In addition; if your client is proceeding under the current zoning ordinance, he ap- pears to be in violation of both the density (maximum lot cov- erage-508 ) and maximum height of walls ( 6 feet ) . Our client , David Jaquith, who, with his wife, owns the above property, received a letter, dated April 10 , 1986 , from William H. Munroe, Zoning Enforcement Officer for the City of Salem. In that letter Mr. Munroe told Mr. Jaquith that the issuance of a Certificate of Occupancy by the Building Department would depend, among other things, on compliance with the Order of Conditions set forth by the Zoning Board of Appeal . Specifically, Mr. Munroe emphasized condition number three : This variance is conditioned upon the petitioner ' s compliance with the terms of the City of Salem' s deed which in- cludes the granting of a fifteen foot easement to an abutter. The deed conveying 10-12 Crombie Street from the City of Salem to David and Roberta Jaquith makes no reference to that easement. I have also reviewed the Contract for the sale of land for Private Development dated April 16 , 1982 , which terms , con Lliti nng and restrictions are incorporated by reference into said deed from the City of Salem. There is no reference to any easementJn this Contract. As we also discussed, the Jaquith ' s purpose for seeking the variance was to petition to allow tworesidentialunits in a B-3 district, a zone where residential use was prohibited. Between the time that the variance was granted (April 22 , 1981) and the start of construction (Fall of 1985) zoning for the area including 10-12 Crombie Street was changed to allow for residential use. These factors make it impossible to use the property for any use which is permitted as a matter of right in a B-3 district. (2) The conditions described above especially affect the property in question but do not 'generally affect the zoning district in which the property isalocated. (3) The conditions described above which affect the land in question, but not the zoning district generally cause the following special hardship: if the requested variance is not granted, the property is valuless and cannot be devel/ped in a manner consistent with the terms of the City of Salem's restrictions for the property. After the acceptance of the bid by the City, the building and contents shall become the property of the contractor, and the contractor will immediately assume all responsibility for damage to the building and contents as a result of fire , vandalism, or other cause . It is the intent of these specifications to dispose of the entire building, including all contents , to a competent building wrecker who will demolish the structure , including foundation walls to twenty-four (24) inches below grade , and complete the contract within three (3) weeks after signing of the contract . 2 - Before demolishing work is started, the building wrecker shall notify the City of Salem Water and Sewer Departments to disconnect these services, after which they shall be capped by a licensed plumber. ' The Building wrecker shall also notify all other public utility companies whose services enter the building to disconnect same . Any expenses in connection with the work shall be paid by the building wrecker. The building wrecker shall remove all dirt and rubbish from time to time as the Superintendent of Public Property shall direct , and leave the premises clean upon completion of the work. The building wrecker shall be liable for any damage caused as a result of de- molishing the building. No sub-contract is to be let without the written approval of the Superintend- ent of Public Property. After the acceptance of the bid by the City, the building and contents shall become the property of the contractor, and the contractor will immediately assume all responsibility for damage to the building and contents as a result of fire , vandalism, or other cause . No piling of material for resale will be allowed. No cleaning of bricks at the site will be permitted. The building wrecker shall provide suitable lights overnight to protect against any possible hazard to cars or persons who may have occasion to be in the vicin- ity of this structure . At completion of demolishing work, the building wrecker shall erect a temporary fence or suitable barrier as approved by the Superintendent of Public Property. Bids are to be returned on this form. The right is reserved to reject any or all bids .
