Dear Attorney Hopkins:
As you are aware the above captioned matter(s) are scheduled for next Friday. It
is my understanding that tenants in illegal apartment (Dow Street #1) have moved out.
The health department has received information that there may be a new tenant there.
This would be a flagrant violation of the code. Please address with Mr. Thomas.
It was also my understanding that the second floor tenants (22-24 Park, 2nd Fl)
would be out by March 28h. Please update. The tenants are still reporting problems to
the Health Department.
Each of the three existing apartments need certificates of fitness. Please have Mr.
Thomas contact both the Health Department (Ginny Moustakis 741-1800) and Building
Inspector Kevin Goggin 745-9595) to re-inspect the premises next week prior to our
court date.
Lastly, I have also enclosed the final receipt form The Clipper Ship Inn for
$373.00 for the time the Health Department had to put up the tenants because of no heat
in their apartment. Please address this with your client as well.

I had forwarded a number of Letters/Memorandums
to former Building Inspector Leo Tremblay on
December 19th, 1997, February 16th, and June 04th,
1998 . These correspondences are all related to
the legality of 33 Dow Street .
The Issue of the Apartment ' s legality was raised
by the then current occupants who did not want to
pay back rent owed, but wanted to use any means
available to try and avoid eviction.
In Mr . Tremblay's letter dated December 30th, 1997
he came to the wrong conclusion, based on inadequate
and incomplete information, that the Apartment was
added without the proper permits .
The facts regarding the legality of 33 Dow Street
were gathered from such sources as The City of
Salem's Engineering Department and the R.L . Polk &
Co. 's Salem City Directory, the same such sources
the Building Department uses to verify an apartment
or building .

I believe that after you have reviewed all of the
correspondence you will agree that 33 Dow Street
was not Illegally Added, but has always been a
legal existing occupied apartment .
I also believe that I have confirmed that the
property has always been a four ( 9 ) unit building.

Legality of this apartment, please do not hesitate
