Dear Peter:
On November 18, 1999, we wrote to you regarding violations of the Salem Zoning Ordinance at
31 Dearborn Street, a two-family house located directly across the street from our house. For
your information, a copy of that letter is enclosed. A few weeks after our writing that letter, the
person living in the attic left, and the attic had been unoccupied until about three weeks ago.
Unfortunately, it appears the attic is again occupied.
Please consider this letter a "written complaint" in accordance with Section 9-2 (a) of the Salem
Zoning Ordinance that the two-family house at 31 Dearborn Street is being used as a three-family
house in violation of the ordinance. Approximately three weeks ago, we observed that the attic
at 31 Dearborn is again being occupied, this time by at least one person but possibly two, who
park a truck (Ontario license plate number 376-4JD) in front of the house every night. We are
therefore again requesting that you record our complaint, investigate, and take action to
discontinue the use of the third dwelling unit at 31 Dearborn. We also request that the owner be
fined, per Section 9-2 (c), as stated in our letter last year.
As we said when we wrote last year, there is inadequate parking for the existing two-family use,
so the absense of parking should preclude any expanded use of the property. Also, we believe
the attic lacks a second means of egress, which should preclude use of the attic from a safety
standpoint.

Dear Peter:
In accordance with Section 9-2 (a) of the Salem Zoning Ordinance, we would like to report what
appear to be violations of the Salem Zoning Ordinance at 31 Dearborn Street, a two-family house
located directly across the street from our house.
1. Approximately four years ago, a woman, Tamara S. Waldmiller, moved into the attic of 31
Dearborn. She later married and was joined by Pedro 1. Fabre, her husband, and they then had
a daughter. (Their name is now Waldmiller-Fabre.) They left in September, 1999, moving to
4 Goodell Street, Salem.
No variance was ever approved for a third apartment at 31 Dearborn, and we believe their
occupancy of the attic constitutes daily violations of the zoning ordinance. Therefore we are
requesting that the owner of 31 Dearborn Street, as the party responsible for and profiting
from these violations, be fined $146,000 ($100/day x 1,460 days)per Section 9-2 (c).
2. In late September, 1999, we observed that the attic at 31 Dearborn is again being occupied,
this time by at least one man, driving an automobile with Massachusetts license plate number
5299 RV. Therefore we are requesting that the zoning ordinance be enforced, that the owner
be fined, and that use of the attic at 31 Dearborn be discontinued.
Additionally, there is inadequate legal parking for the existing two-family use, so lack of parking
should preclude any expanded use of the property. Also, we believe the attic lacks a second
means of egress, which should preclude use of the attic from a safety standpoint.

This letter references your visit to 31 Dearborn Street on Thursday evening, February 16,
2001, in regard to a complaint of a third floor apartment at thisproperty. Currently, I
have friends staying with me using the extra bedroom on the 3` floor. My friends will be
leaving next month.
I understand that the 3`d floor is considered a unit because a door closes it off. By
removing the door to the 3`d floor, I understand I may then use this as part of my house
for friends and family who visit with me.

Dear Jean:
I'm in receipt of your letter dated February 16, 2001.
I would like to clarify the issue of tenant separation. In order to use the third floor space,
the rooms would have to be directly accessible from your unit. Leaving your unit and
going into a common hallway to access the third floor is not a solution.
The only practical way to use the third floor would be to connect the second and third
floor units together.
I hope this clarifies this Departments position.
