.DECISION-ON THE PETITION OF MICHAEL MCNIFF FOR A VARIANCE AT 1315 CROSS
STREET (R-2)
A hearing on this petition was held March 19, 1997 with the following
Board Members present: Gary Barrett, Chairman; Paul Valaskagis, Arthur
LaBrecque, Nina Cohen and Albert Hill. Notice of the hearing was sent to
abutters and others and notices of the hearing were properly published in
the Salem Evening News in accordance with Massachusetts General Laws
Chapter 40A.
Petitioner, is requesting a Variance to subdivide the Lot at 13-17 Cross
Street, a Variance from Lot Size and Frontage to construct a single family
house at 13 Cross Street and a Variance from Lot Size, Frontage, Side
Setback, Front Setback and Rear Setback at 15-17 Cross street.
The Variances which have been requested may be granted upon a finding by
this Board that:
1. Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally
affecting other lands, buildings and structures involved.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the
petitioners.
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district of the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented
at the hearing, and after viewing the plans, makes the following findings
of fact:
1. This will allow petitioner fuller use of the property
2. There was no opposition in this matter.
3. Eric Williams of 15 Hawkes Street, Marblehead, Mass. , co-owner of
the abutting property at 4 Pearl Street was concerned about parking on
Cross Street and requested that only one curb cut be allowed at 13
Cross Street. Additionally, Mr. Williams requested that the petitioner
construct a six (6) foot stockade fence to separate the properties
located at 4 Pearl Street and 13 Cross Street.
4. Patricia Williams of 15 Hawkes Street Marblehead, Mass. , co-owner of
the abutting property at 4 Pearl Street requested that the petitioner
notify the neighbors prior to any demolition and that a rodent control
program be in place prior to any demolition.

5. Jack Zempellin, 32 Lynde Street, requested the petitioner to build a
colonial style house instead of a cape style house.
6. David Goggin, 300 Lafayette Street, was concerned with the quality of
the material in the Barn\Stable, if it is to be sold.
7. Virginia Shea, 10 Pearl Street, requested pest control prior to any
demolition.
On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Zoning Board of Appeal voted unanimously, 5-0 to grant
the variances requested, subject to the following conditions:
1. Petitioner shall comply with all city and state statues, ordinances,
codes and regulations.
2. All requirements of the Salem Fire Department relative to smoke and
fire safety shall be strictly adhered to.
3. All construction shall be done as per the plan and dimensions
submitted and approved by the Zoning Enforcement Officer.
4. Petitioner shall obtain a building permit prior to beginning any
construction.
5. A Certificate of Occupancy is to be obtained.
6. Petitioner is to obtain approval from any City Board or Commission
having jurisdiction including, but not limited to, the Planning Board.
7. Petitioner must obtain a Demolition Permit for 13 Cross Street.
8. Demolition at 13 Cross Street must not commence before 8:30am.
9. Notice of demolition must be given to neighbors five (5) days prior to
any and all demolition 13 Cross Street.
10. A Massachusetts Licensed Pest Control Company must be on site prior to
and during any demolition at 13 Cross Street.
11. There will only be one curb cut for parking at 13 Cross Street and that
curb cut will be located between 13 and 15-17 Cross Street.
12. A six (6) foot stockade fence is to be constructed separating the
properties at 13 Cross Street and 4 Pearl Street.

SECTION 123.0 UNSAFE STRUCTURES
123.1 Inspection: The buiiding official immediately upon being informed by report
or otherwise that a building or other structure or anything attached thereto or
connected therewith is dangerous to life or limb or that any building in that city or
town is unused, uninhabited or abandoned, and open to the weather, shall inspect
the same; and he shall forthwith in writing notify the owner to remove it or make
it safe if it appears to him to be dangerous, or to make it secure if it is unused,
uninhabited or abandoned and open to the weather. If it appears that such
structure would be especially unsafe in case of fire, it shall be deemed dangerous
within the meaning hereof. and the building official may affix in a conspicuous place
upon its exterior walls a notice of its dangerous condition, which shall not be
removed or defaced without authority from him.
123.2 Removal or making structure safe: Any person so notified shall be
allowed until twelve o'clock noon of the day following the service of the notice in
which to begin to remove such building or structure or make it safe, or to make it
secure. and he shall employ sufficient labor speedily to make it safe or remove it or
to make it secure; but if the public safety so requires and if the mayor or selectmen
so order, the building official may immediately enter upon the premises with the
necessary workmen and assistants and cause such unsafe structure to be made safe
or demolished without delay and a proper fence put up for the protection of
passersby, or to be made secure.
SECTION 124.0 EMERGENCY MEASURES
124.1 Failure to remove or make structure safe, survey board, survey report:
If an owner of such unsafe structure refuses or neglects to comply with the
requirements of such notice «ithin the specified time limit, and such structure is not
made safe or taken down as ordered therein, a careful survey of the premises shall
be made by a board consisting; in a city, of a city engineer, the head of the fire
department, as such term is defined in Section I of Chapter 148 of the
Massachusetts General Laws Annotated, as amended, and one disinterested person
to be appointed by the building official; and, in a town, of a surveyor, the head of
the fire department and one disinterested person to be appointed by the building
official. In the absence of any of the above officers or individuals, the mayor or
selectmen shall designate one or more officers or other suitable persons in place of,
the officers so named as members of said board. A written report of such survey
shall be made, and a copy thereof served on such owner.
124.2 Removal of dangerous or abandoned structures: If such survey report
as outlined in Section 124.1 declares such structure to be dangerous or to be unused,
uninhabited or abandoned, and open to the weather, and if the owner continues
such refusal or neglect, the building official shall cause it to be made safe or taken

Barn type structure
Dear Bill:
Per your letter of January 13, 1988 I inspected the above premises on January
29th and have found the following conditions:
- The entire roof is badly sagged and is rotted.
- The southerly side of the structure is badly rotted at ground level.
- Broken glass exists at some windows with plywood on the inside.
- A window on the second floor is open.
- Windows on the back of the structure are open with bars attached to
the inside.
- Southerly side door is not secured well.
- Interior flooring is rotted.
The structure is now being used to store articles for flee-market purposes.
Articles noted were refrigerators, mattresses, large air conditioning units, and
various type of other machinery.
I conclude that the above referenced structure requires immediate extensive
renovations or should be razed in the interest of the public.
I further suggest that your Department investgate the front porches on the
adjacent duplex at 7 and 9 Cross Street with regards to public safety.

Street, regarding it 's disrepair and rodents being seen in the area.
An on site observation noted that the barn roof is in poor repair and appears
to be falling which could create serious health, fire, and safety hazards.
Will you kindly take corrective action to alleviate any potential problems.
We are referring this matter to the Building Department for evaluation.

Dear Mr. Fletcher:
Councillor Usovicz requested that we get in touch with you so that you can appoint
a Board of Survey to inspect the structure at 13 Cross Street in Salem, property
of Mr. William Attridge.
The background on this complaint dates back to September 1974. We brought it
through the courts and in the Superior Court before Judge Johnson on November 19,
1976.
We lost the case because the assessors had listed this property as being X115 and #17
Cross Street even
though there is no fence separating it and has the same owner.
Enclosed find a copy of efforts we have made to have this structure demolished or:
repaired. ,
Councillor Usovicz wants this matter turned over to the Building Inspector for any
further action.

October 23, 1974 Board of Health of City of Sa'LLem, Massachusetts, sent
letter to William Attridge, in regard to his intentions
to either raze or repair the fire damaged structure
at 15 Cross Street
November 4, 1974 John B. Powers, Inspector of Buildings appointed a Board
of Survey to view and inspect premises at 15 Cross Street
in order that a determination may be made with regadd to
the future of the property
Appointed to the Board of Survey were:
Ralph W. Tedford, City Engineer
James F. Brennan, Fire Chief
Laurien L'Italien, 39 Fort Ave., Salem, Mass.
November 62 1974 Ralph Tedford, City Engineer indicated that the structure
was damaged by fire, windows broken, siding missing,
decayed sills exposed, and in his opinion could be
salvaged but only at great expense
November 15, 1974 Laurien R. L�Italien (member of Board of Survey) indicated
the structure cduld be repaired and used as garage.
November 27, 1974 Mr William Attridge advised by the Board of Health, that
structure will be ordered condemned unless rea
are started in 7 days.
December 4, 1974 Mr William Attridge sent letter to the Board of Health that
as soon as insurance is settled on damage the final repairs
will be commenced, he also indicated hi appreciated our
patience on this matter.
March 11, 1975 Certified Mail 786090 sent to Mr Attridge by the Board of
Health advising him that the structure at 15 Cross Street
is a nuisance and a blight to the area. Advised him
to contact the Board of Health within 72 hours on his
intentions. No reply received.
April 15, 1975- Hearing held at District Court in regard to "why a complaint
should" pot be issued'for Violation of the Sanitary Code,

Dear Mr. Powers :
Reference is respectfully made to your recent letter to Mr.
Attridge in regard to the premises at 13 Cross Street, Salem,
Mass . Upon telephoned notice to Mr . Attridge, an inspection of
the premises may be made at any time mutually agreeable to both
of you.
To update you in regard to this property, a complaint was orifi-
, finally filed against William Attridge alone in the First District
Court of Essex for violation of the State Sanitary Code which
pertains to Housing only.
This matter proceeded through the Court system (all told we had a
total of eleven (11) days in Court, finally resulting in a Not
Guilty finding in the Superior Court held at Salem on November 29,
1976.
Since that time, work has been done in regard to inside shoring
etc . , which has resulted in improvement in the strengthening of
the structure, and more work will be done when the present title
problem is taken care of by a Judgment from the Probate Court.
Throughout the proceedings concerning the Board of Health and
also during the Court cases, no mention of Mr. Attridge ' s wife
was made. It is axiomatic that if the property is held by more
than one person and a complaint is made, that all parties be
broughtlbefore, or charged, by the Court or administrative agency
in question.

Outside the aesthetic factors involved, the only thing lacking
here is paint and some finish carpentry work, which will be
accomplished when the property is either sold or the Court action
terminated in my client' s favor.
Should you, or any member of your staff, desire further informa-
tion or an examination of the lengthy court dockets concerning
this matter, I will be pleased to take you to the appropriate
Court and show them to you.

This morning I inspected the exterior of the carriage shed
adjacent to #15 Cross Street as requested by yourself, and I
submit the following for your information.
The northerly side of the building had been damaged by a
fire in an adjacent building, windows were broken, and siding
was missing in several areas, exposing decayed sills, sheathing
studs, and other signs of deterioration.
The exterior of the building could, in my opinion, be sal-
vaged, but only at a great expense.

Dear Mr. Powers: -
0n this date,Nov.6,1974, I inspected the property (a barn) located at
15 Cross St. ,Salem, Mass. ,to investigate conditions likely to cause a fire
or to be a fire hazard. The following are my observations:
The exterior of the structure is in an advanced state of disrepair, with
rotted sills,and the siding has been extensively burned. The roof of
the property has been partially destroyed by fire and presents a continuous .
hazard because of the possibility of total collapse.
The interior of the building has been extensively damaged from a fire and
unless extensive and expensive repair work is initiated immediately, will
continue to threaten the safety of the neighborhood.
I conclude, that because of the extensive damage and a lack of a maintenance
program the structure presents a fire hazard and should be removed.

Section 30. Violation of any lawful rule, order or regulation of the department or of
any lawful rule or order of the marshal or of the head of a fire department, punishment
whereof isnot otherwise provided for, shall be punished by a fine of not more than
ten dollars for each day during which such violation continues after notice to the
offender. Such notice may be given by personal service or by posting the same in a
conspicuous place on the premises thereby. The superior court shall have jurisdiction
in equity to enforce any lawful rule, order or regulation of the department, or any
lawful rule or order of the marshal or of the head of a fire department, upon applica-
tion respectively of the commissioner, the marshal or the head of the fire department.
