Re: Decision of the Zoning Board of Appeals to grant a six-month variance extension to
Pasquanna Developers, Inc. at 50 Circle Hill Road to exercise rights granted by the July 1, 2024,
Board Decision that approved the construction of two (2) single-family dwellings on five (5)
separate and contiguous land court parcels. The Decision approved the construction of one (1)
residential dwelling unit on a nonconforming lot of 10,788 square feet, with the other dwelling
meeting the requirements of the Zoning Ordinance.
*This Decision amends the original Decision submitted on June 5, 2025, by adding the address of
50 Circle Hill Road in the decision header. The amended decision was submitted on June 25, 2025.
The Salem Zoning Board of Appeals met on Wednesday, May 21, 2025, to discuss your request
for a six (6) month variance extension to exercise rights granted by the July 1, 2024 Board
Decision. This Decision allowed the construction of one (1) residential dwelling unit on a
nonconforming lot of 10,788 square feet.
The Department of Planning and Community Development received a letter from Patrick DeIulis
on behalf of Pasquanna Developers, Inc. The letter dated April 4, 2025, received April 8, 2025,
requested a six (6) month variance extension.
This decision would expire on July 1, 2025, however, the Permit Extension Act of 2024 extended
the decision to July 1, 2025. The request before the Board on May 21, 2025, extended the
decision for this variance by an additional six (6) months from July 1, 2026 to January 1, 2027.
At the May 21, 2025, Zoning Board of Appeals Meeting, Mr. DeIulis stated he previously
requested Zoning Board of Appeals relief, with the rights lapsing due to a protracted process with
the Conservation Commission. Mr. DeIulis stated that Pasquanna Developers, Inc., had spent a
year clearing the site and determining how much ledge is on the site. Mr. DeIulis further
described how Pasquanna Developers, Inc., has been working with the City Engineering

Department and has more Departments to work with. Mr. DeIulis noted he is exercising caution
to ensure the permit does not expire again.
The Zoning Board of Appeals voted five (5) in favor (Nina Vyedin (Chair), Hannah Osthoff, Peter
Habib, Christa McGaha, and Stephen Larrick), and zero (0) opposed to grant the requested six (6)
month extension to exercise rights granted by the July 1, 2024 Zoning Board of Appeals Decision.
All conditions in the July 1, 2024, Zoning Board Decision shall apply to this extension. This
determination shall become part of the record for this project .
