If leaded materials peel, chip, flake or otherwise become defective, coveribgs shielding leaded materials come off, become loose; or d=aged, or reversed surfaces become loose or are re-reversed, new lead hazards are created that may pose a health. threat to children's Pursuant to M.G.L. C. ill, s. 199, the owner of any residential premises is liable for damages associated with a case of childhood lead poisoning arising from his failure to abate lead hazards when a child under six years of age is in residence. A property owner's Potential liability does not end once he has received a compliance letter. Should the dwelling unit and applicable exteriors and common areas fall out of compliance when a child under the age of six is in residence and should the child become poisoned, the owner may be liable for damages associated with his failure to correct the lead hazards. For the safety of occupant children and to protect themselves from liability, property owners must ensure that compliance is maintained. CLPPP recommends that the property owner or his representative visually assece the property for compliance routinely, and whenever the occupant reports chipping or peeling paint, detached coverings, loose putty, or deteriorated plaster.
