Zoning Board of Appeals Application
Application ID: ZBA-25-24 Date submitted: June 17, 2025
TO THE BOARD OF APPEALS:
The Undersigned represent(s) that they are the owner(s) of a certain parcel of land located at:
Address: 7 1/2 LYME STREET Zoning District: R2
An application is being submitted to the Board of Appeals for the following reason(s):
We are proposing to utilize the existing building footprint of the one-family residence located at 7-1/2 Lyme Street in the R-2 Zoning
District, which is currently not in compliance, in reconstructing the first floor level with an addition of a new 8'-0" by 6'-0" mudroom, as
shown in the Architectural Drawings provided. Additionally, we are proposing an extension of the second floor level within said existing
footprint only and adhering to the existing building height, which is currently below the maximum. Per Section 4.1 of the Zoning
Ordinance, the existing footprint of the residence is not in compliance on the rear, left, and right side of the property boundary, however
our request is reactionary to the existing non-compliance of the site and the inability to utilize any additional lot coverage, requesting that
alternatively if we can be allowed to utilize said existing footprint as historically allowed and concurrently in contrast to the modern Zoning
Ordinance and its requirements.
For this reason, I am requesting:
[ true ]Variance (s) from provisions of Section 4.1 of the Zoning Ordinance, specifically from The existing rear and side setbacks are
currently not in compliance, as per the site's historical (125 year old) context and previous allowance(s), resulting in the current hardship
that heavily restricts and/or disallows any feasible improvement to the exsting building and site. In response, we are thereby requesting
what we believe to be a reasonable and respectable expansion, in context to the abutters' properties and established neighborhood
vernacular, within the existing footprint across the current existing floor levels..
[ ] A Special Permit under Section of the Zoning Ordinance in order to
[ ]Appealing a Decision of the Building Inspector:
[ ] Comprehensive Permit:
Current Property Use: Residential One Family Are Lot Dimensions Included: Yes
The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be
constructed as per the plans submitted, as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning
Ordinance.
Statement of Hardship (for Variances):
