Re: 3 Cromwell Street Salem MA
3 Cromwell Street is a legal 2 family dwelling built in the early 1900's. In 1964
Salem passed a Zoning Ordinance that established certain zones for residential,
business and Industrial uses. When the Zoning Map was drawn to allow
Automotive related uses along a section of Bridge Street, portions of several side
streets including Cromwell St fell into that zone even though almost all of the
existing lots contained 1 and 2 family dwellings. There are literally hundreds of
similar properties throughout Salem.
3 Cromwell Street is considered an"existing noxi-conforming" 2 family dwelling.
This use can continue without any time limits. If the house were destroyed by
fire our other catastrophe,it could be re-built to the same footprint and floor area
as previously existed.
If an owner were to intentionally demolish 3 Cromwell Street or other similar
non-conforming properties, they would need relief from the Zoning Board to
build a building for business use because although the use would be allowed, all
the residential properties in the area are on small lots that do not meet the
required minimum lot area requirements. My opinion is that these properties
will remain as non-conforming residential properties far into the future.
