Dear Owner:
On Tuesday, September 12, 2023, at the request of the Salem Fire Department,
David Greenbaum, Health Agent, for the Salem Board of Health responded to
your property at 9 Pleasant Street, for a partial building collapse. Upon arrival, a
wall on the back addition of your property had collapsed into your neighbor's
yard. With your permission, further inspection of the dwelling was conducted-and
the following conditions that could materially impair the health and safety of the
occupants were noted:
• There is no hot water in the house.
• There is no heat in the house.
• The ceilings throughout the home are collapsing.
• There are exposed electrical wires throughout the house.
• The electric panel in the basement is uncovered with exposed wiring.
• The oil tank is rusted and rotting out.
• There are many missing walls and ceilings creating a severe fire hazard.
• Due to the partial building collapse the electricity to the house has been
terminated at the pole.
Based upon these conditions, the Salem Board of Health deems this
dwelling unsafe and unfit for human habitation. Based upon these findings
and in accordance with 105 CMR 410.630(B), the Board of Health
determines that the danger to the life or health of the occupants is so
immediate, condemnation is ordered immediately and the hearing
requirements of 105CMR 410.800 are waived. All occupants of the
residence are ordered to vacate the unit immediately. If any person refuses
to leave the dwelling they may be forcibly removed by the Board of Health
or by local police authorities on the request of the Board of Health.
If after one year from the issuance of an order to secure compliance with the
minimum standards set forth in 105 CMR410.000 has not been affected, then the
Board of Health may cause the dwelling to be demolished. Any costs borne by
the Board of Health are a debt to the City and shall be recoverable from the
owner in an action of contract.
No dwelling or portion thereof, which has been condemned and placarded as
unfit for human habitation, shall again be used for human habitation until written
approval is secured from, and the Board of Health removes such placard. No
person shall deface or remove the placard, except the Board of Health shall
remove it whenever the defect or defects upon which the condemnation and
placarding action was based have been eliminated.
Should you be aggrieved by this Order, you have the right to request a hearing
before the Board of Health. A request for such a hearing must be received in
writing in this office of the Board of Health within seven (7) days of receipt of this
Order. At said hearing, you will be given the opportunity to be heard and to
present witness and documentary evidence as to why this Order should be
modified or withdrawn. You may be represented by an attorney. Please also be
informed that you have the right to inspect and.obtain copies of all relevant
.inspection or investigation reports, orders, and other documentary information in
the possession of this Board, and that any adverse party has the right to be
present at the hearing.
