Dear Mr. Comeau:
My inspection of 50 Derby Street earlier this week confirmed the report of violations of
the Building Code and the Salem Zoning Ordinance. A third floor unit has been created
without a Building Permit and without a second means of egress both of which are in
violation of the Building Code 780 CMR.
You are hereby directed to remove said unit within 30 days of receipt of this notice. Your
options are to remove the third floor kitchen and combine the second and third floors into a
single dwelling unit or to combine the first and second floors into a single unit and add a
code-conforming second egress to the third floor. A Building Permit is required for this
work.
Failure to correct this violation may result in further actions being brought against you, up
to and including fines and the filing of criminal complaints at District Court.
