RE: Public Parking Lot
Dear Mr. Pezzulo,
On September 12d', 2024 it came to my attention that you have been operating the
property at 21 Webb Street as a public parking lot with signage posted directing
people to pay$15 to park through a Venmo account. I posted stop work orders
over your signage since the use of the property is in violation of the zoning
ordinance sections 3.1 Principal and Accessory Use Regulations and 5.1 Off-
Street Parking. Shortly after, you gave me a call to discuss the property and I
informed you of the following:
• The public parking lot that has been created cannot exist as a stand-alone
commercial parking lot. The zoning ordinance clearly identifies off-street
parking lots as accessory to a building or use that is established on the
same lot (Section 5.1.1). The stand-alone public parking lot is not an
allowed use according to the use regulations table for an R2 zone, section
3.1 of the Salem Zoning Ordinance.
• You mentioned near-by residents lease some of the parking spaces and/or
stalls in the existing(6)bay garage building. I informed you that since this
is not a legal commercial public parking lot, the ownership of the lot needs
to be the same as the ownership of the building(s) of the residents using
the lot, or else this use shall be deemed a violation as per Sections 5.1.2
and 5.1.7 of the Zoning Ordinance.

• The public parking lot is in violation of the off-street parking design
requirements of Sections 5.1.5 and 5.1.10,where the lot is currently
accommodating spaces for ten or more vehicles(including the intended
use of the six-bay garage building).
• I have also informed you the property lies outside the designated zone for
the Halloween Parking Overlay District and therefore you cannot
accommodate the increasing tourist population visiting the City and offer
public parking at this site.
Our conversation ended with me telling you to cease and desist the use of the
property as a public parking lot.
Since that conversation, it has come to my attention that you have removed the
stop work order signs I posted and have continued to use the property as a public
parking lot in defiance of my cease and desist order. You have posted pay-to-park
signs tied to the Venmo account with fees in increasing charges of$25, $30 and
$40 over the past three weeks. Due to the aforementioned violations and defiance
of my cease and desist order, I will be ticketing you daily until you correct the
existing violations.
If you are aggrieved by this notice, your appeal is to the Zoning Board of
Appeals.
