Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The petitioner is requesting Variances to divide non-conforming parcels into 3 parcels to construct 4 duplex lots. Variances requested are lot width, front and side yard setbacks, lot coverage and building height for the property located at 11 Cousins Street R-2 The Variances which have been requested, may be granted upon a finding by this Board that: a. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structure involve. b. Literial enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying substantially derogating from the intent of the district of of purpose of the Ordinance. The Board of Appeal after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. Petitioner Michael O'Brien, Manager of 1 I Cousins St. Realty Trust, petitioned this Board in August, 2004 seeking to subdivide and for dimensional variances to allow development of 11 Cousins St. After opening the petition, the Board asked petitioner to make changes in the design in response to neighborhood concerns. This they did, and the revised petition was reopened at the Board's October hearing. 2. Presented by Attorney Jack Keilty and surveyor Christopher Mello, petitioners plan calls for residences to be built at the former site of a manufacturing facility. The factory, which was in tax arrears, was demolished by the City of Salem several years ago and the site, at the center of a residential neighborhood, has since been vacant. DECISION OF THE PETITION OF MICHAEL O; BRIEN MANAGER, REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 11 COUSINS STREET R-2 page two :s r z rrtl 3. Petitioner's plan calls for 3 two-and-a-half story duplex townhouses to be constructed, each on a separate lot with less than the required amount of front Ue and insufficient front and side yard setback space to meet the dimensional requirement of the Ordinance. Access to and egress from the lot would be frog Webb St. The development would be marketed and sold as a condominium association consisting of six two-bedroom units. n 4. Property owners who have moved into a new condominium development made from the adjacent Polish Falcons Social Club building sought to maintain access to their rear parking lot via a driveway between the two properties, and petitioner agreed to grant an easement for the perpetual use of such driveway by succeeding owners of those condominiums. 5. In addition, petitioner agreed to install sidewalks and four-foot metal fencing similar to that of the adjacent condominium along the Cousins St. side of the property, and to install landscaping at the rear property line to lessen impact on the Allen St. abutters. 6. As grounds for his variance request, Petitioner states that the property is subject to a state-mandated 21E abatement plan not caused by his actions that will require a significant investment in clearing contaminated soil from the site prior to any development. Further, he argues that as a former manufacturing property, the size of the lot is a factor that makes it unique. Most of the surrounding homes are on lots much smaller than is required by the ordinance. Given the disparity, it would be anomalous to enforce lot size and frontage with respect to one site in an area where lots are uniformly undersized. 7. Petitioner met with neighbors in August to discuss the impact that the development would have, and submitted a petition in support of the proposed development signed by 7 neighbors. Also speaking in support of the petition were David Winter of 17 Cousins St., and Lucy Corchado, Ward 1 City Councillor. 8. Aletha Hill of 12 Allen St was concerned about dust during soil removal. 9. Paul Lessard approved of the revised design, finding it appealing, and he requested that the record show the first floor should be no more than 3 ft above street level. 10. Speaking in opposition were Paul and Lou Grocki of 8 Cousins St. and Mark Calchowski of 12 Cousins St., on the grounds that the proposed duplex townhouses would be overly large for the small street and homes. On the basis of the above findings of fact, and on, the evidence presented at the hearing, the Zoning Board of Appeal concludes as follows: 1. Special conditions exist which especially affect the subject property but not the District. Petitioner shall comply with all city and state statues, ordinances, codes and Regulations. 2. All construction shall be done as per plans submitted and approved by the Building Commissioner. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. Petitioner shall obtain a Certificate of Occupancy. 6. Petitioner shall obtain proper street numbering from the City of Salem Assessors Office and shall display said number so as to be visible from the street. 7. Petitioner shall obtain approval from any City Board or Commission having Jurisdiction including, but not limited to, the Planning Board. 8. Finish floor no higher than grade. 9. Condo association shall include snow removal. 10. Petitioner shall have sidewalk installed on Cousins Street. THE WORK TBSC shall perform work,provide the Services,supply such Equipment and furnish such other materials, supplies and other items as it determines are required to install the System described in the Attachment(the "Work").TBSC will perform or cause its subcontractors to perform the Work in a good and workmanlike manner,in accordance with prudent industry standards and practices.TBSC shall not make any changes in the Work unless agreed to in writing by the Owner. 2. REQUIRED PERMITS TBSC shall be responsible for acting as the Owners agent to secure any permits required for the installation. All permit costs are included in the price for the Work. If you secure your own permits,you will be excluded from the Guaranty Fund provisions of Chapter 142A of the Massachusetts General Laws. 3. WARRANTIES TBSC warrants that,under normal use and service conditions,the System will be free from defects in workmanship and/or materials for ten(10)years after the date of the Work being completed(this"Limited Warranty").This Limited Warranty includes servicing manufacturer warranties free of charge.TBSC warrants any damage to Owner's roof within a five(5)inch radius of roof penetrations during performance of the Work. If a defect is discovered,TBSC will,at no additional cost to Owner,provide such labor and materials as required to restore the System to its originally installed state.If TBSC finds that the problems were not caused by the Work,or if the problems are not an actual problem of the System(e.g.shade or unauthorized alterations to the System),Owner will pay for any new parts and materials,and TBSC reserves the right to charge Owner a service charge of$100 per hour with the minimum service charge equal to$200. 1 QBOSTON SOLAR SOLAR SYSTEM PURCHASE AND INSTALLATION AGREEMENT Effective immediately upon Owner making the final payment under this Agreement,TBSC hereby assigns to Owner,to the extent assignable,any and all manufacturer warranties covering the Equipment and shall deliver copies of such warranties after its receipt of such final payment. 4. TIME FOR PERFORMANCE TBSC shall perform the Work diligently,without unnecessary delays or interruptions and in a timely manner until completed.TBSC shall use reasonable efforts to start and complete the Work according to the timing described in the Attachment. 5. INSURANCE AND LICENSING TBSC represents and warrants to the Owner that TBSC or any subcontractors performing the Work shall be licensed and hold insurance coverage as required by applicable laws. TBSC is registered as a Home Improvement Contractor with the Massachusetts Office of Consumer Affairs and Business Regulation,under registration#169698. 6. OWNER CANCELLATION RIGHTS If Owner delivers a completed Notice of Cancellation within three(3)business days after the date of this Agreement,TBSC shall refund and return the Deposit in full to the Owner within ten(10)business days after its receipt of such Notice of Cancellation(attach to this Agreement). Owner acknowledges that TBSC will spend time and money evaluating the Property,designing the System and preparing the Work.If Owner cancels this Agreement after ten(10)business days,a cancellation fee of $1,000 will be deducted from the Deposit.Any permit costs and unrecoverable equipment costs incurred by TBSC will be added to the cancellation fee and deducted from the Deposit. 7. TAX CREDITS,REBATES AND SRECS The Owner may be entitled to certain financial benefits related to the ownership and use of the System, including state or utility rebates("Rebates"),solar renewable energy certificates("SRECs"),state and federal Income tax credits and net metering credits("Net Metering")(collectively defined as"Benefits").TBSC shall prepare,process and submit applications on behalf of Owner for Rebates,SRECs and Net Metering.TBSC is acting purely as an administrative agent and cannot guarantee the outcome of such applications. The Attachment Includes an estimate of the Benefits that may be available to the Owner.TBSC makes no representation or warranty with respect to the Owner's eligibility to receive such Benefits.In all cases,Owner agrees to consult with the relevant governmental officials and Owner's accountant when evaluating Owner's eligibility for and the financial and tax consequences of receiving Benefits. 2 BOSTON SOLAR SOLAR SYSTEM PURCHASE AND INSTALLATION AGREEMENT 8. PRE-EXISTING CONDITIONS AND PROPERTY PROTECTION TBSC shall not be responsible for any damages as a consequence of the Work performed on the site due to pre-existing conditions(e.g.cracked or broken shingles,faulty electrical wiring,etc.) TBSC reserves the right to suspend performance of the Work or terminate this Agreement with no liability to TBSC whatsoever if it discovers unanticipated site conditions that will increase the cost to perform the Work. If such termination occurs,TBSC shall refund all monies paid to TBSC reduced by any expenses actually incurred.However,if Owner and TBSC agree,the price may be renegotiated to reflect the true cost of the Work. TBSC will make best efforts to protect any property of the Owner,but the Owner is responsible for removing and replacing appliances,floor coverings,and any other obstacles or hazards required to perform the Installation.TBSC is not responsible for replacement of or damage to these items if they are removed by TBSC. 9. CUSTOMER OBLIGATIONS Owner agrees to:(a)notify TBSC immediately upon discovery of an emergency condition relating to the System,damage to the System,or theft of the System;(b)only have the System repaired pursuant to the Limited Warranty(as defined herein);(d)not modify the Property in a way that shades the System;(e)not do anything,permit or allow to exist any condition or circumstance at the Property which would cause the System not to operate as intended;and(g)permit TBSC,after providing reasonable notice,to inspect the System for proper operation,and to make any necessary repairs.Customer agrees to not make any modifications, improvements, revisions or additions to the System or take any other action that could void the Limited Warranty(as defined herein)without TBSC's prior written consent.If Owner fails to comply with the provisions of this paragraph,Owner's Limited Warranty shall be automatically voided. 30. GENERAL PROVISIONS Any disputes which may arise between the Owner and TBSC shall not impede or interfere with the diligent performance by TBSC of the Work.This Agreement shall be subject to and Interpreted In accordance with the laws of the State of Massachusetts. From a field inspection of the property,the existing roof support structures were observed by the client's auditors as follows: The roof structure of(MPI)consists of composition shingle on roof plywood that is supported by modular howe trusses that are spaced at @ 24"o.c..The trusses have a max projected horizontal span of approximately 27'-0"between exterior load bearing walls,and a slope of 23 degrees.The top chords are 2x6 sections,the bottom chords are 2x6 sections and the web members are 2x4 sections.The truss members are connected by steel gusset plates.The max unsupported projected horizontal top chord span is approximately 9'-6". The existing roof framing system of(MP3)isjudged to be adequate to withstand the loading imposed by the installation of the solar panels.No reinforcement is necessary. The spacing of the solar standoffs should be kept at 48"o.c.with a staggered pattern to ensure proper distribution of loads. I further certify that all applicable loads required by the codes and design criteria listed below were applied to the Ironridge solar rail system and analyzed.
