Chapter II: Minimum Standards of Fitness for Human Habitation,an inspection was conducted of the property 11
Read Street#5 permitted by occupant Tasha Moncrief,conducted by David Greenbaum, Health Agent on August
27, 2024,at 1:009m.
Notice: if this rental unit is occupied by a child or children under the age of 6 years, it is the property owner's
responsibility to notify tenants of lead related reports and tests, and to ensure that this unit complies fully with 105
CMR 460:000: Regulations for Lead Poisoning Prevention and Control. For further information or to request an
inspection,contact the Salem Board of Health at 978-741-1800.
You are hereby ORDERED to make a good-faith effort to correct the violations listed on the enclosed inspection
report and to take all positive action to prevent these violations from occurring again in the future.
Failure on your part to comply within the time specified on the enclosed inspection report will result in a complaint
being sought against you in Trial Court. Time for compliance begins with receipt of this Order.
Should you be aggrieved by this Order,you have the right to request a hearing before the.Board of Health. A request
for said hearing must be received in writing in the office of the Board of Health within 7 days of receipt of this Order.
At said hearing,you will be given an opportunity to be heard and to present witness and documentary evidence as to
why this Order should be modified or withdrawn.You may be represented by an attorney. Please also be informed
that you have the right to inspect and obtain copies of all relevant inspection in investigation reports,orders and other

Article II of the State Sanitary Code, 105 CMR 410.000. Upon Inspection the following
were noted:
There are two old water heaters on the ground in front of this building.

),42- The front porch light is broken and not working. Owner to repair or replace

There is a broken ceiling the with exposed wires in the front hall. Owner to

6. There is a fuse box in the basement that services this unit that has improper
30 Days .235 �electrical connections. Owner must hire a licensed electrician and replace
this fuse box service.
NOTE: This Violation has been referred to the City Electrician for follow up.
7.Abe bathroom light/fan fixture in this unit does not work. Owner must repair
30 Days .235 'i/ or replace this light/fan fixture.
8. There is no valid Certificate of Fitness on file with the Board of Health for this
unit. Owner must repair the above violations and apply for and receive a
valid Certificate of Fitness for this unit.

Notice of Occupants' Legal Rights and Responsibilities
This document summarizes some of the legal options that you may have when the owner of a property you live in has
not fixed certain problems in your home, as required by the state Housing Code (105 CMR 410.000).This is not legal
advice.Talk to an attorney before you decide to withhold your rent or take other action described here.
Safe and Healthy Rental.Housing:
Rental housing in Massachusetts must meet minimum standards to protect the health,safety, and well-being of occupants.
The Housing Code, 105 CMR_410.000, Minimum Standards of Fitness for Human Habitation (State Sanitary Cade, Chapter li),
is the state regulation that sets these minimum standards.The Massachusetts Department of Public Health, Bureau of
Climate and Environmental Health's Community Sanitation Program (CSP) issues this regulation, but the standards are
enforced by local health departments.1 CSP works with local health departments and the public to provide training and
technical assistance about the Housing Code. For more information, please see mass.gov/lists/housing-community
sanitation.
Your Responsibility to Keep Your House Safe and Healthy
The Housing Code also,has requirements that people living in rented homes or apartments need to meet.There are some
problems like pests, mold; and keeping exits clear,that might need the owners and occupants to work together to fix the
problem. For example,occupants need to make sure there is no food or garbage left out that could attract pests or keep
their belongings out of exit hallways. If the local health department is doing an inspection, either by your request or for
another issue,the local health department may tell you there is something that you need to fix.The local health
department may issue you an order to correct and give you a certain amount of time to fix the problem.
Your Right to Safe and Healthy Housing and Protection from Retaliation
If you think that conditions in your home are unsafe or unsanitary and may violate the Housing Code,you should inform
your landlord first. If your landlord does not adequately address these concerns,you should then contact your local health
department.They will conduct free inspections of your home and will order your landlord to fix any violations of the
Housing Code.You can find contact information for your local health department by calling your city or town hall or visiting
their website.City/town websites are listed at: mass.gov/lists/massachusetts-city-and-town-websites.
Your landlord is not allowed to raise your rent or try to evict you just because you have made a complaint to them or to
the local health department about the violations.This is called retaliation,and you may be able to sue the landlord for
damages if this happens and you made your complaint in writing(M.G.L.c.186,s.18 and c.239,s.2A).
Your Right to a Hearing
You may ask for a hearing in front of your local Board of Health. You must do this in writing and within.the timeframes
below. If you send a written request on time to the local health department, a hearing will be held within 14 calendar days.
If you do not make a written request within the timeframes below,you lose the right to a hearing.The chart below shows
the reasons you may request a hearing, and the timeframe you have to send the request.
Reason You May Request a Hearing Number of Days to Make the Request in Writing
Your home was not inspected by the local health department 30 days from the day you contacted health department
The.inspector did not find violations you think exist 30 days from the last inspection by the health department
The inspector did not issue an order to correct violations 30 days from the last inspection by the health department
The inspector did not enforce the order to correct 45 days from when the owner received the order to correct
Within five days after the hearing,the local health department is required to issue a final decision on your complaint (105
CMR 410.840). If you do not agree with the decision, or at any point throughout the process,you can file an appeal in
housing court.

This is the local code enforcement authority responsible for enforcing the regulations.

Your Options if an.Owner Does Not Fix the Problems
If your landlord does not fix violations of the Housing Code in your home,you may have some options as described below.
These are not your only options, but they are common actions that tenants and occupants take in these situations. Before
taking legal action, contact an attorney to protect yourself. If you cannot afford an attorney,you may be eligible for free
legal aid services.Go to masslrf.org to find available options for free legal advice.To find additional information on.your
legal rights and responsibilities when your landlord does not fix violations of the Housing Code,visit:
niasslegalhelp.ore/legal-tactics or madeuptocode.org.
Option 1: Go to Court
If your landlord does not fix the problems that the local health department ordered them to fix, or if you believe there
are problerns in your home that may be in violation of the Housing Code,you may also ask a court in your area to order
your landlord to correct the problems.
To file a co mplaint,contact the Housing or District Court Clerk in your region.To find the closest.Housing or District
Court go to mass.gov/orgs/housing-court/locations or mass.pov/orits/district-court/locations.These courts deal with
cases about residential housing including eviction, property damage, and Housing Code enforcement. For help filing a
complaint, you can contact Court Service Centers at mass.gov/info-details/learn-about-court-service-center. .
You can request that the court order the landlord to:
Fix the Problem:You or the local health department may file a petition in Housing or District Court.to order the
owner to fix the violations of the Housing Code (M.G.L. c. 111,s. 127 A, Q.and/or
Refund Rent You Have Paid:You can file a complaint requesting that your landlord pay back all or part of the rent
you pa id during the time that there were Housing Code violations.You can claim either 1) Breach of Warranty of
Habita bility or 2) Unfair and Deceptive Practices (M.G.L. c.93A),or both.
For both claims,you will need to prove that your home had Housing Code violations, and that the owner knew about the
violations and did not fix them. Breach of Warranty of Habitability can also be filed by the local health department.
Option 2: Withhold Rent Until Repairs are Made
If your landlord does not correct certain housing code violations,you may be able to hold back some or all of your
rent payment until they make repairs(M.G.L.c. 239,s.8A).Save the rent money you withhold.A judge may
require you to pay all or some of it back. If they do and you don't have this money,you may be evicted. If you
withhold rent and your landlord tries to evict you from your home,you will need to prove,at a minimum,that:
• The violations may endanger or materially impair the health,safety,or well-being of a tenant o.r occupant;Z
• The rental property owner knew about the violations before you started withholding your rent; and
• Yo xa did not cause the violations.
Option 3: Make the Repairs_Yourself
State law allo%ris you to use your rent money to pay for certain repairs(M.G.L c. 111,s.127L),and not pay that
amount in rent to your landlord.You cannot withhold more than 4 months' rent in a 12-month period to pay for
repairs. If you withhold some or all your rent and use it to make repairs and your landlord tries to evict you from
your home,you will need to prove: .
• The local health department or court determined that the violations may endanger or materially impair the
health,safety,or well-being of a residential tenant; 2
• The landlord was issued an Order to Correct for those violations; and
• The owner did not start the repairs (or sign a contract for work)within 5 days after getting the Order to
Co rrect and did not complete repairs within 14 days after receiving the notice of violations.
Option 4: End your Lease Early and Move
if you meet cer-tain conditions,you may be able to end your lease or rental agreement and move out within a
reasonable tirn e. Contact an attorney to find out more about this option..If you cannot afford an attorney,you may
be eligible for 1free legal aid services.Go to masslrf.org to find available options for free legal-advice.

Dear David Greenbaum,
Please accept this letter as my acknowledgement of the violations noted based on your
inspection of 11 Read St Unit#5 on August 27tn
Please be aware that I have forwarded the list of violations to the head of the HOA
because it is my understanding that items 1-5 are the responsibility of the Condo
Association to fix, since they are not specifically related to my Unit, and I am not the
owner of the building. Please let me know if this is not the case.
I have been trying to address items 6-8 since I became aware of the situation. In early
August, I sent J.P McCurdy Electrical out to try to resolve as many of the electrical
issues as possible and provide me with an estimate for a panel upgrade. The problem
with the loss of power was not fully resolved on that day. When the electricians
returned, the tenant (Tasha Moncrief) would not allow them back in the building to
complete the evaluation. J.P McCurdy Electrical is scheduled to return to the property/
unit to complete the evaluation and provide me with an estimate so the panel upgrade
can be scheduled and completed, providing Ms. Moncrief allows them access to the
Unit.
Ms. Moncrief and I are currently in a custody dispute as we share a child together and I
am not allowed on the property to address these issues myself.

1. There are two old water heaters on the ground in front of this building.

2. The front porch light is broken and not working_ Owner to repair or replace
10 Days .235 the front porch light fixture.
3. There is a broken ceiling tile with exposed wires in the front hall. Owner to
30 Days .500 replace the broken ceiling tile.
4. The light fixtures in the front hall are missing protective covers. Owner to
30 Days .235 replace all protective covers on all light fixtures.
.270 5. The back door in the third-floor hall doesn't close or lock properly. Owner to
30 Days I .500 repair the door to close and lock properly.

6. There is a fuse box in the basement that services this unit that has improper
30 Days .235 electrical connections. Owner must hire a licensed electrician and replace
this fuse box service.
NOTE: This Violation has been referred to the Ci- Electrician for follow u .
7. The bathroom light/fan fixture in this unit does not work. Owner must repair
30 Days .235 or replace this light/fan fixture.
8. There is no valid Certificate of Fitness on file with the Board of Health for this
unit. Owner must repair the above violations and apply for and receive a

My name is Carla Savchuk,and I am helping my son Jason coordinate the repairs for the two new violations noted from the Certificate
of Inspection that was done on 10/02/2024.
Please know when the door got damaged,Jason asked Ms. Moncrief to send pictures so he could determine if the door had to be
replaced or repaired.She never sent pictures.The tenant later informed him that the door was fixed by one of her friends.
He is working with a contractor now to repair the door and check on the stove,which are the two new violations noted that are directly
related to his unit.The contractor has asked for two things before he can provide him with a quote:
• Take a couple of good pictures showing the inside and out,top to bottom capturing the frame of the door-for the
door in need of repair.
• Regarding the two gas burners that aren't working. Please ask the tenant to first troubleshoot the most common issue:
Usually the burner(s)that won't ignite are clogged due to grease or other food debris. To fix or check to see if this is the
problem,simply remove the grate covering the troubled burner. Then remove the burner cap, which should liftoff with ease.
The burner base should lift right off. Clean the surrounding area with a warm, soapy wash cloth and soak the burner base in
vinegar or warm water and use a brush(toothbrush)to remove any debris.Last step, clean any remaining debris out of the
burner hole with a toothpick or sewing needle. Reinstall the burner and cover and try igniting the burner.
The question we have for you is-Is Jason allowed to request the tenant's assistance/cooperation with taking and providing pictures
of the door and attempting to clean the stove burners before having to send a repair person out for what may be a common household
task?
As you probably are aware, he is in the middle of a custody battle with Ms. Moncrief and is not allowed on the property.
Any guidance you can provide will be very much appreciated.
Also, items 1&2 are in the general/common area of the building and are the responsibility of the Condo Association.He has
forwarded the violations once again to the head of the HOA to address. If we have misunderstood who is responsible for items#1 and
#2,please let me know.

Hello Mr.Greenbaum,
I just wanted to provide you with an update on the status of the execution of the eviction of 11 Read St Salem, MA Unit 5.
• As I mentioned in an earlier email, Ms. Moncrief didn't show up for the first-tier event date for eviction on
02/14/2025 and was defaulted.
• Jason had to wait 10 days to request the issuance of the execution order. He requested it on 02/27/2025.
• Ms. Moncrief filed a motion to remove the default on 02/28/25 and was granted a hearing date of 03/21/25.
• Ms. Moncrief failed to show up on 03/21/25 and was defaulted again.
• The Execution order is in the process of being issued now.
She continues to cause ongoing problems in the unit. She now is overflowing the bathtub causing water damage to the
unit beneath her.
We will keep you posted as things move along.As soon as she vacates the property the door and stove will be
addressed.All other issues have been fixed. She refused the delivery of the new stove, and the contractors that were
fixing the door were pulled off the job due to the tenant being unruly and disrespectful.

Update after Housing Court on:02/14/2025
Hello Mr.Greenbaum,
As you know,Jason is having difficulty getting the repairs completed at his unit due to resistance and uncooperativeness from Ms.
Moncrief.
There was a scheduled hearing on 02/14/2025 addressing two issues:
• Continuance of follow-up hearing from 01/31/25 regarding repairs
• First-tier event date-eviction
The Board of Trustees for 11-13 Read St.are demanding that Jason evict Ms.Moncrief. Please see the Demand for Eviction letter
from their attorney dated 07/23/24. Failure to do so would result in litigation against him.
Ms.Moncrief didn't show up and was defaulted.The next step is for Jason to receive the execution and have a constable or sheriff
serve it.
I am sharing this with you because most likely Jason will not be able to get the door repaired and the stove replaced until Ms. Moncrief
vacates the property. We were able to work with the HOA manager and the two violations in the common area are repaired.
I will continue to keep you updated as things progress.

• My son took the tenant(Ms. Moncrief)to housing court on 01/10, petitioning the housing court for an order allowing contractors
on the property to access and make repairs.
• The housing court ordered the tenant to allow contractors access to the Unit for the purpose of making repairs.
• All repairs were ordered to be completed by landlord by 01/24.
• Follow-up court date January 31st.
A contractor was hired to repair items 1,2,and 3 on the below list and a new stove was purchased, scheduled to be delivered&
installed and removal of old stove.
However,only items 1 &2 were repaired as scheduled on January 23rd.These are the two items in the common area of the building.
• The contractors were faced with frustration,disrespect and uncooperativeness when they started to work on the door at Unit 5.
Between 1 -1:30 p.m.the contractors were pulled off the job. Please see the remarks noted on the attached invoice.
• The tenant refused to accept the new stove because it is"your typical 4-burner stove"(not five burner).Claims it is a down
grade. Item#4.
The next housing court date is 2/14. Until then,he will not be able to schedule any future repairs.Should you have any questions,

The best advice I can give is to have your son consult with an attorney. He should petition the housing court for an order for
access to the unit so the contractor can view the needed repairs and time to make the repairs.
In reference to the violations in the common areas that are the responsibility of the condo association,your son will have to work
with the association to ensure that these violations are corrected. His attorney should work with the association to address these
issues as well.

Mr.Greenbaum,
On December 25th Ms. Moncrief was notified that the repair man was scheduled to go out this Friday. She agreed to the date and
time. However,this evening Ms. Moncrief stated that she will not be allowing the repair man access to the building/unit. She is upset
with other issues that are non-related and is being difficult.
She said rather than allowing Jason to make the repairs she will take him to landlord-tenant court. Is she in any type of violation with
the Board of Health for interfering with the repair schedule?
Please advise as to how we should proceed. It is difficult to find good contractors. Canceling and rescheduling is not going to entice
them to make us a priority.Additionally, I believe Jason might be subject to a 1-hour minimum charge.
Any guidance you can provide would be very much appreciated.

Dear Mr. Greenbaum,
Ms. Moncrief was released on December 16,2024. My son has a repair man scheduled to go out and look at the door to provide a
quote to repair or replace it this Friday 01/03/2025. Once the quote is obtained,and if it is within reason,the work will be scheduled as
soon as possible. I will try to check the stove burners again to make sure they are all still in working order before scheduling the
reinspection.
Please confirm that once the violations highlighted in yellow(items 3&4) have been repaired,that everything noted during
your inspection(s)that pertain to his unit#5 have been properly addressed.
It is our understanding that items 1 &2 are the responsibility of the Condo association/HOA since they are in the common areas of
the building.We have shared this information with them on a few occasions.

Ms. Moncrief is not agreeable to having anyone in her home while she is incarcerated to coordinate the completion of the repairs.
We respectfully ask for a 30-day extension from the date of her release.She is scheduled to be released on December 23rd.

Hello Mr. Greenbaum,
I just wanted to give you an update on the status of the 2)repairs,that are noted as violations,that are directly related to
Jason's unit.
Ms. Moncrief is incarcerated and not able to coordinate the scheduling of repairs. The door was scheduled to be
replaced on Saturday October 26th,but she got arrested on Wednesday, so it had to be canceled.All five burners on the
stove work.They just needed to be cleaned. I understand they still need to be reinspected.
Although Ms. Moncrief is not at the unit at this time,the restraining order still prevents my son from going there. We
will try to coordinate the repair of the door, if either me or her daughter are able to coordinate it. Otherwise, an
extension will need to be granted. Ms. Moncrief is scheduled to be released on December 23rd.

Good Afternoon Ms.Savchuk,
understand and appreciate that this is a difficult situation,unfortunately, I am not able to ask or require the occupant to assist in
making the repairs or taking pictures so the contractor can provide a quote. The best advice I can provide is to discuss with a
lawyer how to proceed with these repairs and obtaining the necessary photos/information for the contractor to provide the
quote and or have a technician address the issue with the burners.
I know this may not seem very helpful but that is the best advice I can offer.
