9, 12, 14, 15, AND 16 CEDAR ROAD PIP SITE DESIGNATION TETRA TECH RECEIVED OCT 2 8 2024 CITY OF SALEM BOARD OF HEALTH October 24, 2024 Mayor Dominick Pangallo 93 Washington Street Salem, MA 01970 Re: Public Involvement Plan Site Designation 12 and 14 Cedar Road, and 14 Barnes Road (RTN 3-38273) and 16 Barnes Road and 9, 12, 14, 15, and 16 Cedar Road (RTN 3-38210) Salem, Massachusetts Dear Mayor Pangallo: On behalf of our client, Prolerized New England Company, LLC (PNE), Tetra Tech, Inc. is providing this Designation and response to the Petitioners who filed an October 7, 2024 petition for designation as a Public Involvement Plan (PIP) site with the LSP for the Ingemi Trusts and Trustees, who are Potentially Responsible Parties (PRPs) under the Massachusetts Contingency Plan (MCP) and the Massachusetts Superfund, Chapter 21 E. On October 10, 2024, PNE received a letter dated October 8, 2024 from the Salem City Solicitor forwarding a copy of the petition. PNE is also a PRP, and has agreed with the Ingemi PRPs to perform future MCP response actions, under reservation of rights to seek recovery of all response costs from the PRPs. The Trustees have performed initial response actions with its LSP at the sites. PNE hereby designates the above-referenced disposal sites as a PIP site in accordance with the MCP. As required by the MCP, this Designation is made within 20 days of PNE's receipt of the petition. PNE will prepare and implement a final PIP plan under full reservation of its rights to seek recovery of response costs from the Ingemi and other PRPs. In accordance with the MCP (310 CMR 40.1405(5)), the following deadlines are applicable to the PIP Site: Holding of a public meeting within 80 days of receipt of the petition, in this case by no later than December 29, 2024, to present a draft PIP Plan and solicit comments and questions from the attendees; Publication of a public notice at least 14 days prior to the public meeting, including mailing a copy of the public notice to each of the ten petitioners and to the Mayor and Board of Health in the City of Salem; A minimum 20-day public comment period after presentation of the draft PIP Plan at the public meeting; and Preparation of the final PIP Plan within 30 days of the close of the public comment period. 1; Fax tetratech.com Please contact the undersigned if you have questions.
