The Undersigned represent(s) that they are the owner(s) of a certain parcel of land located at:

An application is being submitted to the Board of Appeals for the following reason(s):
The residential addition consist of 71 square foot single story addition to expand mudroom and add a
bathroom to the first floor, and a 130 square foot wood deck on an R2 noncompliant lot. The owners
have ZBA approval for a previous version of this project that remained 2-feet off the property line (April
30, 2024) however, upon consideration, it is necessary to build to the property line on order to fit a full
bath on the tight lot.
For this reason, I am requesting:
[ ]Variance (s) from provisions of Section of the Zoning Ordinance, specifically from .
[ true ] A Special Permit under Section 3.3.5 Nonconforming Single- and Two-Family Residential Structures. Building Coverage and
Rear Setback of the Zoning Ordinance in order to Due to the small lot size, the proposed project increases the existing 52% building
coverage (more than the 35% allowable) to 57% building coverage. The project is within the 10ft side yard setback required, but extends
to the rear property line in order to fit in a needed full bath for the family on the first floor. Zoning R2 requires a 30ft setback.

The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be
constructed as per the plans submitted, as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning
Ordinance.

Statement of Grounds
a) Social, economic, or community needs served by the proposal;
This small but important project will allow the SpiƩle family to remain in their home in Salem by retrofiƫng their
home to meet the needs of their family. A more adequate entry / mudroom will serve the enƟre family and the
healthcare workers for their daughter providing a safe transiƟon space from the outside. Similarly, a full bath on
the first floor will improve the daily lives of the enƟre family as there is currently only a small powder room on the
first floor.
b) Traffic flow and safety, including parking and loading;
There will be no change to traffic flow and safety, including parking and loading.
c) Adequacy of uƟliƟes and other public services;
The small addiƟon displaces an exisƟng half bath to create a full bath, and the current water and sewer faciliƟes
are adequate; no other public services are affected.
d) Impacts on the natural environment, including drainage;
The new project including 71 sq Ō addiƟon and deck includes a surrounding french drain around the deck to
percolate all new roof run-off.
e) Neighborhood character; and
The small addiƟon and deck is minimal and will be in keeping with the historic nature of the surrounding
neighborhood character.
f) PotenƟal fiscal impact, including impact on City Tax base and employment.
There is no fiscal impact on the City Tax base and employment.
