Tremblay Director of Public Property Inspector of Building Zoning Enforcement Officer City of Salem RE: 65 Derby Street Dear Mr. Tremblay: We are in receipt of your letter dated June 13, 1995 which directs New England Power Company to either bring the structure located at 65 Derby Street up to structural acceptance in accordance with the State Building Code or to demolish and remove the structure. Based on our engineering and economic assessment we have determined that it is neither reasonable nor practical to bring the building into conformance with the requirements of the State Building Code. We will therefor proceed to secure the necessary permits from your office to demolish and remove the building. Once we have obtained the necessary permit(s)from your office we will proceed to demolish and remove the structure located at 65 Derby Street. Ketschke 24 Fort Avenue Salem, Mass. 01970 RE: 65 Derby Street Dear Mr. Ketschke: Due to several complaints, this department conducted an on site inspection at 65 Derby Street and have found said property to be unsafe and a danger to life and limb. The building is uninhabited and abandoned. The brick chimneys above the roof must be secured or removed. From the windows, I observed structural elements at the first floor level as being unsafe. The interior floors have well over a four inch pitch within a ten foot span, which leads me to believe the building is structurally unsound. I am requesting the said building be brought up to structural acceptance according to State Building Code with stamped approved drawings from a qualified structural Engineer submitted to this office. Or that the structure be demolished and removed within ten (10) days upon receipt of this letter. Failure to do so will result in the office acquiring special permission from the Mayor's office and or City of Salem Councillor's to have said structure removed and a lien placed on said property per State Building Code 780 GMB, Fifth Edition, Section 123.1 and 123. 2. If it appears that such structure would be especially unsafe in case of fire, it shall be deemed dangerous within the meaning hereof, and the building official may affix in a conspicuous place upon its exterior walls a notice of its dangerous condition, which shall not be removed or defaced without authority from him. 123.2 Removal or making structure safe: Any person so notified shall be allowed until twelve o'clock noon of the day following the service of the notice in which to begin to remove such building or structure or make it safe, or to make it secure, and he shall employ sufficient labor speedily to make it safe or remove it or to make it secure; but if the public safety so requires and if the mayor or selectmen so order, the building official may immediately enter upon the premises with the necessary workmen and assistants and cause such unsafe structure to be made safe or demolished without delay and a proper fence put up for the protection of passersby, or to be made secure.
