Please be advised I have examined utility records and
census records relative to the above entitled real estate
and it is my opinion that it was a lawful six-family prior
to adoption of the Zoning Ordinance on August 27 , 1965 . In
addition, the records of the Assessor' s Office indicate it
is currently assessed as a six-family. Accordingly, it is
my opinion it should be afforded the protection of Section
VIII (E. ) of the aforementioned ordinance relative to
nonconforming uses and, thus, it' s current use as a six-family
is permissible.

Dear Mr. Savickey:
We inspected your premises at 85 Derby Street on March 3,
1975 and found that the second floor rear apartment is
in violation of Section 609.1 of the Massachusetts State
Building Cods, (Minimum number of exit-wags).
At that time you were advised to empty the apartment or
build a fire escape.
To date no satisfactory fire escape or door to same has been
installed. In accordance with Section 122.0 of the Massachu-
setts State Building Code, notice is hereby given to discoatime
and correct violations of said code.
Your attention is directed to Sections 122.2 and 122.3
regarding penalities for failure to comply with this notice.

You are requested to take ocrrective action in the 2nd floor apartment at
85 Derby Street on the below listed violations of the Sanitary Code (or of
tle Building Code of the Commonwealth) as indicated below:
* (1 ) Covers not provided on electrical outlets.
** (2) Only one means of exit provided for 2nd floor apartment (tenant
indicates 2nd means of exit was removed and replaced by window). - -
(3) Provide cover on exposed heater in childs bedroom..- ----
(4) Cold water faucet in kitchen is not in operating condition.
* (5) Many extension cords in use due to lack of electrical outlets in
large living room.
Corrective action on all of the above is requested within 10 days after receipt
