The enclosed plans and technical information have been prepared in accordance with the Salem
Subdivision Regulations and Zoning Ordinance. A preliminary subdivision application was previously
submitted on November 15, 2023, and approved by the Planning Board on March 7, 2024. The purpose
of the Preliminary Plan was to start the freeze provisions of MGL 40A for the land illustrated on the
plans. This provision of MGL 40A affords landowners certain zoning ordinance "freeze" provisions by
filing a preliminary plan. These freeze provisions can be extended by filing a definitive plan with 7
months of the preliminary plan. The Board is reminded that while the owner must follow the
subdivision process, it is solely intended to be administrative, and no improvements shown on these
plans are intended to be utilized. Care has nonetheless been taken to ensure that all necessary
standards for utilities, the roadway, stormwater management and other infrastructure have been met or
exceeded. Three (3) waivers have been requested for the sole purpose of adhering to modern
practices. These waivers include use of the North American Vertical Datum of 1988 (NAVD88) datum in
lieu of the City of Salem datum, omission of the City of Salem flood elevation of 15.36 (City of Salem

Datum) and use of the Federal Emergency Management Agency (FEMA) flood elevation of 10(NAVD88)
and omission of the boundaries and types of wetlands as shown on the maps titled "Wetlands of Salem,
Massachusetts" as the wetland boundary has been approved by the City of Salem Conservation
Commission by an Order of Resource Area Delineation (MassDEP File#064-0766). Granting of these
waivers will not alter that design of the plan in any manner.
