Dear Mr. Strout:
This office represents Donald Michaud, Michael Skerry and Louise Skerry with
regard to a lawsuit regarding substantial improvements which were done to my client's
home at 222 Derby Street. Mr. Michaud has spoken with you and has asked me to write
this letter to you regarding the permit for the improvements as well as other matters
related to this contract.
The contract between my client and Kneeland Construction Company is enclosed.
As you can see, the contract for renovations was in the amount of$80,618.00. The
building permit,which is also enclosed lists the applicant as John Kenney and lists the
estimated costs as $40,000.00.
Mr. Michaud advises me that you will write a letter on my client's behalf dealing
with the following items:
1. In applying for the building permit,the contractor misrepresented the
contract price by$40,618.00;
2. The contractor is Kneeland Construction Corporation and the applicant for
the building permit is John Kenney, a share owner in the Kneeland Construction
Company;
3. The building permit application contains the City of Salem builder's
number rather than the Commonwealth of Massachusetts home improvement license;
4. The owner on the permit is listed as Don Michaud when in fact the owners
are Donald and Mary Michaud and Michael and Louise Skerry.
Any help that you can provide to my clients would be greatly appreciated. If you
have any questions, please do not hesitate to telephone me.

THIS AGREEMENT made this 14TH day of November, 1995 by and between
KNEELAND CONSTItUCTION CORPORATION, 40711 Mystic Ave., Suite 3413, Medford,
MA, 02155, hereinafter called the Contract and Mr. & Mrs. Michael & Louise
Skerry , 224 Derby Street, Salem, MA. Witnesseth, that the Contractor and the
Owner for the considerations named agree as follows:
Article t. Scope of the Work.
The Contractor shall furnish all of the materials and perform all of the work
shown on the drawings by Demarco-Jarek Partnership A-1, A-2, A-3 dated 6/1/95,and
specifications dated August 16, 1995 and/or described in the proposal dated September
25, 1995 , with options 1,3,4 an 5 accepted, and letters dated September 28 and October
1.8 1995., entitled exhibit A, as annexed hereto as it pertains to the work to be
performed on property at 224 Derby Street, Salem, NIA.
Article 2. Time of Completion
The work to be performed under (his Contract shall be commenced upon
receipt of building permit and shall be substantially completed on or before twelve
weeks after job start. Time is of the essence.

Article 5. General Provisions CJ
I. All work shall be completed in a workmanship like manner and in
compliance with all local building codes and other applicable laws.
2. To the extent required by lav all work shall be performed by individuals 4
duly licensed and authorized by law to perform said work.
3. Contractor may at its discretion engage subcontractors to perform work
hereunder, provided contractor shall fully pay said subcontractor aid in all
instances remain responsible I'or the proper completion of this contract.
4. Contractor shall furnish Owner an appropriate release and waiver of lien
for all work performed or'materials provided at the time of final payment.

SPECIFICATIONS
General Requirements:
1. All work shall comply with Federal, State and Local Codes and Ordinances and shall be
done to the highest standards of craftsmanship.
2. Samples shall be supplied to the Architect of all materials proposed for substitution of
specified materials and of workmansHip representing artistic techniques.
3. Temporary facilities for protection of tools and equipment shall conform to local
regulations and shall be the contractor's responsibility.
4. The contractor shall present the building to the owner for acceptance, dean and ready for
occupancy.All glass shall be cleaned and polished,floors swept clean, carpets
vacuumed, fixtures washed, with all labels removed and exterior hand raked free of trash
and debris.
5. Winter protection: Heat and snow removal shall be the contractor's responsibility. All
space heating shall be done in a safe, sensible manner, with periodic checks on the
systems and shall comply with State Industrial Commission and OSHA regulations.
6. The contractor shall carry Builder's Risk"All Risks"Insurance to cover the cost of this work.
The Architect shall be presented with certificates of contractor's insurance and Owner's
fire extended coverage at the time o signing of the con rac .
7. Rental charges, safety, protection and maintenance of rented equipment shall be the
contractor's responsibility.
8. Contractor shall maintain the job dear of trash and debris.All waste material shall be
removed from site prior to substantial completion and prior to final acceptance.
9. Cost for Building Permits, taxes, sales tax and other charges relative to construction of
this project sha aincluded in the contract price.
10. These documents do not include the necessary components for construction safety.
Safety, care of adjacent properties during cohstruction, compliance with state and federal
regulations regarding safety shall be the Contractor's responsibility.
11. Contractor shall visit the site and become familiar with all conditions prior to submitting his
proposal. Contractor shag verity all dimensions and conditions shown on these drawings
with those at the site.Any variation which requires physical change shall be brought to
the attention of the Arc itect.

12. All materials and workmanship shall be guaranteed for one year after completion and
move-in. Any defects shall be promptly corrected at no cost to the Owner.
13. No liability shall result from delay in performance or nonperformance caused by
circumstances beyond the Owner's control including, but not limited to, Acts of God, fire,
flood, war, government action(Local, State and Federal), accident, labor trouble, or
shortage, inability to obtain material,equipment or transportation. Materials so affected
may be eliminated from the contract without liability providing that suitable replacements
are procured and mutually agreed upon.
14. The contractor shall provide and maintain temporary electric and telephone at the site
during construction at his expense.
15. All work shall be conducted as quietly as possible and without unnecessary noise and
dust.
16. It is intended by the representations on the drawings and in the specifications that the
work will be performed exactly as shown and specified. Should field conditions
encountered in the course of the work require modifications to dimensions or
relationships of parts of materials from what is shown or specified, the contractor at no
additional cost to the Owner, and with express consent of the Architect in each case,
shall make such modifications to the wor as may be necessary toto complete the work in
accordance with the intent of the Contract Documents and prior to the fabrication and/or
installation of the work or any piece thereof, report to the Architect in writingall
discrepancies between the existing conditionsand�ract Documents which would
require any modification as given above.
17. Shelter and Protection of Materials: Provide adequate storage facilities for materials and
equipment as required for the work. The facilities shall be enclosed, heated and provided
with moisture control, as required, to provide adequate protection.
18. Temporary Dust proof Partitions: Temporary dust proof partitions, where required, shall
be erected before demolition work or wrecking is started and shall be removed at
completion of entire work or when directed by Owner.
19. Contractor is hereby required to take all precautions and so schedule the work as to
minimum discomfort, annoyance and interference in the routine daily operations in and
around the building by the Owner and such other contractors who may be engaged to
perform work therein.
20. Dust Control: Thoroughly wet down all work being demolished and all trucking ways as
necessary to prevent spreading dust. Provide all water, hoses and connections required
for dust control.
21. Protection of Property: Protect existing buildings and grounds, public streets, sidewalks
and existing utilities. If damage is done to these areas,the contractor shall make all repairs
to same at no additional expense.

9. In the event Owner shall fail to pay any periodic or installment payment

10. All disputes hereunder shall be resolved through the legal justice system

11. Contractor shall not be liable for any delay due to circumstances beyond

CONSTRUCTION SUPERVISORS
2.12 On-site prescence of licensee: A licensed individual or a licensed designee shall
• be present on the site at some point to approve construction, reconstruction,
alterations, removal or demolition involving the following work:
a. Excavation
b. Foundation (pouring or other)
c. Decking
d. Rough framing
e. Finished framing
f. Chimneys
1. Excavation/foundation
2. At the top of the smoke chamber and support of the flue liner
3. When erection of the chimney is completed.
2.13 Lost/stolen licenses: License holders are required to keep the license in their
possession at any and all building sites. If said license is lost, stolen or mutilated,
it shall be the responsibility of the license holder to notify the BBRS.
2.14 Requirement to show license: Any building official may require the license
holder to produce the license at any time on a job site.
2.15 RESPONSIBILITY OF EACH LICENSE HOLDER:
�• 2.15.1 The license holder shall be fully and completely responsible for all work for
which lie is supervising. He shall be responsible for seeing that all work is done
pursuant to the State Buil mg Code an e rawmgs as approve y e u� mg

2.15.2 The license holder shall be responsible to supervise the construction,
reconstruction, alteration, repair, removal or demolition involving the structural
elements of buildings and structures only pursuant to the State Building Code and
all other applicable Laws of the Commonwealth even though he, the license holder,
is not the permit holder but only a subcontractor or contractor to the permit holder.
2.153 The license holder shall immediately notify the building official in writing of
the discovery of any violations which are covered by the building permit.
2.15.4 Any licensee who shall willfully violate Subsections 2.15.1, 2.15.2 or 2.15.3 or
any other Sections of these Rules and Regulations and any procedures, as amended,
shall be subject to revocation or suspension of license by the Board.

After reviewing your sketches of the East and West Chimneys at the 224 Derby St. building we
have the following comments.
For the listed,natural draft equipment you show on your sketch, we find the layout and
application of a Type B gas vent generally acceptable, irrespective of sizing. This use of
equipment is in compliance with applicable codes (National Fuel Gas Code 248 CMR 6.00 :
Section 7, specifically 7.5.2. regarding Point of Termination and 7.6.1(d), regarding
Application.)
In addition, we find the layout acceptable with regards to providing adequate support of the
chimney. The height of the double walled vent extending above the point of connection to the
existing masonry chimney is acceptable, as it is adequately supported for its design and weight,
and is in conformance with general industry standards and applicable codes (National Fuel Gas
Code 248 CMR 6.00 : Section 7, specifically 7.5.6. regarding Support of Chimneys.)
Furthermore, for the intended use of this Type B gas vent, we find it to be acceptable and in
conformance with general industry practice.

A hearing on this petition was held May 31 , 1989 with the following Board Members
present: James Fleming, Chairman; Messrs. , Bencal , Luzinski and Associate Member
Labrecque. Notice of the hearing was sent to abutters and others and notices of
the hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioners, represented by Attorney Chris Drucas, are requesting a special Permit
to allow a display window at 222-224 Derby Street, currently in an R-2 district.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board of
Appeal may, in accordance with the procedure and conditions set forth in Section
VIII F and IX D, grant Special Permits for alterations and reconstruction of non-
conforming structures, and for changes, enlargement, extension or expansion of
nonconforming lots, land, structures,a nd uses, provided, however, that such
extension, enlargement, or expansion shall not be more detrimental than the
existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City's inhabitants.
The Board of Appeal , after careful consideration of the evidence presented, and
after viewing the plans, makes the following findings of fact:
1 . There was no opposition to the petition presented at the hearing.
2. The additional window is necessary to enhance the visibility of the
photography business.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . The granting of the Special Permit requested will promote the convenience
and welfare of the City's inhabitants.
2. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.

and made part of this decision.

The petitioners, represented by Attorney Chris Durcas, are seeking a Special
Permit to change the existing use at the locus from an Art Studio to a Photo
Studio. Teh property is located in an R-2 district.

FIRE DEPARTMENT CERTFICATE OF APPROVAL FOR BUILDING PERMIT
In compliance with provisions of Section 113 . 5 of the Mass. State
Building Code; and under guidelines agreed upon by the Salem. Bldg.
Inspector and the Salem Fire Chief; the applicant for a building
permit, shall obtain the Certificate of Approval (see reverse side)
and stamped plan approval from the Salem Fire Prevention Bureau.
Said application and approval is required before a building permit
may be issued. The Mass. State Building Code requires compliance
approval of the Salem Fire Department, with reference to provisions
of Article #4 and Article #12 of the Building Code, the Salem Fire
Code;-i-Mass.•-:Gerneral.Laws and Mass. Fire,Prevention Regulations.
The applicant shall submit this application with three (3) sets of
plans, drawn in sufficient clarity and detail, to obtain stamped
approval of the Salem Fire Department. This applies for all new
construction; substantial alterations; change of use and/or occupancy;
and any other-approvals required by the Mass. General Laws and the-
Fire
heFire Codes.
Exception: Plans will not be required for structural work, when the
-proposed work: to be performed under the building permit ,
will not ; in the opinion of the Building Inspector, require
a plan to show. the nature_ and character of the work to
be performed.
NOTICE: Plans are normally required for fire supression systems; fire
alarm systems; tank installations; and fire code requirements.
NOTICE: Under provisions of Article #22, of the Mass. State Bldg. Code;
certain proposed projects may not require submission of plans ,
nor complete compliance with new construction requirements. In
these cases, provisions of Article #22, Appendix T, and Tables
applicable shall apply. This section shall not however, super-
sede the provisions outlined in Salem Fire Prevention Bureau
Regulations; Chapter 148, M.G.L. ; or the Mass. Fire Prevention
Regulations. i.e. all permits for, fire code use and/or occupancy
shall apply for the entire structure; •fire alarm and/or smoke
detector installation, shall apply to the entire structure, based
on new A .C . (hardwired) units for all new construction, but the
existing structure may comply with regulations applicable for
existing structures.
`- NOTICE: Sub-contractors may also be required to file individual appli-
cations for a fire department certificate of approval, covering
their area of work. Said sub-contractors shall file for Fire
