The Zoning Ordinace requires the minimum depth of the rear yard to be 30 feet and the side yards to be 10 feet. The current depth of the rear yard is 15 feet to the existing deck and the current side withs are 5 feet on the left side and 9 feet on the right side to the existing deck. The proposed addition would reduce the depth of the rear yeard to 8'-10" and not effect the side yard depths. [ true ] A Special Permit under Section 3.3.3 of the Zoning Ordinance in order to Non-conforming Structure []Appealing a Decision of the Building Inspector: [] Comprehensive Permit: Current Property Use: Residential Are Lot Dimensions Included: Yes The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be constructed as per the plans submitted, as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning Ordinance. Statement of Hardship (for Variances): Statement of Grounds (for Special Permits): We are requesting approval to build a rear addition on the already non-conforming lot at 11 Jackson Street to improve the home's circulation pattern and the client's quality of living. The proposed rear addition will relocate the kitchen to the back of the home. Currently the kitchen is located between the living room and first floor bathroom and is in direct path from a primary bedroom to the bathroom. The current kitchen is small and lacks adequate counter space and seating. By relocating the kitchen to the rear of the home, we are providing a safer circulation pattern for the home owner and her children. The exterior style and materials will be complimentary to the existing structure's character. The proposed addition is not visible from the street and is not more detrimental to the neighborhood than the current structure or other structures in the neighborhood which already sit on the edge of lot lines and are non-conforming.
