I am writing pursuant to M.G.L. c. 40A, Section 7 to request that you take action to compel the removal of a portion of the structure located at 13 Barton Square which encroaches upon my clients' property. Specifically, a small section of the roof structure which was recently rebuilt extends over the lot line into air space of my clients and prevents the planned expansion of the building. It is my understanding that the recent work to 13 Barton Square was completed without a building permit. February 16, 2006 Joseph Barbeau, Assistant Building Inspector City of Salem 120 Washington Street Salem, MA 01970 Re: BBRS Docket#05-091 Dear Mr. Barbeau Paul Wakem, the State Building Inspector asked that I prepare a narrative of our activity related to Michael McGinn,the westerly abutter to our project at 7 Crombie Street. Please review this document and let me know if you take exception to any of its contents since it does paraphrase some of the statements made by you. He also asked that you forward this information to him. In early March of 2005 we started the formal permitting process for the project with the City of Salem which included the following advertised public hearings; 2 meetings with Planning Board, 3 meetings with Salem Redevelopment Authority, 2 meetings with the Design Review Board and 1 meeting with the Health Department(see attached schedule of meeting dates).We also conducted a voluntary public meeting on site in which we invited all abutters and residents of Crombie Street. About 12 people(a majority of Crombie Street households)attended the meeting and were supportive of the project. The project as designed conformed to the City of Salem Zoning Bylaws,therefore no appeal for relief was required. In September of 2005,we began meetings with the abutters to update them on our plans and give them more details about the construction operation and contact information. On Monday,August 8 of 2005, Lex George, our project manager met with Mr. McGinn to inform him of our intentions and to ask permission to remove his encroaching overhang. Strategically,our approach was to establish and maintain good relationship with the three abutters and proactively prevent interference with our project.We also wanted to remove his encroachment by agreement rather than by any procedural or legal action.At the meeting, Mr. George negotiated with Mr. McGinn a scope of work that we estimated to be worth about$20,000 to be performed by our team to Mr. McGinns property that included moving 1 window, repair to his wall, upgrading an existing fence and the installation of some skylights. As we became more familiar with the condition of Mr. McGinn's property, particularly the non- compliant nature of certain building elements,we decided that is was not in our best interest to actually be performing work on Mr. McGinn's property so the in late August of 2005 we engaged Scott Grover,Attorney at Law to help formalize communications with Mr. McGinn and negotiate a price to pay for some of these improvements; attorney Grover was authorized to negotiate in the neighborhood of$20,000.Although communications were minimal and unsuccessful, Attorney Grover opined that Mr. McGinn was seeking compensation well beyond the cost of improvements Eo" SSE%STREET,SUITE 300 M,MASSACHUSETTS 01970 NE 978.744.7379 FAX 978.741.0240 .WSAlchitects.com and in the neighborhood of$100,000. Knowing that we had no obligation to improve Mr. McGinn's property and realizing that the price of establishing a cooperative relationship with Mr. McGinn was well beyond reason and our budget, we withdrew our offer from the table. Also believing that an agreement with Mr. McGinn in regards to his encroachment was unlikely and that the procedural or legal approach would further delay our construction we modified our design to work around the encroachment. On September 21, 2005, Mr. McGinn filed plans with the building department to modify his structure. Based upon statements we understand that he made when filing, we believe that he hoped to achieve financial gain from us by doing so. A more detailed description of the actions subsequent to the September 281h meeting is included in the attached letter,dated January 13, 2006 and submitted on our behalf to Mr. Shuman, Chairman of the BBRS, by Attorney William F.
