Old Post Office Building, 1100 Pennsylvania Avenue, NW, 4809,
Washington, DC 20004.
If you should have any questions, please contact William Smith or Paul Holtz at this office.
Thank you for your cooperation.

DECISION ON THE PETITION OF MIROSLAW KANTOROSINSK-I-FOR-tA Fiu_
VARIANCE AT 407 ESSEX ST./40 WARREN ST./403-405 ESSEX (B -1 )
-' TY . .
A hearing on this petition was held ,May 30, 1990 with the following Board
Members present: Richard A. Bencal , Chairman; Edward Luzinski , Vice Chairman;
Mary Jane Stirgwolt, Acting Secretary and Richard Febonio. Notice of the hearing
was sent to abutters and others and notices of the hearing were properly published
in the Salem Evening News in accordance with Massachusetts General Laws
Chapter 40A.
The petitioner is requesting variances to allow parcels to be divided as per
the plans submitted. Property is located in a B-1 district.
The Variances which have been requested may be granted upon a finding by this
Board that:
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
The Board of Appeal , after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . No opposition was voiced to the plans.
2. Petitioner has received approvals from the Historical and Planning Boards.
3. The proposed plan would begin to straighten out lot lines in the area.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property but not
the district in general .
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
