An application is being submitted to the Board of Appeals for the following reason(s):
WE BUILT A FENCE AT THE HEIGHT OF 4'BUT OUR FRINT YARD ELEVATION IS AT 4'SO IT BOUGHT THE FENCE UP ABOVE THE
PROPER HEIGHT FOR THE CITY ORDIANCE.OUR FRONT OF PROPERTY IS HIGHER THAN THE SIDEWALK THAT SLOPES
DOWNWARD AND THERE IS A RETAINING WALL UNDER THE FENCE.(PROBABLY EASIER TO SHOW YOU PICTURES)WE
WOULD LIKE TO APPLY FOR A VARIENCE SO WE CAN KEEP THE PROPOSED FENCE IT LOOKS AMAZING AND IS ONLY THE 4'
HIGH AND IS SEE THREW SLATS.WE HAVE CHILDREN AND HIGHLAND AVE IS THE BUSIEST STREET IN SALEM SO THIS
FENCE WOULD BE MAKING THE YARD ALOT SAFER FOR THE KIDS TO PLAY IN.WE CHASE A BALL AT LEAST 5 TIMES A DAY
INTO THE TRAFFIC OF HIGHLAND AVE IT IS DEFINATLY NOT SAFE RIGHT NOW.
THE CURRENT HIGHT OF MY YARD IS 4' WE WOULD LIKE TO BUT THE 4'FANCE ONTOP OF THE WALL THAT IS THERE.IT
WOULD ONLY BE HIGH AT THE END OF THE YARD WHERE THE REST OF THE YARD SLOPS DOWN.THE HIGHEST PART OF
THE WALL IS AT 47"AND THE LOWEST PART IS 30"SO THE FENCE WOULD SLOPE THE SAME WAY AS THE WALLAND YARD.
AT THE INTERSECTION OF HIGHLAND AND PROCTOR THE FENCE IS NOT BLOCKING THE VIEW OF TRAFFIC PLEASE SEE THE
VIDEO AND PICTURES.THERE ARE MANY CARS THAT PARK ON HIGHLAND AVE AND THE FENCE IS WELL INSIDE THE VIEW
OF TRAFFIC.WE WOULD LIKE A VARIENCE FOR THAT AS WELL.THE FENCE AT THAT POINT ON THE SIDE YARD IS UNDER
THE 7'HIGH RESTRICTION.THE SIDE YARD FENCE MEASURES AT 4'6"WELL UNDER 7%

The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be
constructed as per the plans submitted,as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning
Ordinance.
Statement of Hardship(for Variances):
WE HAVE CHILDREN AND THIS FENCE WOULD MAKE OUR YARD SAFER FOR THEM TO PLAY IN AS OF RIGHT NOW WE ARE
CHASING A BALL INTO THE TRAFFIC OF HIGHLAND AVE AT LEAST 5 TIMES A DAY.1 THINK THAT HIGHLAND AVE IS THE
BUSIEST ST IN SALEM AND PUTTING UP THIS FENCE WILL MAKE MY FAMILYS PLAY TIME SAFE AND GIVE US A LITTLE
PRIVACY IN OUT YARD.THE FENCE IS NOT HURTING ANYONE NOR IS IT AFFECTING ANY OF OUT NIEGHBORS PROPERTYS
IT IS ONTOP OF A RETAINING WALL THAT HAS BEEN THERE FOR 2 YEARS.THE FENCE IS ONLY 4'HIGH AND HAS SPACE
INBETWEEN THE SLATS SO ITS NOT TOTALLY BLOCKED OUT.ITS IS OFF OF THE CITYS PROPERTY AND IT IS ON OUT
PROPERTY.IT IS SAFE AND SECURE AND IS NOT AFFECTING TRAFFIC OR THE BLINDING OF TRAFFIC ON HIGHLAND AVE.AT
NIGHT THE LIGHTS ON THE POSTS LOOK BUEATIFULAND ITS SUCH A GREATADDITION THE NIEGHBORHOOD.WE TAKE
PRIDE IN OUR HOME AND MY HUSBAND SPENT MANY HOURS BUILDING THIS FENCE WITH HIS OWN HANDS AND HE IS SO
PROUD AT HOW NICE IT CAME OUT AND WE HOPE THAT YOU WILLAS WELL DRIVE BYAND SEE HOW AMAZING IT LOOKS.
SPECIAL CONDITIONS ARE OUR FRONT YARD AT THE HIGHEST POINT IS 4'HIGH SO IF WE PUT UP A FENCE THAT IS ONLY 4'
HIGH IT WOULDNT EVEN REACH ARE YARD.THE FRONT OF OUR HOUSE THE SIDEWAL SLOPES SO THERE IS A DIFFERENT
HIGHT AT EVERY T OR 4'SO THE RTETAINING WALL IS ALSO HIGHER AT SOME POINTS.WE ARE LOOKING FOR A SPECIAL
PERMIT SO WE ARE ABLE TO KEEP A 4'FENCE THE WHOLE WAY EVEN THOUGH THE SIDEWALK MEASUREMENTS MAY VARY
BECAUSE THE ROAD IS SLOPED

A) I THINK IT SERVES A COMMUNITY NEED BY MAKING THE PROPERTY MORE DISIRABLE MAKING PEOPLE WANT TO MOVE
TO SALEM IS THEY SEE BEAUTIFUL HOMES.
B) IT DOES NOT DO ANYTHING TO THE FLOW OF TRAFFIC THE FENCE HAS BEEN UP FOR WEEKS NOW AND THERE HAVE
NOT BEEN ANY ISSUES INVOLVING TRAFFIC.IT IS NOT BLOCKING DRIVERS IT IS FAR OFF THE ROAD.DOES NOT AFFECT
PARKING OR LOADING OF ANY KIND.

D) DOES NOT IMPACT DAINAGE THE FENCE DOES NOT TOUCH THE GROUND AND THERE WAS DRAINAGE BUTT INTO THE
WALL THAT HAS BEEN THERE FOR 2 YEARS AND THERE HASNT BEEN A PROBLEM.IT IS BUILT ON THE WALL SO IT DOESNT
AFFECT THE GRASS OR AND NATURAL THING.
E)I THINK IT AFFECTS THE NIEGHBORHOOD CHARACTER IN AGOOD WAY IT MAKES THE NEIGHBORHOOD MORE
APPEALING THIS HOUSE WHEN WE BOUGHT IT WAS A DUMP AND THE WORK WE HAVE PUT INTO IT SINCE HAS BROUGHT
THE VALUE UP AT LEAST DOUBLE.EVERYONE THAT HAS STOPPED,DRIVEN BY OR WALKED BY HAS COMPLEMENTED US
ON THE FENCE WE HAVE NOT HAD ANY BAD FEED BACK ON IT AT ALL.WE DO HAVE ONE NEIGHBOR THAT COMPLAINS
ABOUT EVERYTHING BUT JELOUSY IS A TOUGH ONE TO FIGHT.WE JUST WANT TO ENJOY OUR HOME AND MAKE IT LOOK
PRETTY AND I THINK WE ARE DOING A GREAT JOB AT IT EVEN SOME OTHER NEIGHBORS STARTED FIXING UP THEER HOMES
AND ONE NEIGHBOR ASKED MY HUSBND TO BUILD THEM A FENCE TOO.
