Following up on my previous letter of July 28, 2006 and the structural report done by
Allen Vitakevich's(P.E.) dated July 17, 2006, I was expecting a permit application and
work to commence as early as possible
State Building Code 780 CMR Section 121 through 121.8 covers "unsafe structures":
Both Mr. Vitakevich's letter and my letter reference the word "unsafe".. This is not a
term that an Engineer or Building Official takes lightly. In declaring a building or
structure "unsafe", the clock is ticking on repairs. .I understood the Engineering has been
done,but to date, no application has been received by this office and no repair work has
begun.
If repairs are not able to proceed immediately, please let me know so that a different
course of action can be taken per the State Building Code.

Gentlemen:
At the request of Steven Navarro, I visited 131 Derby Street on Monday, July 17,2006 to
review concerns regarding the deterioration of the roof framing.
Roof areas were exposed on the garage roof at the east and west walls and the roof of the
main residence at the westerly wall.
The exposed roof framing consisted of 2x 10 wood members at the garage roof and 2x8
wood members at the roof of the residences. Extensive deterioration is visible at the ends
of the framing members where they are bearing in pockets in the exterior brick walls.
The deterioration has resulted from moisture penetrating the walls during the life of the
C, buildings.
• The roof members that have deteriorated ends have completely lost their bearing in the
wall pockets and cannot support imposed loads required by the Massachusetts State
Building Code and accepted engineering practice.
The existing conditions are "unsafe" and require immediate remedial work to insure the
integrity of the roofs.
The roof of the residences is not in any immediate danger of failure, since the interior
stud walls recently constructed in front of the original brick walls will prevent a collapse.
The garage roof should not be occupied at this time and the space below should receive
barriers to prevent entry by any human beings. Belongings stored in the garage may also
be vulnerable to any collapse.

Based on my observations, the deteriorated members were exposed during the recent
renovation. Recent construction such as ceiling strapping and duct penetrations were in
contact with deteriorated framings.
The top of the masonry walls supporting the wood framing has also been subjected to
various forms of deterioration and must be repaired to a.sound condition. Most of the
damage is limited to the interior wythe of brick.
The required details to restore the integrity of the framing and brick walls can be resolved
in a short time frame.
It is adamant that one verifies the ends of the wood beams in the residential building are
sound. The tops of the beams should be exposed during the remedial work process.
Restoring the roof of the garage will be a laborious task. In my opinion it would be more
cost effective to remove the roof and replace it with a properly designed structural
system.
The roof areas receiving decks may be designed for 60 pounds per square foot, since this.
is a two family dwelling.

A hearing on this petition was held on January 19, 2005 with the following Board
Members present: Nina Cohen, Chairman,Richard Dionne, Steven Pinto and Edward
Moriarty. Notice of the hearing was sent to abutters and others and notices of the hearing
were properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40�►.
Petitioner request a Special Permit to extend an existing nonconforming building for the
property located at 131 Derby Street located in an R-2/B-1 zone.
The provision of the Salem Zoning Ordinance which is applicable to this request for a
Special Permit is Section 5-3 (2) (8)which provide as follows:
Notwithstanding anything to the contrary appearing in this Ordinance,the Board of
Appeal may,in accordance with the procedure and conditions set forth in Section 8-6 and
94, grant Special Permits for alterations and reconstruction of nonconforming structures,
and for changes,enlargement,extension or expansion, of nonconforming lots,land,
structures,and uses,provided however,that such change,extension,enlargement or
expansion shall not be substantially more detrimental than the existing nonconforming
use to the neighborhood.
In more general terms,this Board is,when reviewing Special Permit requests, guided by
the rule that a Special Permit request may be granted upon a finding by the Board that the
grant of the Special Permit will promote the public health, safety, convenience and
welfare for the City's inhabitants. . . _ _ _ ._ - .v_ _
A. Special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other lands,
buildings or structures in the same district.
B. Literal enforcement of the provisions of the Zoning Ordinance would involve

C. Desirable relief may be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the intent of the district or
the purpose of the ordinance.

1�,after careful consideration of the evidence presented, and after
viewing the plans,makes the following findings of fact.
L Petitioners'property at 131 Derby Street lies at the intersection of the B-I and R-
2 zoning districts. Under Section 7-9 of the Salem Zoning Ordinance,the
dimensional limitation of the less restrictive zoning district may be extended
thirty feet into the more restrictive zone. In this case,the requirements of the B-I
zone will apply to the entire lot.
--2-On-the site-are two-buildings.Both are dimensionally nonconforming for either
district and together they constitute a mixed-use site. A six-unit multifamily
residential dwelling lies at the front lot line,with a two-story brick garage at the
rear of the lot. The garage has most recently been used for a carpentry business
and a clean-out business while the units in the front building were rented out until
recently.
3. Petitioner proposes to convert the rear building to residential use by renovating
the garage into two loft type apartments. He seeks a special permit to build a
stairwell exit on the roof to enable the tenant to utilize the roof area for a deck.
Under petitioner's proposal four vehicles will be parked inside the existing
garage, and two additional off-street spaces will be provided for tenants in the
courtyard.
4. Petitioner has spoken to many residents of the area, and he submitted a petition in
support signed by 20 neighbors. Additionally, Dave Eng of Eng's Florist, a
neighborhood business,came to the meeting to speak in support of Mr. Legon's
petition. There was no opposition to the proposed plan.
On the basis of the above findings of fact,and on the evidence presented at,the hearing,
the]3oaazd-of Appeal concludes as follows.
1. Literal enforcement of the provisions of the ordinance would involve substantial
hardship on the petitioner.
2. The relief requested can be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of the
district or the purpose of the ordinance.
3. The Special Permit granted can be granted in harmony with the neighborhood and
will promote the public health, safety, convenience and welfare of the City's
inhabitants.

and 0 in opposition to grant the Special Permit requested, subject to the following
conditions.
1. Petitioner shall comply with all cited state statues,code ordinances and

shall be strictly adhered to.

6. All snow removal shall be offsite.

Evety occupant of a dwelling, dwelling unit, or rooming unit shall give the
owner thereof, or his agent or employees, upon reasonable notice, reasonable
access, if possible by appointment, to the dwelling, dwelling unit, or rooming
unit for the purpose of making such repairs or alterations as are necessary
- to effect compliance with the provisions of these minimum standards.
