Why is this application being submitted to the Board of Appeals?The below statement must
describe what you propose to build,the dimensions,the zone property is in,and the zoning
requirements. (Example: I am proposing to construct a 10' x 10' one story addition to my home
located at 3 Salem Lane, in the R-2 Zoning District.The Zoning Ordinance requires the minimum
depth of the rear yard to be 30 feet.The current depth of my rear yard is 32 feet; the proposed

An application is being submitted to the Board of Appeals for the following reason(s): A
The residential addition consist of 71 square foot single story addition to expand mudroom and
add a bathroom to the first floor, and a 130 square foot wood deck on an R2 noncompliant lot.The
owners have ZBA approval for a previous version of this project that remained 2-feet off the
property line(April 30, 2024) however, upon considerration, it is necessary to build to the
property line on order to fit a full bath on the tight lot.

Why is the special permit being sought?
Due to the small lot size,the proposed project increases the existing 52% building coverage (more
than the 35% allowable)to 57% building coverage.The project is within the 10ft side yard setback
required, but extends to the rear property line in order to fit in a needed full bath for the family on
the first floor.Zoning R2 requires a 30ft setback.

of said Zoning By-Laws would involve practical difficulty or unnecessary hardship to the

This small but important project will allow the Spittle family to remain in their home in Salem by
retrofitting their home to meet the needs of their family.A more adequate entry/ mudroom will
serve the entire family and the healthcare workers for their daughter as they come in providing a
safe transition space from the outside. Similarly,a full bath on the first floor will improve the daily
lives of the entire family as there is currently only a small powder room on the first floor.
b)Traffic flow and safety, including parking and loading;
There will be no change to traffic flow and safety, including parking and loading.
c) Adequacy of utilities and other public services;
The small addition displaces an existing half bath to create a full bath, and the current water and
sewer facilities are adequate; no other public services are affected.
d) Impacts on the natural environment, including drainage;
The new project including 71 sq ft addition and deck includes a surrounding french drain around
the deck to percolate all new roof run-off.
e) Neighborhood character; and
The small addition and deck is minimal and will be in keeping with the historic nature of the
surrounding neighborhood character.
f) Potential fiscal impact, including impact on City Tax base and employment.
There is no foreseenfiscal impact on the City Tax base and employment.
