Each unit has sufficient sound insulation to prevent a noise nuisance to other units or area residences. Response All residences have acoustic insulation in walls between units as well as in floors with contiguous units. 2. Each unit has individual ventilation that is equipped to prevent a odor nuisance to other units or area residences. Response All residences have individual ventilation in both kitchens and bathrooms. 3. By-laws for the condominium association must state that residents of the condominiums may not create an odor or noise nuisance. Response The condominium association is formed after the majority of units are sold and occupied. We will notify the association at the appropriate time of this Health Department requirement.. 4. Each unit must have, in accordance with the State Housing Code 150 sq ft of floor space for its' first occupant, and at least 100 sq ft of floor space for each additional occupant. The floor space to be calculated on the basis of total habitable room area. Response All units conform to this requirement. 5. Each unit must have in every room occupied for sleeping purposes at least 70 square feet of floor space,every room occupied for sleeping purposes by more than one occupant shall contain at least 50 sq ft of floor space for each occupant.. Response All units conform to this requirement. And with the following regular conditions: 1. The individual presenting the plan to the Board of Health must notify the Health Agent of the name, address and telephone number of the project(site)manager who will be on site and directly responsible for the construction of the project. Response Our site superintendent is Mr. Dan Beals. 2. The developer shall adhere to a drainage plan as approved by the City Engineer. The developer shall employ a licensed pesticide applicator to exterminate the area prior to construction, demolition and/or blasting and shall send a copy of the exterminator's invoice to the health agent. Response A-1 Exterminators completed a rodent extermination program prior to the beginning of demolition. When we receive their invoice we will forward a copy to you. 4. The developer shall maintain the area free from rodents throughout construction. Response The site supervisor has been notified of this requirement and will take appropriate action if rodents retum. 5. The developer shall submit to the Health Agent a written plan for dust control and street sweeping which will occur during construction. Response It is our intent to have sub-contractors: • clean up after themselves on a daily basis including vacuuming, • isolate work areas with plastic enclosures where excessive dust is created, We have already hired a laborer—Sean McKinnon, whose job it is to monitor both interior and exterior conditions for dust and debris. We will also have a dumpster on site until the conclusion of construction. 6. The developer shall submit to the Health Agent a written plan for containment and removal of debris,vegetative waste and unacceptable excavation material generated during demolition and/ or construction, Response We have a licensed demolition contractor on site at the moment who is isolating construction debris and hauling it to appropriate disposal sites. Our construction supervisor will also be monitoring waste during construction and disposing of it appropriately. 7. The Fire Department must approve the plan regarding access for firefighting. Response The Salem Fire Department has approved this project. B. Noise levels from the resultant establishment generated by operations, including but not limited to refrigeration and heating,shall not increase the broadband sound level by more than 10 dB(A) above the ambient levels measured at the property line. Response We have commissioned a study by an acoustical engineering firm(in the schematic design stage) to advise on noise levels associated with rooftop A/C units. We will be following their recommendations to isolate and contain noise levels to conform to State requirements. 9. The developer shall notify the Health Agent when the project is complete for final inspection and confirmation that above conditions have been met. Eng., has reviewed your concerns and we are revising fabrication of 2 gusset plates as well as reconstructing and reinforcing the second floor barrel vault. Once this work is complete he will issue a letter of compliance which I shall forward to your office, • The masonry construction at the rear of the building has not yet been completely demolished and reconstructed. This will be done according to instructions from Mr. Georgis. All masonry openings will have properly installed loose lintels, • The drywall nail spacing is being addressed and our installer will review and correct deficiencies, • Safety handrails have been reinstalled where they had been temporarily removed to handle a drywall shipment, • Additional safety handrails have been located where required, • All propane tanks have been removed from the site, • The sheetrock has been removed form the first floor hallway in anticipation of a final framing inspection, • The electrical wiring identified as being exposed has been corrected, • We have had a number of clean ups and will continue to maintain as clean a site as it is possible to do. The work consisted of the repair of a damaged masonry wall at the rear of the building, and the improvement of flashing on the shelf at the top of the damaged wall. There was no need to move occupants out of the building in the course of construction work, therefore, building occupancy was not affected. At that time the Board asked if you were aware if the building official and the opposing party were here to sit in on the hearing. It was stated that you did not see them. The board also asked if your neighbor/abutter had any issues with your appeal request. It was stated that they had no issues and were in favor of your request. From the testimony the board heard that morning and the fact that nobody was there to testify against your request they voted to grant your variance and the hearing was closed. A short time later, Assistant Building Inspector, Joseph Barbeau appeared with Mr. Mike McGinn of 12 Winter Street, Merrimac. They notified the Board that not only had they been waiting in another room for the hearing to start but also that you were aware they were there because they had a conversation with you and the man you were representing. The board then asked Mr. McGinn if he was in favor of us granting your appeal like it was stated earlier from the testimony heard and he stated absolutely not. The board at that time had a discussion about what had transpired and decided that they had no other alternative but to rescind their original verbal decision and to re-open the case. When the new date has been decided you will receive in the mail the date and time to re-appear for the new hearing. The building inspector as well as the abutter both has the right to provide testimony in this appeal and that will be done at the new hearing. I was told that it hadn't been issued yet; and that no increase (days? or beds?) would be granted. If this is so: how could your agency be in possession of such a certificate,that runs counter to these statements, from November 1, 1999 to November 1, 2,000? Additionally, the up-creep from a request for"Emergency Winterbeds for Homeless Individuals from a maximum of 165 days ($30,60 to this year's 199-days ($35,820), leads us to believe that, as the function of the Crombie Street Church devolves from its religious role, that there will be continuous efforts to further establish a higher and higher presence in Salem, of services for the State's wandering homeless. This is a very sensitive issue in Downtown Salem for those of us who care about the City's destiny and who pay the taxes, which support this operation as well as the City. In accordance with 780 CMR 122.3, Appellant requests that the Board grant a variance from 780 CMR 705.3 of the Massachusetts State Building Code ("MSBC") regarding 7 Crombie Street, Salem, MA. In accordance with MGL c. 30A, §§ 10 and 11; MGL c. 143, §100; 801 CMR 1.02 et. Seq.; and 780 CMR 122.3.4,the Board convened a public hearing on September 7, 2006 where all interested parties were provided with an opportunity to testify and present evidence to the Board. Findings of fact 1. The subject property is a seventeen unit condominium building located at 7 Crombie Street, Salem, MA. 2. Several window opening are located on the south side of the building. 3. The south side of the building is 1' 6" inside the property line. 4. Salem zoning requires a side yard to have a five foot minimum set back from the property line. As a result the number of window openings on the south side of the subject property are limited.. This is a concise version of the Board's decision. As a compliance alternative the Salem Building Commissioner allowed the owner of the subject property to install exterior sprinkler heads immediately above each window opening. 6. The Appellant seeks a variance from 780 CMR 705.3 in order to install two new window openings on the south side of the building in the new second story addition to the subject property. 7. The Appellant originally sought a variance from 780 CMR 705.3 to install three new window openings but as a result of the Appellant increasing the property set back to approximately five feet one window opening was removed from this appeal. 8. Exterior sprinkler heads will be installed above the two new window openings. Discussion A motion was made to GRANT the Appellant's request for a variance from 780 CMR 703.5 based upon the fact that there is a zoning requirement for a five foot setback minimum from the property line. There is nothing currently constructed behind the subject property and nothing should be constructed within five feet of the rear property line. The exterior window sprinklers must be installed to provide additional protection for the two new window openings. Motion carried 3-0. Conclusion The Appellant's request for variance from 780 CMR 703.5 of the MSBC is GRANTED. SO ORDERED.
