11.5 Hardy Street petition amendment AMENDMENT TO PETITION 24-39 FOR 11 1/2 MADY STREET Petitioner/Owner hereby amends her petition to add a request for a Variance under Section 3.3.4 to extend and alter her nonconforming structure to increase existing nonconformities as to side and rear set-backs, and to add two small dormers on the roof that do not increase the height of the structure measured in feet which will allow her to provide more headroom and light to the 31d floor apartment. The grounds for this request are: 1) Special circumstances: because of the unique existing conditions of her structure being a townhouse attached side-by-side to another structure, that the two townhouses are located in different zoning districts, the long and narrow shape of Lot and the location of her structure at the front left corner of the lot, are unique circumstances which do not generally affect the zoning district where the property is located; 2) A literal enforcement of the provisions of the Ordinance would Impose substantial hardship, financial or otherwise on the applicant: 3) The size and rear location of the improvements are such that the variance may be granted without substantially harming the public good, and 4) Given the unique location and condition of this structure and the need to provide more housing and to be able to maintain the property in close quarters,the variance may be granted without harming the public good, and would not significantly change the intent of the zoning taws. ZONING BOARD APPEALS APPLICATION Application ID: ZBA-24-39 Address: 11 '/2 Hardy Street Petitioner: Lori Pattison NOTES: *The existing depth of the rear yard is 29.5', where 30.0 is required' therefore, relief from depth of the rear yard requirement is requested. (This would apply to the back dormer.) **The house adjoins another house, therefore, relief from the minimum 10' width of side yard requirement is requested. (This would apply to both the back and front dormers.) ***Neither dormer would change the footprint of the existing house. There will be no increase in the height of the building because the tops of the dormers are no higher than the current peak of the roof. ****The dormer at the back of the unit is to convert what is "attic" space to more usable space by adding height to the ceiling. It would be building on existing walls and would not change the area(length and width) of the existing room but add headroom so that instead of storage space it would be a more usable living area. It is not visible from the street but would be a very appealing renovation and improvement to the house. *****The dormer at the front of the house is to convert what is now a room with a slanted ceiling to a flat ceiling and adding windows so that it is a more livable space. The dormer will be done with careful thought as to its appearance, so that it will add character and charm to the front of the home.
