Marx,Jr. P.E. Re: Engineer Statement for Peirce Residence, 20 Dearborn St., Salem,MA for Solar Roof Installation I I have verified the adequacy and structural integrity of the existing roof rafters for mounting of solar panels and their installation will satisfy the structural roof framing design-loading requirements of the Massachusetts building code—780 CMR Residential Code 8th Ed. For the installation of the solar mounting, the Ironridge mounting rails will be anchored I to the rafters with Quick Mount on the center of the rafters and will be securely fastened to the rafters with lag screws. The design is based on the added weight of the F collectors, wind speed of 100 mph, exposure B and ground snow load of 40 psf. The Photovoltaic system and the mounting assemblies will comply with the applicable sections of the Residential Code and loading requirements of roof-mounted collectors. Thereby, I endorse the solar panel installation and certify this design to be structurally j adequate. - Sincerely, 2 SN OF yrysyG F JAMESA- z MARX.JR. c01 CIVIL NO.36365 O James A.Marx,Jr. P.E. oe 9Fcrsrea Professional Engineer Fri MA Professional Engineer 36365 2 10 High Mountain Road Ringwood,NJ 07456 I cc:Sungevity i i i SOLAR ELECTRIC SYSTEM i PEIRCE RESIDENCE SALEM, MA i I . Although the current documentation included with the LGate 101E conflicts with these claims, we are in the process of changing the language in our new installation packet to make the range of usable breakers sufficiently clear. In the meantime I can provide you with our product sheet that states this requirement. I have included a relevant quote from page 15: "The LGate 101 accepts the following inputs: 1.Voltage Sense—through the 120V power cable or wired directly to a two-pole circuit breaker 20A or less for 240V." If you have any concerns about the safety of using breakers smaller than 20A you can direct them to Locus Energy's offices in New York and California. If we do not receive a floor plan per our request we will not issue an occupancy Permit . You were told this when filling permit applications on August 17 , 1995 verbally by myself. And Mr. John Jennings at an inspection in February 1995 , also requested that the floor plan layout be submitted to our office . I would also like to make you aware that any industrial use of the new building, would be a substantial change of use, and would require approval from the City of Salem Zoning .Board of Appeals . On June 11 , 1996 I received such a drawing, and my findings after a review of the drawings are as such. The property in question is located in a B-5 District. The B-5 District allows business and professional offices . It also allows accessory uses generally in support of the above permitted use . A review of your drawings shows that the principal use of the building is not that of business or professional offices. Article II Definition Use : The specific purpose for which land or, a building. and land, is designed, or for which it is or may be occupied or maintained . Article II Definition Building, Principal : A building in which is conducted the main or principal use of the lot on which said building is situated. Article II Definition Accessory building or use: A building or use on the same lot with, and of a nature customarily incidental and subordinate to , the principal building or use . It is my determination after speaking with you and reviewing the drawings submitted to my office that you intend to utilize the greater portion of this building for an illegal use in a B-5 District. Until you can assure this office that the principal use of this building is for professional offices , an Occupancy Permit will not be issued. A secondary use in my estimation would be for parking of vehicles, and storage of office supplies . Further, unless the building is brought into compliance, the City will soon take legal action which will result in the complete removal of the structure. The drawing you provided me at the job site on November 7 , 1996 during our visit , was one in the same that this office rejected on June 11 , 1996 except for the wording of "Office Space" "Inventory Storage" '-of "Warehouse" . My findings are still one and the same as described in my June 17 . 1996 letter ( Letter enclosed ` . As for my visit satisfying my concerns : 1 . Rough inspections were conducted by the plumbing inspector for the second floor level , but the building inspector was not contacted to make a rough inspection before closing of wall partitions with sheet rock. 2 . Exterior walls were not inspected by the building department at second floor level to enable sheet rock to be installed at exterior walls . 3 . No inspections were requested by your contractor before the suspended ceiling was installed at second floor level . This office responded to all requested inspection while foundation work and steel fabrication work was on going. We also inspected the pre-stress concrete panels at second floor level during and after installation. This office was not notified prior to your installing the sheet rock walls and finish ceilings to perform a rough inspection . On my visit of November ? , 1996 it is my belief that you are occupying said building without an occupancy permit and performing non-conforming use in said structure. I am requesting that you stop illegally using said structure and start conforming with building codes and zoning ordinances . Please contact the Building Department to make proper inspections at the proper time of job sequence . We are reaching out to get you set up in Salem's Short-Term Rental(STR) program, which is required for eligible property rentals of under 30 days. Under the City Ordinance, anyone who is eligible to rent out their property to provide short-term lodging is responsible for registering the property and obtaining a Certificate of Fitness from the City's Health Department. If you registered the property prior to the Short-Term Rental Ordinance going into effect, the property needs to be re-registered to comply with the new ordinance. This includes lodging arranged through online sources. Because some homeowners may not be aware of the new obligations regarding short-term rentals, the City is offering an opportunity for eligible owners to comply with the registration requirement without incurring penalties. Visit our website at www.salem.com/str for more information and there is a link to register on the Harmari website. Please register with the Building Department as soon as possible to avoid penalties. Please feel free to contact us at 978-619-5640 with any questions you may have about the process and the requirements under the ordinance. We would like to help you achieve compliance quickly and easily. Failure to respond to this request may result in additional enforcement actions, including fines, and could result in your ineligibility to continue using your property as a short-term rental. Thank you for your prompt attention to this matter. Sincerely, Thomas St.Pierre Building Commissioner
