All Board members excepting 'Mr. Gray and Mir. Labrecque were nres-_J; :: . Counselor John Crean appeared for the petitioner, and explained the: c..�se ' the same as in the appeal on file ; his client is the owner of two of land on Day Avenue , namely Lot L and Lot M, on each of which he propGses to erect a two family dwelling; the Ordinance requLres a lot area of 7000 sqtiare- feet in this district , and petitioner ' s , plan sficws each lct size to he 6023 .2 square feet . Appearing opposed to granting this appeal were the Ward Councillor Edmond Perron, P.butters , and many neighbors . A document protestin.E., granting this variance , containing fifteen signatures of abutters and oth.e.r residents of Day Avenue was presented and becomes an integral- part of the f- !.o an this case . The following is a summary in brief of some of' their o'_' ,;ctions : Granting of an easement by the abutters on Day Avernie to the forf!�'_,r owner to dig a trench for the purpose olf installing a water line w-Ith the .ander- standi-ng and condition that one single family dwelling would be erected, which was verified on May J-5--i-6 , 1966 , by the former owner, his and an abutter, was withdrawn and the City Planning Board was notified because of failure to execute original intent ; reference was made of refusal by the Planning Board to allow petitioner to -extend sewerage on Day Avenue for reasons by the then City Engineer, Mr. Neal B. Mitchell . After studying the facts presented, the members found that on July 28 , 1967 , petitioner was notified by the City Planning Board that approval to extend . the sewerage on Day Avenue was denied for reasons listed in a lel-ter from the City Engineer, dated May 26 , 1967 , and was advised to have his en,,3-neer confer with the City Engineer and answer all his criticisms , after wh_;.C.I. a new plan might be submitted. Levels taken at the site indicate the existing sanitary sewer can not be extended in a southwesterly direc- tion if the present road grade is maintained, and minimum acceptable limits of cover and slope are maintained . Note should be made that any change in profile will have to be approved by the Planning Board, provis- ion made for drainage , slope easements taken or provisions made for kcep .i: fill off abutting private property , and the existing 40 foot layorit maintained. "There :is no water main in D.6y Avenue. Existing houses are on copper services that extend to Linden Street with one l" service supplying two of the houses" .
