RE; 21 Willow Ave- Code violation
Dear Mr. Camire, you were cited by this Department approximately a year ago regarding non-compliance with
Appendix K of the Building Code( Sound Transmission Code)regarding your permit to completely rehab
21 Willow Ave, units one and two. At the time of the initial notice, you were given the right to Appeal my
interpretation of the Code to The Board of Buildings, Regulations and Standards in Boston. You have not done
so. We are aware that you recently had a sound Engineer conduct a Sound (STC)test and that you failed one
portion of the test. You asked me to check with the State Inspector, John Bennett, to see if you could file for a
variance from this section of the code and Inspector Bennett responded that it was an un- likely proposition. .
You are now directed to arrange for and secure a building permit within 30 days of this notice and for the work
to begin and be completed within 45 days of this notice. Failure to arrange for this work will result in daily fines
and further enforcement actions. .

Dear Mr. Camire,
As we discussed , the tenant, in unit one, has been complaining about the sound levels being transmitted from
the unit above. The Mass State Building Code requires conformance with Sound Transmission Class (STC ).
It does not appear that you are in conformance with this code. The code for Airborne noise levels are required to
have a STC rating of less than 50 or 45 when Field tested. . Structure borne noise level require the same level of
compliance The Code reference is appendix K in the one and two family Mass State Building code 780 C.M.R.
Therefore, you arc directed to submit testing from a qualified sound testing firm to demonstrate either
compliance or non compliance and if non-compliant, a cure or remedy for the issue within 30 days of this
notice. If you have any questions, please contact me directly. If you feel you are aggrieved by this order, your
Appeal is to the Board of Buildings, Regulations and Standards in Boston.

Hi Tom,
I spoke with John Camire yesterday and he spoke to a
sound engineer. The engineer told him there is no sound
code for a remodel. He has been stalling for over two
months. Does Appendix K require the sound performance
even in a remodel of a one and two family dwelling?
