In response to your request for a Certificate of Inspection, the
,-.referenced premises were inspected on December 12, 1977., The
Inspection revealed the following deficienc#es that require
correction prior to the issuance of a Certificate.
1 . All "EXIT" fixtures shall have all bulbs active.
2. Provide an additional emergency lighting fixture in rear
exterior exitway.
3• Provide an additional "EXIT" sign and emergency lighting
fixture in the second floor pantry.

Bancroft House has ',been designated by the Salem
Redevelopment Authority as the developer of a 'parcel
of land -(approx. 30,000 s.T. ) .in -Salem's urban renewal area,
which has frontage on Derby 'Square ,and ^Central Street,
and also lies between buildings which face on Zssex
and Front Streets.
Our architect ' Richard Reece of Jung/Brannen-Richard
Reece, Boston, has prepared sketehes ,for a -building
which will contain approximately 55 000 s.f. of floor
space, of which about 45,,000-, s.f. will be for retail
uses, about 5,000 s.f. for offices$ and about 5,000 s.f.
-for function rooms, storage areas .and offices for
Bancroft House.
Our objective ' s to createaunique marketplace--
a'lively and exciting place 'to shop, Just as the
Quincy ,Market in .Bcston ,is. We7pr

,pose to achieve that
goal through -various -means, such as' a covered, arched
arcade •,along three sides of the building, and a very
colorful Interior. We are also exploring thepossibility
of� installing solar ,collectors, .But :most importantly,
we plan to -arrange shops and stalls on several levels
separated by no more than a half flight of stairs; and
in the center of the building there will be -open area
;or atrium extending from the lowest level to a rooftop
skylight. The function -facilities will be - a separate
part ofthe ,buildingj protected -as required by the
'State Building Code.
On April `28, 1977 we presented our concepts and .sketches
'to officials of Salem's Building and .Fire Departments,
and others. Mr. Powers, Salem's Building Inspector, has
raised the following question: because most of the

to us because all of Section -460 is concerned only
with school buildings. Mr. Powers has siated' that a
resolution of this matter is .necessary before we can
proceed with our present plans.
Consequently, yesterday 1 spoke to Mr. Paul Moriarty,
an attorney for the State Building Code Commission,
and gave him the facts as summarized in this letter.
He informed me that in his opinion as -well as a
'Mr. Dimatteo an architect for the Commission, our
interpretation is correct: namely, that all of
Section 460 applies only to school buildings, as stated
in its. preamble. He also said that in his opinion the
wording of Section 460.4 does need to be clarified, in
order to make it quite clear that it applies only to
school structures and not to all buildings.
lir. Moriarty suggested that this matter could be cleared
up either through an appeal to the Commission by us and
our architect, or by a letter from you or Mr. Powers
to the Commission. When 1 related the foregoing to
Mr. Powers today, he agreed with us that the appeal
procedure was not the preferable alternative, but he
also stated that a letter to the Commission must
originate with you.
We therefore request, and shall greatly appreciate,
your cooperation in writing such a ,letter to the Commission
and in helping us to clarify this .matter . at the
-earliest possible date.

Tests were conducted this date at the Bancroft _Restaurant,
7 Derby Square; on the new sprinkler system. The system
was filled with water at approx. 9: 30 A M and Engine %f6
placed one 212" line into the siamese connection and pumped at
one-hundred PSI. , Readings at gauges were as follows.
# At OS&Y valve-100 PSI; at top floor-90 PSI (Static )
Two lines were then placed into the fire department connection
and Engine #6 pumped at 150 PSI. Readings at gauges were as follows.
At OS&Y valve-158 PSI; at top floor-145 PSI ( Static )

Engine ff6 then increased the pressure to 200 PSI, and the following
readings were taken at the gauges.
200 PSI at the OS&Y valve; 182 PSI at the third floor. (Static)
175 PSI at the OS&Y valve; 150 PSI at the third floor, (Residual:)

The system was then left with 200 PSI for a hydrostatic test, the
t time being 9:45 A . M.
I returned' at 11: 50 A. M. and found the system had held at the Static 1
readings of 200 PSI at the OS&Y valve and of 182 PSI at the third
floor.
This system is therefor acceptable to this bureau.
It shall be noted however that the electric bell has not-been f-
:' irlstalled as of this date, and no zoning annunciator is available
for location of alarm as of this date.

I have reviewed the drawings, sheets 1 thru 8, for the above project and
stamped those giving structural information.
I inspected the existing structure in July 1975, which was in good sound
condition. The existing frame, strengthened as shown on the drawings,
will carry a safe live floor load of 100 p. s. f.
The 7" concrete slab spenning 10 feet should be reinforced with #5 @ 10"
bottom and #4 @ 18" distribution bars. Concrete fc' = 3000 Steel fy = 40, 000.
I hereby certify that the drawings conform to the structural recommendations
of the Commonwealth of Massachusetts State Building Code.

of General Laws, Chapter 22, Section 13A, and Chapter 30A on an appli-
cation for modification of, or substitution for, certain Rules and
Regulations of the Board as specified in said application on behalf of

Upon the evidence and testimony presented the Board VOTED:

Grant variance Section 30.6 on basement, mezzanine and 2nd floor only; and that public
toilets on first floor restaurant be installed for the handicapped and that they be
