As discussed during our Thursday, November 8, 2012 telephone conversation regarding your property
located at 110 Derby Street, is in violation of the City of Salem Zoning Ordinance chapter 6-1 for a
multi- family residence in a unit zoned for single (1) - family residences.
Remediation of this violation as discussed and noted below shall bring your unit property in to
compliance with the City of Salem Zoning Ordinance chapter 6-1 and the Salem Building
Department.
The following actions are required immediately to bring the property into
compliance with the Massachusetts State Building Code and City of Salem
Zoning Ordinances:
1. File Building Permits and arrange inspections for the complete removal of the
second floor kitchen including removal of plumbing behind the finished wall.
(Permits to be applied for by December S, 2012 and said work must be completed
immediately)
2. Removal of interior door slab and hinges at first floor Turner Street entry vestibule
3. Provide a signed and notarized affidavit stating the second floor level shall not be
operated as a secondary apartment. This shall be required prior to this
department issuing any Letter of compliance for this unit.

Our office received a complaint regarding your property located at 110 Derby Street, alleging an
illegal apartment in violation of the City of Salem Zoning Ordinance chapter 6-1 for a multi- family
residence in a unit zoned for single (l) - family residences.
Under the provisions of 780 CMR, Section 104.6—Right of Entry, of the State Building Code,
access to this property must be granted for the purposes of this inspection. If this property has
rental units, these tenants must be notified in advance of this inspection, so that access to these
spaces may also be accomplished.
This inspection is scheduled for Friday,November 9th at 10:00 P.M.
You are hereby directed to contact this office immediately upon receipt of this letter. Failure to
respond to this notification will be construed as non- compliance, and as such an Administrative Search
Warrant will be sought, so as to allow the lawful inspection of this property. If you feel you are

DECISION OF THE PETITION OF DANIEL FOX REQUESTING A
VARIANCE FOR THE PROPERTY LOCATED AT 110 DERBYSTREETB-1
A hearing on this petition was held January 17, 2001 with the following Board Members
present: Nina Cohen, Chairman, Richard Dionne, Stephen Buczko, Stephen Harris and
James Hacker. Notice of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
The petitioner is requesting a Variance from minimum lot area per dwelling unit and
parking variances to allow 3 residential units for the property located at 110 Derby Street
B-1.
The Variances, which have been requested, may be granted upon a finding by this
Board that:
a. Special conditions and circumstances exist which especially affect the land, building.
or structure involved and which are not generally affecting other lands, buildings and
structure involve.
b. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioners.
c. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district of the
purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1. Petitioner represented at this meeting by Scott Grover, Esq. of Tinti, Quinn and
Grover, has entered a purchase and sale agreement to purchase a property at 110
Derby Street that is currently owned by The House of Seven Gables Settlement .

2. The structure at 110 Derby Street had been the site of two dwelling units and a
restaurant known as The Grand Turk Tavern. Some years ago, the restaurant cease
operating, and at the time it was bought by the Gables Association,the facility was
leased to another business owner who used it as a function hall for special functions.
3. Petitioner wishes to change the use of the structure from 2 residential units and a
function hall to 3 residential units. It is petitioner's assertion that the proposed

mulitfamily use is a use as of right in the B-1 district, and therefore it seeks
variances for parking and for the existing nonconforming condition of the small size
of the units relative to the 3500 sf requirement of the ordinance. Total square
footage for the three units is 4800 sf.
4. As grounds for its petition, petitioner proffers the changing character of the
neighborhood.
5. There was no opposition to the proposed petition.
On the basis of the above findings of fact, and on, the evidence presented at the
hearing, the Zoning Board of Appeal concludes as follows
1. Special conditions exist which especially affect the subject property but not the
district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the public good and
Without nullifying or substantially derogating from the intent of the district or the
purpose of the Ordinance.
Therefore,the Zoning Board of Appeal voted 4-1, to grant the Variances requested,
subject to the following conditions;
1. Petitioner shall comply with all city and state statures, ordinances, codes and
regulations.
2. All requirements of the Salem Fire Department relative to smoke and fire safety shall
be strictly adhered to.
3. All construction shall.be done as per the plans and dimensions submitted.
4. Petitioner is to obtain approval from any City Board of Commission having
jurisdiction including, but not limited to, the Planning Board.
5. Petitioner shall obtain a building permit prior to beginning any construction.
6. A Certificate of Occupancy shall be obtained.

A hearing on this petition was held on July 19, 1989 with the following Board
Members present: James Fleming, Chairman; Richard Bencal , Vice Chairman; John
Nutting, Secretary, Edward Luzinski and Richard Febonio. Notice of the hearing
was sent to abutters and others and notices of the hearing were properly published
in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40
Petitioners, owners of the property, are requesting a Special Permit to allow
construction of an addition in this B-1 district.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board
of Appeal may, in accordance with the procedure and conditions set forth in
Section VIII F and IX D, grant Special Permits for alterations and reconstruction
of nonconforming structures, and for changes, enlargement, extension or expansion
of nonconforming lots, land, structures, and uses, provided, however, that such
change, extension, expansion or enlargement shall not be substantially more
detrimental than the existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City's inhabitants.
The Board of Appeal , after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . The addition will be used to house a walk in refrigerator/freezer.
2. The refrigerator/freezer is an essential need of the establishment.
3. The addition is in harmony with the buildings use.
On the basis of the above finding of fact , and on the evidence presented, the
Board of Appeal concludes as follows:
1 . The petitioners plan will promote the public health, safety, convenience
and welfare of the City's inhabitants and will be in harmony with the
present structure.
2. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district of the purpose of the Ordinance.

in effect except for relief granted by this decision.
4. All construction be done as per the plans submitted and as per the
dimensions submitted.
5. Exterior finishes shall be in harmony with the existing structure.
6. A sign shall be displayed inside the restaurant relative to local
parking rules.

DECISION
RE: _NO NAME,,PUB, 110 Derby Street, Salem
1. An application for variance was filed with the Board by Robert
Curran (Applicant) on December 16, 1989. The applicant has
requested a variance from the following section(s) of the 1982
Rules and Regulations of the Board: :
Section: 26.1 relating to primary entrances
17.2 relating to floors being of a common level.
30.1 relating to public toilet rooms.
2. The hearing was held on: March 6, 1989
3. The following persons appeared:
Robert Curran and James Bailey, Owners
4. FINDINGS AND DECISION:
The No-Name Pub is in a house that was built in 1800, and is
historic in nature. The pub is on the first floor and seats 49. There
are two apartments on the second floor. The front entrance has two
steps, the first is 3 1/2 inches high and the other is 9 inches over a
short span. The house was built in different in time periods and the
interior is at different levels and there are two two full steps up to
get to the alternate exit and also to get to the different sections of
the interior of the pub. The house is built right up to the sidewalks
on both sides and is very close to the lot line on the other two sides.
The petitioner stated that it is not feasible to build ramps to enter
and exit the house because of the construction of the building with
regards to steps into the house, and the house being built at the

sidewalk and the interior being at more than one level. The cost for
such construction would be excessive. A letter was submitted from
Annie Harris, Salem Historical Commission urging the Board to grant
a waiver for the above property. The Commissions view is that the
installation of the ramp, in particular, its landings and railings, will
detract significantly from the buildings restored architectural
integrity while being of only minor value in terms of handicap
access.
The variances being sought are for Sections: 26.1 relating to
primary entrances, 17.2 relating to floors being of a common level,
and 30.1 relating to toilet rooms.
The Board inquired if the petitioner had a site plan to see how the
building sits on the plot. The petitioner only had photographs with
him. The board inquired as to the extent of work performed? The
petitioner stated that most of the work performed was on the
outside of the building, new roof, new windows, painting and
clapboards. Also, there was work performed on the apartments,
new bathrooms and kitchens. The building inspector required that
the petitioner come before the board, because the amount of money
spent triggered the board's regulations requiring an accessible
entrance. The petitioner testified that the amount of money spent
was approximately $60,000, mostly repairs. The amount of money
on the variance application was $15,000. The petitioner stated this
was for the pub only.
After listening to the testimony, the Board continued the hearing and
required the petitioner to submit the following materials, within
two weeks, before the Board can make a final determination.
1 . A plot plan and schematic drawings of the restaurant.
2. Architectural drawings showing the feasibility of providing a
ramp at the primary. entrance.
3. Copies of all building permits within the last 24 months.
JUNE 12, 1989
The Board reviewed all the material submitted, including a new plan

proposing the creation of a code complying handicapped accessible
entrance at the side of the building with a walkway at a 1 :20 slope.
After reviewing all the information the Board voted as follows:
Grant a variance to Section 26.1 to access to the primary entrance
on condition that the side entrance be made fully accessible and
further, signage be installed at the primary entrance indicating the
location of the accessible entrance.
Grant a variance to Section 17.2 to the change in level inside for the
reason that the change in level is existing and it is technologically
infeasible to construct a ramp or install a wheelchair lift due to the
size of the space.
With respect to Section 30, the petitioner has provided handicapped
j accessible bathrooms, therefore a variance is not necessary.
This constitutes a final order of the Architectural Access Board
entered pursuant to G.L. c. 30A.Any aggrieved person may appeal this
decision to the Superior Court of the Commonwealth of
Massachusetts pursuant to Section 14 of G.L. c. 30A. Any appeal
must be filed in court no later than thirty (30) days of receipt of
this decision.
