RECITALS OF FACT:
A. The dwelling at 16 Dearborn Street in Salem, Massachusetts
was built as a two family residence, with substantially
identical apartments on the first and second floors. Each
apartment has separate utilities for heat, forced hot water
by oil, hot water by gas, electric, and water. Each apartment
has two distinct entrances/exits. The attic is unfinished
and shared by both apartments. The basement contains separate
laundry facilities for each apartment. The driveway is greater
than two standard car widths and leads to a two car garage.
B. The following neighbors have lived on or close to Dearborn
Street since before 1965 and can testify and bear witness to,
that the dwelling at 16 Dearborn Street is and always has been
a two family dwelling.

Please be advised that I have examined various documentation
relative to the use of the above described premises as a two
family dwelling. I have examined correspondence from the owners
of this dwelling, Affidavits from abutters and various directory
listings.
Based on my review of this documentation, it is my opinion
that this dwelling was a lawful two family residence prior to the
adoption of the City Zoning ordinance in 1965. It is my opinion
that this dwelling should be afforded the protection of Section
VIII (E) of the aforementioned Ordinance relative to non-
conforming uses and this dwelling's current use as a two family
unit is permissible.

It is agreed and understood by and between the parties that the Product Specifications, along with the Custom Remodeling and
Improvement Agreement, constitutes the entire understanding between the parties,and replace any and all prior negotiations,
representations,or agreements,either written or oral. The Product Specifications may not be changed, modified,or varied in any way unless
such changes are in writing and signed by both Buyer(s)and Contractor. Buyer(s)hereby acknowledge that Buyer(s)has read the Product
Specifications.
