Dear Mr. O 'Brien :
You have inquired whether the use of 26 Daniels Street by
Mr. William McKinnon as a six family dwelling unit is now improper
because , as a non-conforming use , it has not been so used for
more than one year. The premises in past years have been used
as a six family building.
The test of abandonment of the non-conforming use has not
been met in this situation. Mr. McKinnon has continued to work
on the building since it was last occupied in order to restore
it to code specifications. He took down an adjacent dwelling
to provide parking which is required for a six family unit , and
has provided parking in excess of requirements. The action taken
by Mr. McKinnon in the last few years , as a question of fact
disclose , that there was not an intent to abandon the "non-
conforming use" status of this structure . Accordingly, Mr.
McKinnon may so use .this structure in the future and a permit
may properly issue.,from your office to complete his renovations.

You are hereby ORDERED to make a good faith effort to correct these violations; said
correction of these violations shall be commenced IMMEDIATELY ,
after receipt of this letter and shall be completed no later than 24 HOURS
Also notify the Health Department immediately by letter of your intentions to make
these repairs.
Under Provisions of Article 2 of the State Code, the above are considered EMERGENCY
CONDITIONS which may endanger or materially impair the health and/or safety and well-
being of an occupant.
You are hereby advised of your right to a Hearing before the Board of Health by filing

dwelling, and, that we sold both properties to Donald A. Felt, as
Trustee of Atlantic Properties on June 5, 1978 as a six family
dwelling (26-28 Daniels Street) and a three family (9 Kosciusko
Street) , and I, William F. McKinnon, do know for fact from my j

Dear Mr. Pitcoff: Re-Presently owned McKinnon Properties,
With regard to the four residential buildings referred to by Mr. Wil-
liam F. McKinnon as his properties in Salem, our records disclose the
following information:
30 March Street: - There was difficulty with this particular property;
it had been idle for a considerable length of time, and in
1966 Mr. McKinnon did some repair work and made the place hab-
itable, having obtained a permit to install shingles, enclose
two corner porches, and a new door with three or four steps.
4 Daniels Street Court: - I condemned the rear porches some years back.
He has now rebuilt the porches and renovated the three apart-
ments in the house' which is presently occupied. In 1969, we
issued a permit to- remove back and side porches from the three
floors of the structure; in 1970, he was granted a permit to
remove and replace some doors and windows, and to replace three
ches.
26 Daniels Street: He has been working on this house practically all
of the mer; in a few weeks, it will probably be ready for
ion. A permit was obtained from this office in 1970 to
replace clapboards, and to repair window mouldings and porches.
In March of this year, a permit was issued to remove bathroom
partitions and restructure bathrooms with new plumbing, new
wiring, new ceilings, heating system.
14 Kosciusko Street: - In 190$ this house was in poor Condition. We
issued a permit in 1969 to install three windows, board in six
former doorways, repair exterior stairway or replace same, and
make general repairs to interior walls and ceilings.
This is the extent of records in this department relating to these
four parcels of property.
