Dear Mr. Medina:
This correspondence has been prepared to notify you that water is being illegally discharged from
155 Derby Street onto Kosciusko Street. Discharging water from private property to the City's
sidewalk and/or street that is causing a public nuisance and safety hazard is against City
regulations.
You are to immediately stop creating this problem, per City Ordinance, Sec. 2-11447,
"Maintenance of Street; removal of nuisances, obstructions and encroachments". Please contact

A hearing on this petition was held on Tuesday, May 17, 1977, with members
Jane Lundregan, Arthur Labrecque, Willia'1 Abbott, and Associate Members James
Boulger and Douglas Hopus:r as voting members present. Notices were sent to
abutters and others in accordance with Pass. General Laws, Chapter 808.
24r. Vining petitioned the Board requesting a Special Permit to allow the
creation of two smaller apartments in place of the presently existing large
apartment at 155 Derby Street_ The additional apartment licked the lb par'.;i-ng
spaces required by the City's Zoning ordinance_ The Petitioner stated in his
petition that the change would make- the housing more appropriate to the area
:in which :it :is located and would result in an upgrading of the property. It is
calculated to .reduce the actual density of the occupants.
Several abutters appeared in opposition to the granting of the petition.
Their objections were that granting to special Permit would add to the concerti-en
i.r: the neighborhood. _ The Board voted to deny the S_uecial Permit. . The Board
noted that -it had denied several such requests in the same neighborhood because of
congested conditions.
The Board -felt that it: could not grant said Special Permit without detriment .
to the surrounding neighborhood and without derogating from the intent of the Salem
Zoning By-Laws. -
-PETITION DENIED
Appeal from this Decision, if any, shall be node pursuant to Section 17 of the Mass.
General Laws, Chapter 808, and shall be filed within 20 days after the date of filing
of this Decision in the office of the City Clerk.
Pursuant to Mass. General Laws, Chapter 303, Section 11, the Variance or.Special
Permit granted herein, shall not take effect unt:il. a copy of the Decision, bearing the
certification of the City Clerk that 20 Ways have elapsed and no appeal has; been filet
or that, if such an appeal has been filed, that it has been dismissed or denied, is
recorded -in the South Essex Registry of Deeds and indexed under the name of the owner

Dear Bill,
As per your request, accompanied by two (2) Inspectors from the Salem Health
Department, I inspected the premises located at 155 Derby Street on July 7, 1978.
I spoke at length with the Owner, Mr. Fred Vinning, who has given me a list of
tenants in each of the three (3) apartments. Mr. Vining was very disturbed by
the incident that happened over the 4th of July and told us that he had spoken
to all ,the tenants.
We could find no evidence of either Health, Building, or zoning violations
during the inspection.
In view of Mr. Vinning's concern for his neighbors and his efforts in this
matter I feel that this complaint has been resolved.
