DECISION AND ORDER After the order of remand in this case dated April 15 , 1997, the Board held further hearings and rendered a further decision. Still, however, the reasons given for most recent, undated decision, apparently rendered on June 9, 1997, are entirely without substance, and indeed without any factual or logical basis : 1 . Although the facts do show some problems in the past with behaviors by some roominghouse residents, the evidence also shows that the management of those behaviors has improved, rather than deteriorated, since the time that the plaintiff acquired ownership. 2 . The Board' s reliance upon the plaintiff' s so-called "admission" that he does not have the requisite ability necessary to run a roominghouse is entirely misplaced. Such "admission" appears to be taken out of context, and there is no evidence tending to show that the plaintiff, who is a professional school teacher and a landlord elsewhere, is not qualified. 3 . The finding that the building does not comply with the requirements of the building code, fire code, and health code, and as such is not fit to be a roominghouse, is simply false. As noted in my prior order, the plaintiff' s City of Salem, Licensing Board, Lodging House License Application is accompanied by a Routing Slip bearing the signature approvals of the Historic Commission, Health Department, Fire Prevention. Inspector, Building Inspector, and Department of Public Services. And after the re-inspections that occurred in the course of the case in this Court, the plaintiff promptly corrected all of the minor violations that were found. 4 . The Board' s reliance upon the former building manager' s refusal to speak with them is entirely misplaced . The dialogue that occurred was in a public setting, and private information was requested. In any event, the building manager has since departed. For the reasons stated in the plaintiff' s memorandum November 18 , 1997, the plain if filed f' s motion for summary judgment is allowed, and the defendant' s cross-motion is denied. The 3`a floor inspection floor tiles in bath needs repair. There was 1 leak in skylight into ceiling, broken skylight window. Railing height 3`d floor stairway needs to be repaired and raised to 36". Bars on window in stairway 18" and below. Replace toilet room floor. Room 2-3 bureau in front of 2"d means of egress. That hallway also has debris in the way must be kept clear. t Room 2-5 blocked 2nd means of egress. Room 2-6 blocked 2°d means of egress, no smoke at landing, scrape and paint water leak in room.
