Per our conversation of July 19, 2007, in order to ensure that the Museum located
in your building at 285 Derby Street meets the requirements of the code for a Special
Amusement, it is imperative that you have your Architect conduct a Chapter 34 Review
of this plan. Of specific concern would be the arrangement of egresses for this use, and
whether the current configuration would be allowed. Also, of concern is the demising
wall between the two uses (SATV and Museum), and the required fire rating of that
separation. Please feel free to relate to your Architect that if he has any questions

Public notice is hereby given of the application by Donald J. Clarke Real Estate to
maintain existing pier and floats, at 24 Congress and 281 Derby Streets, in the
municipality of Salem over flowed tidelands of South River. The proposed use of the
project is to provide access to navigable waters and is a water dependent project.
The Department will consider all written comments on this Waterways application

receed by within 30 days subsenuent to the "Notification Date" Failure of any aggrieved
person or group of ten citizens or more to submit written comments to the Waterways
Regulation Program by the Public Comments Deadline will result in the waiver of any right
to an adjudicatory hearing in accordance with 310 CMR 9.13(4)(c).
