Dear Ms. St. Pierre:
The Department of Environmental Protection, Waterways Regulation Program has
reviewed a request, dated 21 March, 2005, which seeks permission of the 289 Derby Street Trust
to demolish certain existing structures, as located on a plan entitled "Proposed Building
Demolition, Source: Coastal Survey" submitted with the referenced 21 March, 2005
correspondence. The location of said request is identified as 289 Derby Street, Salem.
The Department has determined, in accordance with 310 CMR 9.22(1)(d), that the
referenced activities do not require an application for a License. Therefore, this letter serves as
your written approval from the Waterways Program for the demolition of the referenced
structures. However, prior to proceeding with referenced work, all other applicable local, state
and federal approvals must be obtained. If you have any questions concerning this matter, please

Dear Mr. Duke.:
Pertaining to the requirements you must meet concerning the
possible renovations to the 1st Floor at the aboved referenced
property, please be aware of the following:
Section 906 of the Massachusetts State Building Code says,
"a three (3) hour fire rated ceiling is required between the
1st and 2nd floors.
Section 210 of the Plumbing Code requires you to have:
(1) water closet and lavatory for each sex - 50-99 persons
(2) water closets and lavatories for each sex - 100-149 persons
(3) water closets and lavatories for each sex - 150-200 persons
Section 608 of the Building Code requires, (2) exits for a maximum
of - 300 persons.
Section 607 says 150 L.F. maximum travel on exit corridors with
sprinklers.

In accordance with provisions of General Laws of the
Commonwealth of Massachusetts and the Salem Fire Code,
the following regulation governing the demolition of
structures within the City of Salem shall be followed.
This regulation is made in the interest of fire prevention,
to prevent conditions which are or may become dangerous as
a fire hazard, or are otherwise in violation of law.
1. Before a structure can be demolished, the Salem
Fire Department Shall conduct a preliminary
demolition inspection, to ascertain any conditions
which may require a fire watch or other preventive
measures , to be taken before, during and/or after
said demolition process.
2. A permit to demolish or remove a building or structure
shall not be issued until said inspection has been
conducted, and a report of requirements necessary for
prevention of fire and life safety hazards shall be
obtained by the applicant for the permit.
3. The requirements outlined in the report shall become
a part of the restrictions portion of the demolition
permit issued by the Building Inspector, for compliance
with the Code.
4 . The inspection report shall include, but not necessarily
be restricted to the following:
A. Welding and cutting permit required.
B. Fire watch to be maintained by a professional
off-duty firefighter, with such equipment as
determined by the head of the Fire Department.
