11 ROPES STREET UNIT 1 NOTICE OF POST-COMPLIANCE LEAD HAZARDS 5-10-2024 NOTICE OF POST-COMPLIANCE LEAD HAZARDS
A lead inspector has completed a post-compliance assessment determination(PCAD)or a comprehensive inspection acting
as a PCAD at property owned by you. This PCAD revealed that certain leaded areas no longer meet the standards of the
Letter of Compliance for the unit. See the attached report for more details.
If this property has been cited by a code enforcement inspector or a housing quality standards inspector, you must
follow the requirements to correct the hazards provided to you by that inspector. Otherwise, follow the instructions
in this letter.
Within 30 days from this PCAD,work needed to correct post-compliance lead hazards must be done a person over the age
of 18. There are different requirements for who can do this work using lead safe work practices.
a. For a rental property, usually certified lead-safe renovators must do the work. Contact DLS to find out
about certified lead-safe renovators and requirements for lead safe work practices at
www.mass.gov/lwd/labor-standards/deleadin)z-and-lead-safM
b. Contractors hired to do most repair work must be certified lead-safe renovators.Contact DLS to find out
about certified lead-safe renovators and requirements for lead safe work practices at
www.mass.2ov/lwd/labor-standards/deleading-and-lead-safetv
c. If you are working in the home you live in,you still need to work safely. Go to
www.epaa.gov/lead/renovation-repair-and-paintingpro2ram-do-it-yourselfers to learn more.
Once hazards are corrected, the owner should bring a lead inspector in to document the work. The inspector will check that
all lead hazards have been corrected, there are no signs of paint chips, dust,or debris, and that dust samples meet acceptable
standards. If all this is completed within 30 days of the PCAD,the inspector will issue a"Certification of Maintained
Compliance,"an addendum to the Letter of Compliance.
If some of the work was completed by the 30`"day,but not all,the owner MUST contact the inspector to reinspect the work
that has been completed to date. The inspector will reinspect and comply the work that has been completed appropriately to
this point,as well as provide guidance on the next steps needed to address the remaining violations. Failing to schedule the
reinspection by day 30 jeopardizes an owner's compliance status.
After 30 days, all remaining lead hazards can only be corrected following the deleading requirements, including the
requirement to use authorized people and relocate occupants for high or moderate risk work inside the home. The
level of authorization required depends on whether the corrective work to be done is high-risk,moderate-risk,or low-risk.
In addition, other rules required for deleading projects must be followed, including a 10-day advance deleading notification.
Visit www.mass.gov/dph/cl=p or contact CLPPP at 800-532-9571 for more information about how to become authorized
before doing any work. Inspectors do not have authority to grant extensions beyond the 30-day period.Once the work
is done and documented by the lead inspector as being completed, including dust samples and collection of invoices from
authorized workers, the unit will be eligible for a"Certification of Restored Compliance,"an addendum to the Letter of Full
Compliance.
In cases where corrective work is not performed by appropriately authorized people, when required,CLPPP will reject the
Letter of Compliance. CLPPP may issue in its place a letter documenting the history of unauthorized deleading.
Property owners are urged to maintain their properties in good repair at all times. When corrective work is
necessary, owners should carefully follow the requirements for post-compliance corrections,to ensure that children
and workers are not put at risk, the home is not contaminated, and to ensure that the owner does not subject
him/herself to liability for failing to properly maintain the property.
