Decision
City of Salem Zoning Board of Appeals
Petition of Hans Weedon requesting a Variance from rear yard setback
and a Special Permit to modify an existing non-conforming building, to
allow for a second story balcony for the property located at 1A
DANIELS STREET COURT [R-2].
A public hearing on the above petition was opened on October 17, 2007 pursuant to Mass
General Law Ch. 40A, Sec. 11, with the following Zoning Board members present:
Robin Stein, Rebecca Curran, Richard Dionne, Bonnie Belair and Elizabeth Debski.
Petitioner seeks variances pursuant to Section 9-5 and a special permit pursuant to
Section 8-4 to allow for a second story balcony.
The Board of Appeal, after careful consideration of the evidence presented at the public
hearing, and after thorough review of the pians and petition submitted, makes the
following findings of fact:
1. Architect Helen Sides, presented the petition for the property owned by Hans
Weedon at IA Daniels Street Court in the R-2 Zoning District.
2. The proposed balcony is part of a second story addition. The residence is
currently one story and the Zoning Ordinance allows for 2 1/2. The requested
relief is exclsuively for the balcony.
3. The proposed balcony is shown on the plans prepared by HF Sides Arch LLC
entitled "Weedon Loft", dated January 23, 2007, sheets A3-A6. The 3' x 10'
proposed balcony is on the south side of the residence and it would extend
into the already non-conforming rear yard by 3'.
On the basis of the above findings of fact and all evidence presented at the public hearing
including, but not limited to, the Plans, Documents and testimony, the Zoning Board of
Appeals concludes as follows:
1. The petitioner may vary the terms of the Residential Two-Family Zoning
District to enable the proposed development, which development is consistent
with the intent and purpose of the City of Salem Zoning Ordinance.

2. In permitting such change, the Board of Appeals requires certain appropriate
conditions and safeguards as noted below.
In consideration of the above, the Salem Board of Appeals voted, five (5) in favor(Stein,
Debski, Belair, Dionne, and Curran) none (0) opposed, to grant petitioner's requests for a
variance and special permit subject to the following terms, conditions, and safeguards:
1. Petitioner shall comply with all city and state statutes, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted to and
approved by the Building Commissioner.
3. All requirements of the Salem Fire Department relative to smoke and fire safety
shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finishes of new construction shall be in harmony with the existing
structure.
6. A Certificate of Inspection is to be obtained.
7. Petitioner shall obtain approval from any of the City Boards or Commissions
having jurisdiction including, but not limited to, the Planning Board.
8. There shall be no exterior stairs connecting to the balcony.

An inspection was made this date of the proposed addition of
a three story structure to the existing three story building
now situated at this location.
The Salem Fire Department does not feel the structural addition
would increase the fire potential at this location, based on
the use of a fire wall between the existing structure and the
addition. The increase in occupancy use to a six family structure
will not substantially increase the fire hazard, as proposed.
The density regulation affecting the Southerly side of the addition
where only 8j feet will separate the new addition from the building
on Daniels Street, would be wiser to be kept at the ten feet spacing
normally required by the Mass. Building Code. However, we realize
architecural concerns may be a deciding factor in this case. There-
for while the 8'j feet is not ideal, we could tolerate this condition.
It appears that the best and most efficient use of this land would
be served by a use such as intended by the petitioner. It has
been noted that sufficient parking space will be available and
would also serve as a working area for fire fighting purposes.
The provisions of Chapter 1480 Section 26Ci relating to installation
of a fire alarm system, will be mandatory.

partitions and restructure bathrooms with new plumbing, new
wiring, new ceilings, heating system.
14 Kosciusko Street: - In 196$ this house was in poor Condition. We
issued a permit in 1969 to install three windows, board in six
former doorways, repair exterior stairway or replace same, and
\ make general repairs to interior walls and ceilings.

A design check for the subject residence was done on the existing roofing and framing systems for the installation of solar
panels over the roof. From a field inspection of the property, the existing roof support structures were observed as follows:
The roof structure of (MPI) consists of composition shingle on roof plywood that is supported by nominal 2x8 rafters @
16"o.c.. The rafters are framed over an existing flat roof. The rafters have a max projected horizontal span of 15'-0", with a
slope of 5 degrees. The rafters are supported on both ends by a load bearing wall.
The existing roof framing system of (MPI) is judged to be adequate to withstand the loading imposed by the installation of the
solar panels. No reinforcement is necessary.
The spacing of the solar standoffs should be kept at 48" o.c. with a staggered pattern to ensure proper distribution of loads.
I further certify that all applicable loads required by the codes and design criteria listed below were applied to the Unirac
Sunframe solar rail system and analyzed. Furthermore, the installation crews have been thoroughly trained to install the solar
panels based on the specific roof installation instructions developed by Unirac Sunframe for the racking system and
Quickmount for the roof connections. Finally, I accept the certifications indicated by the solar panel manufacturer for the
ability of the panels to withstand high wind and snow loads.
Design Criteria:
• Applicable Codes = Massachusetts Residential Code, 8th Edition, ASCE 7-05, and 2005 NDS
• Roof Dead Load = 8 psf (MPI)
• Roof Live Load = 20 psf
• Wind Speed =100 mph, Exposure C
• Ground Snow Load = 40 psf - Roof Snow Load = 28 psf
