Dear Martin and Joan,
Due to a complaint received by the Fire Department from a tenant residing at the above property,
a required inspection was conducted on Thursday June 6,2024 by Building, Fire and Health
Inspectors. During the inspection it was confirmed that an illegal apartment has been created
again in the basement. This issue has been on going over the years since 1999. On March
28,2019 you signed an affidavit stating that the basement space is part of the first floor, which it
is not and is being used as a single apartment.
The building is assessed as a lawful nonconforming five(5) family dwelling located in the
residential two-family district(R-2). During our inspection it was also confirmed that there are
eight (8) dwelling units in the entire building including the basement. No permits or records exist
that the other three(3) dwelling units were created legally. During the inspection you were
directed to cease the use of the illegal basement unit, and to contact this office to discuss the
situation.
You are directed to cease occupying the basement unit immediately as you were directed during
the inspection and to contact this office to discuss the illegally created units.
If you feel aggrieved by this order, your appeal would be to the Board of Buildings, Regulations
and Standards in Boston.
