An application is being submitted to the Board of Appeals for the following reason(s):
This is a refiling of an application that was approved by the Board in August,2022. Petitioner required approvals from the Salem
Conservation Commission in order to apply for a building permit. Petitioner timely filed Notices of Intent with the Commission in
September,2022;however,through no fault of Petitioner the Commission did not approve the applications until August,2023.
Further, Petitioner is still awaiting the issuance of an Order of Conditions,which Petitioner expects to receive in the near future.
Petitioner is proposing to construct two single family residences on five separate and contiguous land court parcels. The property
has direct access to Durkin Road and Martin Lane via a paper street(formerly Sable Road)that predates the zoning ordinance. The
property has 265 feet of frontage on the paper street and 25,788 square feet of area. One dwelling will be constructed on three
parcels totaling 15,000 square feet and will meet R1 zoning. The other dwelling will be constructed on two parcels totaling 10,788
square feet and will require variances for minimum lot area,lot area per dwelling unit and lot width. See Petitioner's Statement
and documents referenced therein for additional information regarding the application.

The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be
constructed as per the plans submitted,as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning
Ordinance.
