Referenced Plans and Documents: - Project Narrative, prepared by Niemitz Design Group, 530 Harrison Avenue, Boston, MA 02118, dated March 31, 2022. Plan Set titled, 'Turners Seafood at Lyceum Hall - Three Season Patio Addition', prepared by Niemitz Design Group, 530 Harrison Avenue, Boston, MA 02118, dated August 16, 2022. A series of photographs of existing conditions, submitted by the applicant on March 30, 2022. Conditions of Approval: - Validity of Approval: This approval is valid for two years from the date of the meeting. The approval shall no longer be valid if a substantial use and/or construction has not commenced except for good cause within this two-year period. - Consistency with Approved Design/Plans: Should the applicant determine that the project may not be completed as presented and conditioned herein, he/she/they shall return to the SRA to review proposed modifications prior to making any changes in the field. - The rail system along the existing roofline should be one level and not feature the change in elevation as shown on the plan set. The primary customer entrance to the building will remain on Church Street. The rear handicap accessible entrance will not become a customer entrance except for handicapped customers. Other than the signage required to identify a handicap entrance, no signage will be posted directing or inviting non-handicap customers to use the rear entrance. The four feet of sidewalk width adjacent to (south of) the expansion must be kept clear and unobstructed at all times. No trash bins or dumpsters will be permitted in the courtyard area or along the Salem Green alleyway; and no trash, equipment, furniture, supplies, or other materials will be left temporarily in those areas. The stormwater drainage and building access issues on the southwest portion of the proposed addition will be resolved to the satisfaction of the Salem Five Bank. The plans for stormwater drainage and runoff from the roof of the proposed addition will be to the satisfaction of the Salem Five Bank. The southeastern corner of the proposed addition will be far enough west to allow space for a vehicle to comfortably park between the proposed addition and the Salem Five Bank's adjacent parking area, without blocking the traffic lane to the east of the restaurant. The applicant shall contact the SRA, via Principal Planner, Kate Newhall-Smith, prior to the opening of the new dining area to execute the License Agreement in accordance to the terms voted on at the September 14, 2022 SRA meeting. The required fee shall be paid to the SRA upon execution. Findings: - The Board found that the proposal is consistent with design standards and guidelines for projects in the Downtown Renewal Area. The project will be an attractive addition to the Salem Green area and bring a liveliness to this quiet area, which is consistent with the Downtown Renewal Plan's objectives. The color of the awning and curtain walls is consistent with Turner's branding and existing awnings on the front façade. The parapet is a good addition to the roofline and will successfully screen the restaurant's mechanical systems. Subject=Contact regarding Public Art) Digital Signature Matt Hamor 03/30/2022 Conditions of Approval Findings: Conditions of Approval Findings: NIEMITZ DESIGN GROUP March 31, 2022 Project Narrative Turner’s Seafood 43 Church St., Salem, MA Project Narrative Turner’s Seafood Salem, MA 3.31.22 Turner’s Seafood intends to add a permanent three-season outdoor seating patio to the rear of the existing space at 43 Church St. The existing restaurant has permitted seating at the rear of the building in the SRA owned outdoor space on Salem Green public pedestrian path. The current secondary building egress and handicap accessible entrance are located at the rear of the building along this space. At present the space is paved in brick and concrete with an uneven surface that is, at times, prone to collecting water. The existing previous single story expansion supports the building’s HVAC equipment on the roof and is visually prominent on this side of the green. The goals of the project are to create a fixed and defined outdoor dining space for the restaurant within the green space, improve emergency egress from the building, to upgrade the accessible access to the building, and conceal the existing HVAC equipment on the first story roof from the green. The proposed patio will add 804 square feet of outdoor dining space to the current restaurant. This will allow for 48 seats in addition to the 235 current seats at the interior of the first floor restaurant and second floor event spaces. The structure will be a wood deck with a fixed roof that will require permanent footings for structural support. The space will have architectural and decorative lighting as well as ceiling hung infrared heaters for the shoulder seasons. At the perimeter will be sliding waterproof curtains with Isinglass windows to close during inclimate weather. At one end of the patio will be a small service bar for the space, which will have no seats or stools. The existing handicap ramp will be demolished and built new to meet current all ADA/MAAB codes. The existing rear exit will be moved to improve access from the bar side of the restaurant as well as the kitchen and second floor spaces. A new additional exit will be added on the dining room side of the restaurant adjacent to the handicap ramp. This entrance will improve the handicap access and experience entering the restaurant, in addition to bettering the emergency egress for the dining room. New bi-folding doors will replace the existing storefront at the bar rear dining and allow this space to open up to the patio and the green space. The current single story roof will receive a new low screen wall to better shield the existing HVAC equipment from view. Good afternoon everyone, Chris and I met with fire department officials this morning and they were supportive of our proposal to construct a three season room. Their concern with fire truck access remains isolated to the main drive / walkway that separates our building from Salem Five’s. They all agreed that the hydrant has not been used in many years and thus is unnecessary - they were looking into the possibility of having it capped and removed. The only issue raised was their ability to carry ladders past the structure. Not having a code reference present, they all seemed to agree that a 4’ pathway would suffice. I specifically mentioned the idea of raised decking to make the space level and thus handicap accessible with the interior of the restaurant. No one posed any objections. Lt. Peter Schaeublin did share that the structure would need to meet updated safety requirements since it would be newly constructed. He is proposing to construct a three-season room that extends off of the existing glassed in area – see attached site plan. The new seating area will be located on Salem Redevelopment Authority-owned land and will maintain 4’ of clearance between the proposed room and the curbing of the planting bed. I have a January 2021 email from Jim stating that you had initially expressed no concerns with the project so long as there remains a 4’ pathway for ladder access to the buildings.
