referenced property. I feel I have done all I can to satisfy Mr. Groszyk.
I conducted an inspection of the property and made inquiries and was
assured the property was occupied by two brothers and a friend, which is an
allowable use in an R-1 district. I was comfortable with this finding but
as you can see from his latest letter Mr. Groszyk, he is not satisfied with
my finding.
As I am at .a loss as to what more I can, in my capacity as Zoning

the installation of 18 feet of granite curb and sidewalk at 6 Crowdis Street.
I have discussed this matter extensively with the Ward 4 Councillor;MF-Leonard—`4

In accordance with chapter 26, Section 105 of the Salem Code of Ordinances,
I hereby grant your request for a waiver of curbing and sidewalk based on the
following:
I . Short length of curb proposed to be installed due to an interuption
of a wide driveway.
2. Sidewalks and curbing do not presently exist in the adjacent area on
Crowdis Street.
3. Drainage will not be adversely affected.

DECISION ON THE PETITION-OF-PETRO & ANASTASIA THEOPHILOPOULOS
FOR VARIANCES AT- 4'4- CROWDIS ST-(R-1 )
A hearing on this petition was held October 12, 1988 with the following Board
Members present: James Fleming, Chairman; Messrs. , Bencal, Nutting and Strout.
Notice of the hearing was sent to abutters and others and notices of the hearing
were properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
Petitioners, owners of the property, are seeking variances to allow an
existing deck in this R-1 district.
The Variances which have been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purposes of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . Minimal neighborhood opposition was voiced;
2. The lot in question is long and narrow;
3. The decks serve as a means of egress;
4. The area covered by the deck has much ledge.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . The property is unique due to the size of the lot;
2. The conditions described affect the land in question but do not
affect the district in general;
3. The requested Variance may be granted without substantial detriment to
the public good.

Dear Mr. Beaulieu,
On October 28, 1987, we performed bacteriological analyses on
samples of water you collected from 40 ' of water pipe newly
installed at the end of Crowdis Street. The results of these
analyses showed the pipe to be bacteriologically
contaminated.
On December 7 , you again collected samples from the end of
the newly installed pipe. You also collected samples from
two homes on Crdwdis=S=treet before the new pipe. This was to
see if the contamination was limited to the new section of
pipe or originated in the municipal system. The sample from
the new pipe again showed contamination, but the samples from
the houses did not, indicating the source of the
contamination is in the newly installed pipe.
The source of contamination in the new pipe must be
eliminated and the pipe chlorinated in accordance with
accepted standards (AWWA C651-86) before the new pipe can be
connected to the Salem municipal system.

The Planning Board voted on July 2, 1987 to approve the proposed
subdivision plan entitled, "Subdivision plan, Crowdis Street ," dated
July 8, 1986 , subject to the following conditions:
1 . Proposed road extension will be a minimum of twenty-four (24)
feet of pavement;
2. Road construction shall consist of 1' " of wearing surface , 2"
base over 12" of gravel ;
3. The proposed 45 ' x 30' turn-around shall be paved according to
the above specifications for road construction;
4. :The_ extension .of -the sewer .'shall be.subject to the review and
approval of the Engineering Department;
5. Land shall be reserved for a 5 foot sidewalk and a three foot
planting strip on both sides of the roadway;
6. A performance guarantee shall be filed with the Planning Board
prior to endorsement of the plan to ensure completion of the
improvements required under the City of Salem Subdivision Regulations;
7. All applicable Board of Health requirements shall be satisfied;
8. All construction shall be carried out in accordance with the
Rules and Regulations of the Planning Board. A clerk of the Works shall
be provided by the City at the expense of the developer as is deemed
necessary by the Direcor of Public Services and the City Planner;
9. No construction shall commence before 7 :00 a.m. on weekdays and
8 :00 a.m. on Saturdays . Work shall cease at 5:00 p.m. No work shall be
conducted on Sundays or holidays;
a. There shall be no drilling or blasting on Saturdays,
Sundays or holidays.
b. No drilling or blasting shall take place befor 8:00 a.m.
10. As-built plans, stamped by a Registered Professional Engineer
or Land Surveyor shall be submitted to the Department of Public Services
prior to the issuance of Certificate of Occupancy.

This endorsement shall not take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed and no appeal has been filed or that if such appeal has been
filed, that it has been dismissed or denied, is recorded in the grantor
index under the name of the owner of record or is recorded and noted on
the owner' s certificate of title. The fee for recording or registering
shall be paid by the owner or applicant .
