DECISION OF THE PETITION OF SAMUEL PAPALARDO JR. REQUESTING A
VARIANCE FOR THE PROPERTY LOCATED AT 6 DEARBORN LANE R1
A hearing on this petition was held August 21, 2002 with the following Board Members
present: Nina Cohen, Joan Boudreau, Richard Dionne, Bonnie Belair and Stephen
Harris. Notice of the hearing was sent to abutters and others and notices of the hearing
were properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
The petitioner is requesting a Variance from side setback to construct an addition for the
property located at 6 Dearborn Lane R-1
The Variances, which have been requested, may be granted upon a finding by this
Board that:
a. Special conditions and circumstances exist which especially affect the land, building
or structure involved and which are not generally affecting other lands, buildings and
structure involve.
b. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioners.
c. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district of the
purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1.The petitioner appeared and represented himself at the hearing
2. Plans were submitted showing the proposed addition to be constructed.
3. A petition was submitted with 4 abutters in favor or the petition.
4. There was no opposition to the plans.

On the basis of the above findings of fact, and on, the evidence presented at the
hearing, the Zoning Board of Appeal concludes as follows
1. Special conditions exist which especially affect the subject property but not the
district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the public good and
Without nullifying or substantially derogating from the intent of the district or the
purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted 5-0 to grant the Variances requested,
subject to the following conditions;
1. Petitioner shall comply with all city and state statutes, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted and
approved by the Building Commissioner.
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall
be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finishes of the new construction shall be in harmony with the existing
structure.
6. A Certificate of Occupancy shall be obtained.

A hearing on this petition was held on April 19, 2000, with the following Board Members'
present: Richard Harrison, Stephen Buczko, Stephen Harris, and Richard Dionne. o
Notice of the hearing was sent to abutters and other and notices of the hearing were
properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
The petitioner requesting Variance from side setback to add an addition to the side of
the existing building located at 6 Dearborn Lane.
The Variance which has been requested may be granted upon a finding of the Board
that:
a. Special conditions and circumstances exit which especially affect the land, building
or structure involved and which are not generally affecting other lands, buildings or
structures in the same district.
b. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner
c. Desirable relief maybe granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district or the
purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing and after viewing the plans, makes the following findings of fact:
1. The petitioner was opposed by Ms. DeVoe, who resides at 10 Dearborn Lane. Ms.
DeVoe sent a letter stating her objections.
2. Mr. Emanuel Gerontis who resides at 2 Dearborn Lane is a direct abutter and he
also had several objections. Mr. Gerontis 's objections were that the addition would
be less than six feet form his property line and the loss of privacy could possibly
lower his property value.
3. Pat Donahue who resides at 8 Dearborn Lane also voiced her objections.
On the basis of the above findings of fact, and on the evidence presented at the hearing,
the Board of Appeal concludes as follows:
1. Special conditions do not exist which especially affect the subject property and not
the district in general.

2. Literal enforcement of the provisions of the Zoning Ordinance would not result in

3. The relief requested cannot be granted without substantial detriment to the public
good or without nullifying and substantially hardship derogating from the intent of the
district or purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted 1 in favor and 4 in opposition to grant the
requested variances. Having failed to garner the four affirmative votes required to pass,
the motion is defeated and the petition is denied.

Following are the steps which we will follow to insure the proper
control and construction of the addition on your hone.
First you will find attached your building permit. This is for
foundation only.
V/!ou should have your engineer certify to you in writing (copy us) that
your footings are proper.

✓Call us for an inspection after the above is completed and you have in

hand a recertified plot plan showing set backs of new addition on lot.
Be aware that your application is for a 24 ft. addition, and that your
plot plan indicates a 22 ft. addition. In that either size addition
would be appropriate providing that the proper setbacks are maintained
youz permit for a foundation at this time will be honored. Location
requirements are as follows: 30 ft. rear yard, 10 ft. side yard, and
15 ft. front yard.
Be sure to have your foundation properly located within these require-
ments, re-certified by a surveyor and a new plot plan submitted to us
prior to starting frame construction. Failure on your part to adhere
to these instructions will result in us being unable to grant you a
permit for the structure.

FIRE DEPARTMENT CERTIFICATE OF APPROVAL FOR BUILDING PERMIT
In compliance with the provision of Section 113.5 of' the Massachusetts
State Building Code, and under guidelines agreed upon by the Salem Bldg.
Inspector and the Salem Fire Chief, the applicant for a building permit:
shall obtain the Certificate of Approval (see reverse side) and stamped
plan approval from the Salem Fire Prevention Bureau.
Said application and apjiroval is required before a building permit may be
issued. The Massachusetts State Building Code requires compliance
approval of the Salem Fice Department, with reference to provisions of
Articles 4 and 12 of the`Lluilding Code,. the Salem Fire Code, Massachusetts
General Laws, and 527 Code of Massachusetts, Regulations.
The applicant shall submit this application with three (3) sets of plans,
drawn in sufficient clarity, to obtain stamped approval of the Salem Fire
Department. This applies for all new construction, substantial
alterations, change of use and/or occupancy; and any other approvals
required by the Massachusetts General. Laws, and the Salem Fire Code.
Exception: Plans will not be required for structural work when the
proposed work'; to be performed. under the building permit will
Ant, in the opinion of the Building- Inspector, require a
plan to show the nature and character of the work to be
performed.

Notice: Plans are normally required for fire suppression systems,
fire alarm systems, tank installations, and Fire Code
requirements.
Under the provisions of Article 22 of the Massachusetts,'State Building

cases, provisions of Article 22, Appendix.T,. and Tables 'spplicable
shall apply. This section shall not, however, supersede the

11 (a) In conformance with the statement of the applicant
at the public hearing there shall be no filling on the
water side of lots 6 and 7 .
11 (b) Lot 5 shall be filled to conform with the Plan of Land
in Salem, Massachusetts, Sheets 1 and 2 , prepared by
George Hayes, Land Surveyor, dated May 5th, 1976 which
was submitted at the public hearing. The fill shall
conform with the requirements of condition 5 and
furthermore shall contain no deleterious substances
which may pollute by leaching. The riprap shall be the
size customarily used in the locality for erosion pre-
vention and it shall extend to at least the elevation
of the 100 year water elevation, 15. 2 feet mean low
water datum.
11 (c) The storm drain on lot 5 shall be relocated and con-
structed as shown on Plan of Land in Salem, Massachusetts
Sheet 1, prepared by George Hayes, Land Surveyor, dated
May 5th, 1976 which was submitted at the public hearing.
11 (d) All debris, branches, tree trunks, and stumps shall be
removed from the water side of all lots within one week

Dear sir, as a life long resident of SALEM my husband and I
who are retired and on a fix income, tried to get permission
from the building dept. to convert part of our home in No. Salem
to an eficiency apartment. We were flatly fefused due to our
neighborhood being only SINGLY FAMILY HOMES,we were dissapointed
but respect the city rules .
Now we fiord out that a Mr. Leanard Papalado of Dearborn Lane ,
(a stone throu from us) is presently adding on to his home to
build a seperate residence for a familly member,the addition is
almost as large as his home and built right on water property.
Could it be a coincidence that his neighbor is on the PLANNING
BOARD, His father (who is Moving in) is on the LISENCE BOARD and
His UNCLE happens to be the MAYOR os SALEM. We have made inquiries
to the building departement but have been put off with "its
already done" I am sure if this letter does ever appear all will
be denied and within a year two families with seperate facilities
will be living on Dearborn La.
Iguess it is true . .I;'ts WHO YOU KNOW.

Dear Mr. Rock:
Pursuant to your request, we have reviewed the following information regarding solar panel installation on the roof
of the above referenced home:
1. Site Visit/Verification Form prepared by a Vivint Solar representative identifying specific site information
including size and spacing of rafters for the existing roof structure.
2. Design drawings of the proposed system including a site plan, roof plan and connection details for the solar
panels. This information was prepared by the Design Group and will be utilized for approval and construction
of the proposed system.
3. Photovoltaic Rooftop Solar System Permit Submittal identifying design parameters for the solar system.
4. Photographs of the interior and exterior of the roof system identifying existing structural members and their
conditions.
Based on the above information we have evaluated the structural capacity of the existing roof system to support
the additional loads imposed by the solar panels and have the following comments related to our review and
evaluation:
Description of Residence:
The existing residence is typical wood framing construction with the roof system consisting of 2 x 6 dimensional
lumber at 16" on center. Collar ties were not present during the inspection. The attic space is unfinished and
photos indicate that there was free access to visually inspect the size and condition of the roof rafters. All wood
material utilized for the roof system is assumed to be Spruce-Pine-Fir #2 or better with standard construction
components. Our review of the photos of the exterior roof does not indicate any signs of settlement or
misalignment caused by overstressed underlying members.
Stability Evaluation:
A. Wind Uplift Loading
1. Refer to attached Ecolibrium Solar calculations sheet for ASCE/SEI 7-10 Minimum Design Loads for Buildings
and other Structures, wind speed of 100 mph based on Exposure Category"B"and 15, 27 and 14 degree roof
slopes on the dwelling areas. Ground snow load is 40 PSF for Exposure "B",Zone 2 per(ASCE/SE17-10).
2. Total area subject to wind uplift is calculated for the Interior, Edge and Corner Zones of the dwelling.

B. Loading Criteria
10 PSF=Dead Load roofing/framing 40 PSF=Live Load (ground snow load)
5 PSF= Dead Load solar panels/mounting hardware
Total Dead Load=15 PSF
The above values are within acceptable limits of recognized industry standards for similar structures. Analysis
performed of the existing roof structure utilizing the above loading criteria indicates that the existing rafters will
support the additional panel loading without damage, if installed correctly.
C. Root Structure Capacity
1. The photographs provided of the attic space and roof rafters show that the framing is in good condition with no
visible signs of damage caused by prior overstressing.
D. Solar Panel Anchorage
1. The solar panels shall be mounted in accordance with the most recent "Ecolibrium Solar Installation Manual',
which can be found on the Ecolibrium Solar website (ecolibriumsolar.com). If during solar panel installation,
the roof framing members appear unstable, deteriorated, structurally compromised or deflect non-uniformly,
our office should be notified before proceeding with the installation.
2. Maximum allowable pullout per lag screw is 235 Ibs/inch of penetration as identified in the National Design
Standards (NDS) of timber construction specifications for Hem-Fir (North Lumber) assumed. Based on our
evaluation,the pullout value, utilizing a penetration depth of 2 1/2", is less than what is allowable per connection
and therefore is adequate. Based on the variable factors for the existing roof framing and installation
tolerances, using a thread depth of 2 Yz'with a minimum size of 5/16"lag screw per attachment point for panel
anchor mounts should be adequate with a sufficient factor of safety.
3. Considering the roof slopes, the size, spacing, condition of roof, the panel supports shall be placed at and
attached to no greater than every fourth roof rafter as panels are installed perpendicular across rafters and no
greater than the panel length when installed parallel to the rafters (portrait). No panel supports spacing shall
be greater than four(4) rafter spaces or 64"o/c,whichever is less.
4. Panel supports connections shall be staggered to distribute load to adjacent rafters.
Based on the above evaluation, it is the opinion of this office that with appropriate panel anchors being utilized the
roof system will adequately support the additional loading imposed by the solar panels. This evaluation is based on
information supplied to us at the time of this report and current industry standards and practices.
