Conditions of Approval: - Validity of Approval: This approval is valid for two years from the date of the meeting. The approval shall no longer be valid if a substantial use and/or construction has not commenced except for good cause within this two-year period. - Consistency with Approved Design/Plans: Should the applicant determine that the project may not be completed as presented and conditioned herein, he/she/they shall return to the SRA to review proposed modifications prior to making any changes in the field. - Screening Maintenance: The existing screen elements, including existing shrubbery, vegetation, and fencing, shall be maintained so that they sufficiently screen the units. If any of the screening elements are removed, whether by design, by accident, or by weather, the elements must be replaced as soon as possible, taking into consideration weather and seasonality concerns. Color of Ground Units: The applicant shall explore an alternate color for the ground units. The bright white can be strident, even with the existing screening elements. If the units are available in a more muted tone or if they can be painted, the applicant shall take the necessary steps to install units with a muted white tone. Compliance with Condominium Association Conditions: The installation of all ductless units shall adhere to the conditions listed in the New Salem Condominium II Association Conditions for Removing Old AC Units and Installing New Mini-Split Units, as voted and approved on May 19, 2022. These conditions shall apply not only to new units, but shall be retroactive and apply to units installed prior to the date of the Authority's final decision. SRA Pre-Approval: If the owners, existing or future, of units A-1, A-2, A-3, A-4, B-1, and C-1 at 28 Federal Street would like to install ductless mini split air conditioner systems, they shall abide by all the conditions listed in this decision document, including those listed in the New Salem Condominium II Association 'Conditions for Removing Old AC Units and Installing New Mini-Split Units' dated May 19, 2022. If the owners of the listed units are not able to adhere to all the required conditions the owners shall apply to the Salem Redevelopment Authority for a Small Project Review of the proposed installation(s). Findings: - The Authority finds that these mini-split units will likely grow in popularity and their installation must be carefully considered to ensure minimal negative visual impact of the infrastructure. Members also found that the New Salem Condominium II Association has carefully considered the design of the installation as evidenced by the Association's conditions. It is because of the care and attention to detail in these conditions, and when coupled with the additional conditions issued by this body, that members are in support of issuing a pre-approval for future mini-split installations at this property. The Authority finds that the infrastructure, when installed pursuant to the conditions in this decision, will result in the infrastructure blending with the building façade and even referencing the right angles and layouts of the buildings' windows. The Board of New Salem Condominiums II has approved this request. STATEMENT OF PROPOSAL The purpose of this request is for approval the placement of exterior conduit on the building and the location of exterior AC units as part of the installation of mini-split air conditioners. This includes conduit previously installed, conduit partially installed and now on-hold and future installations. BACKGROUND The new Salem Condominium II owner’s association had previously approved 2 owners to install AC units under the condition that they complied with conditions of installation prepared by the Board’s building committee. (See attached copy.) These were lower units that are largely screened from view by a 6.5 foot high fence on the Federal Street or South side of the building and 6 foot high hedges on the North side. (See North and South elevations on the drawing.) The next requests from owners were from 3 upper unit installations. A new owner, who did not fully understand our multi-layer approval process by the Board, ie, a vote of approval by all owners, started the installation before that was completed. The Board immediately stopped the installation on the day it was started and until the owner received formal Association approval. When working on that an owner cautioned that SRA approval might be required due to visibility. We then reached out to Kate Newhall-Smith who confirmed that SRA review and approval was necessary. We then retained the services of an architect for design input and the preparation of the submitted drawing. GOING FORWARD The conduit installed on the upper unit, noted on the drawing as B3, will be modified to comply with a configuration as shown on the architect’s drawings. All conduit will be painted to match the color of the clapboards. The drawing also locates those condo units under discussion. It is also our request that the SRA approve the layouts shown would apply for future owners, should they decide to install similar air conditioners.
